93-185 RESOLUTION NO. 93R- 185 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF kNAHEIM AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND DISTRIBUTION OF WATER AS ADOPTED BY RESOLUTION NO. 72R-600 AiYD MOST RECENTLY AMENDED BY RESOLUTION NO. 93R-45. WHEREAS, the City of Anaheim maintains a water distribution system for the furnishing of water to residents and inhabitants of the City of Anaheim and has adopted Water Rates, Rules and Regulations for the sale and distribution of water; and WHEREAS, A Notice of Hearing was published as follows: On July 26, 1993, notice of the public hearing on water rates was published in the Orange County Register and proof thereof is on file with the Secretary of the Public Utilities Board. WHEREAS, the Public Utilities Board held a public hearing on August 5, 1993 and evidence was presented in connection with the proposed revisions of Water Rates, Rules and Regulations; and WHEREAS, The Public Utilities Board has considered the proposal of the Public Utilities Department and has considered the evidence presented at the public hearing; and WHEREAS, the Public Utilities Board has made the following findings with respect to the need for changes to the Water Rates, Rules and Regulations: 1. The Water Utility has water services with compound meters. 2. In determining customer schedule assignments for compound meters, it is appropriate to give consideration to changed circumstances with service requirements and industry practices. 3. Allowing the private fireline portion of the compound meter to take service under the Private Fireline schedule is a more equitable treatment than the current practice. 4. In allowing customers to take water service on a temporary basis, it is reasonable to require that such service be metered to better control the consumption of water and reduce system losses. Therefore, it is reasonable to eliminate unmetered temporary service connections and spacer connections. 5. On the basis of the preceding findings, the applicability and rate and rule changes proposed for Schedules W-PFL, W-T, and Rule 13 are reasonable and appropriate. 6. It is appropriate to decrease the Water Utility revenue from sales budget for fiscal year 1993/94 by $183,000. 7. It is appropriate to decrease the Water Utility debt service budget for fiscal year 1993/94 by $65,000. 8. It is appropriate to decrease other miscellaneous operating costs in fiscal year 1993/94 by $118,000. WHEREAS, the Public Utilities Board considered the California Environmental Quality Act (CEQA) and made the following findings: 1. The establishment of these rates as set forth above will ensure adequate revenues necessary to meet water supply costs, operation and maintenance expenses, capital expenditures, debt service requirements, reserve amounts, intracity transfers, and other necessary operating and maintenance expenses. 2. The matters covered above come within Section 21080 (b) (8) of the Public Resources Code of the State of California. Section 21080 (b) (8) states that CEQA does not apply to the establishment, modification, structuring, restructuring, or approval of rates, tolls, fares, or other charges which the public agency finds are for the purpose of meeting operating expenses, materials, meeting financial reserves, obtaining funds for capital projects necessary to maintain service within existing service areas, or obtaining funds necessary to maintain those intracity transfers as are authorized by city charter. Thus, the establishment of these rates is exempt from CEQA. WHEREAS, based on the findings hereinabove made, the Public Utilities Board of the City of Anaheim recommended to the City Council that the Council adopt the findings of the Public Utilities Board with respect to the matters contained herein and adopt the changes to the Water Rates, Rules and Regulations as shown in Appendix B; and WHEREAS, based on the findings hereinabove made, the Public Utilities Board of the City of Anaheim recommended to the City Council that the Council, by Motion, certify that the adoption of the Water Rates, Rules and Regulations is statutorily exempt under CEQA, Public Resource Code, Section 21080 (b) (8), in accordance with Title 14 of the Code of California Regulations, Section 15273 (a), and authorize the City Manager to execute, and the City Clerk to file, a Notice of Exemption for same with the Orange County Clerk; and WHEREAS, the City Council has considered the evidence and concurs with the findings of the Public Utilities Board as set forth hereinabove. NOW, THEREFORE BE IT RESOLVED that: 1. The findings of the Public Utilities Board as set forth herein are hereby adopted by the City Council of the City of Anaheim. 2. The changes to the Water Rates, Rules and Regulations as shown in Appendix B are hereby adopted by the City Council of the City of Anaheim and will become effective September 17, 1993. 3. The Public Utilities General Manager is hereby authorized and directed to prepare, promulgate, publish, and implement changes to the Water Rates, Rules and Regulations as set forth herein. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim on this 14th day of September 1993. Anaheim Blvd. 3. ~3. ~ Anah~m, CA 92805 Page No. RULE NO. 13 TEMPORARY SERVICE CONDITIONS OF SERVICE The City shall, if no undue hardship to its existing customers will result therefrom, furnish temporary service for construction work, circuses, Christmas tree lots, bazaars, fairs, plumbing pressure testing, or other similar uses, that because of their nature will not be used steadily or permanently. All such services shall be subject to the following conditions: 1. Application for temporary service, with appropriate deposits, shall be made to the Utility. The deposits for Temporary Service shall be refunded except as defined in condition 2 below, after char~es for permits, water consumption, loss of or damage to meter and fittings, and installation and removal charges have been deducted at the termination of service. 2. The Temporary Service shall remain in effect for the designated period, not to exceed one year from date of application. However, a Temporary Service may be terminated at any time, and will be made at the discretion ~ of the Utility. If a Temporary Service is terminated by the Utility because of inactivity or failure to pay for services, after Utility has delivered, or caused to be delivered, written notice to the address shown on the application of the impendin~ termination and Applicant has failed to respond within thirty days of said notice, then the Temporary Service account will be closed and all deposits made on behalf of the Temporary Services shall be forfeited to the Utility. 3. Char~es for loss or damage to meter and flttln~s will be based upon current prices. 4. Temporary services shall generally be taken from exietin~ outlets on the water system or from fire hydrants designated by the Utility. Any special outlets shall be installed at the customer's expense. 5. Backflow prevention devices, and approved plumbing material may be required for certain types of uses, and shall be installed at the customer's expense. 6.
