A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING
ISSUANCE OF MULTIFAMILY HOUSING REFUNDING REVENUE BONDS FOR
REFINANCING OF PROJECT OWNED BY CHEVY CHASE ANAHEIM PARTNERS
WHEREAS, the An.a, heim Housing Authority (the "Authority") is authorized by A..rtide 11 of
,,C, hapter 3 qf Part I of Division 2 of Title 5 of the Government Code of the State of Cal~tornla (the
'Law") to Issue and sell refunding revenue bonds for the purpose of refunding outstanding
bonds of the local agency, and the Law provides a cemp ere, additional and alternat ve method
for such financing;
WHEREAS, the Authority has previously Issued its Anaheim H. ousing Authority
Adjustable Rate Demand Multifamily Housing Revenue Bonds, 1988 Setres A (Park Vis~
Apartments Project) in the principal amount of $26,000,000 (the "Prior Bon.,cL.s") for the purpose or
providing financing for the acquisition of land and rehabllltatidn, cons. tructlo.n. and devalo~mant
thereon of multifamily rental housing facilities located within the area or operason of the Aumorlty;
and
WHEREAS, Chevy Chase Anaheim Partners, A California. Limited Partnership (the
"Developer"), has requested the Authority to issue Its multifamily housing refunding revenue
bond.s (the "Bonds") under the ,.L.a.w for t.h.~ purpose o.f refinancing a 3§2-unit multifam~ily..r. en~l
hous~n_g development located w~thm the .C~ty of Anaheim on a 19-acre ai.te bounded by L;al~Tornla
State Route 91 On the north, Romn)/a. Dnve on the south, Manzanita Par~( on the east and Patrick
Henry School on the west (the "ProJect") financed with the proceeds of the Prior Bonds: and
WHEREAS, the Bonds will be considered to be "qualified exempt facility bonds" under
Section 142(a) of the Int,ernal Revenue. Code of 1986, a~. amended (the ;Code'}, and Section
1.47(f) of the Code requires that the applicable electoa rep~sentative with respect to the
Authority hold a public hearing on the Issuance of the Bonds; ana
· WHEREAS the Authority has determined that the City Council of the City of Anaheim is
the "applicable elected representative" to hold said pub c heanng; and
WHER_ EAS, notice of.said public .hearing has been duly given as required by the Code,
,and the City Council of the C~ty of Anahe~ .m. has heretofore held such publichoB.ring at which all
~ntereeted persons were given an opportun!ty to, be heard on all matters relative to the refinancing
and operation of the Project and the Author ty's ~ssuance of the Bonds therefor; and
WHEREAS, the City Council of the City of Anaheim, as the "applicable elected
repres?ntative" of the Authority, approves of the issuance of the Bonds as In the public interests
of the ^uthortty.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, as
tollowe:
1. The City Council of the City of Anal~eim hereby finds and determines that the
foregoing recitals are true and correct.
2. Th.e. City Council of the City of Anaheim hereby approves the Issuance of the Bonds
by the Authonb,/under the Law for the purpose of providing funds to reflnance the Project.
.3. Tt~e Issuance of the Bonds sha.II be subJ.e. ct to approval by the Authority of all
· financing documents relating thereto to which the Authority is a party and subject to the sa['e of the
Bonds to the underwriter thereof.
4., This resolution shall take effect immediately.
