93-066 RESOLUTION NO. 93R-66 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING THE PAYMENT OF THE COST OF LAND FOR AND INSTALLATION AND CONSTRUCTION OF PUBLIC IMPROVEMENTS TO BE OWNED AND OPERATED BY THE ANAHEIM CITY SCHOOL DISTRICT IN THE CITY OF ANAHEIM WHEREAS, Health and Safety Code Section 33445 authorizes redevelopment agencies, with the consent of the legislative body, to pay all or part of the value of the land for and the cost of the installation and construction of any building, facility, structure or other improvement which is publicly owned if the legislative body determines that such improvements are of benefit to the redevelopment project area or the immediate neighborhood in which the project is located, and that no other reasonable means of financing such buildings, facilities, structures or other improvements are available to the community; and WHEREAS, Health and Safety Code Section 33679 requires that before a redevelopment agency commits to use property tax increment funds to pay the cost of land for and installation and construction of publicly owned buildings, the legislative body shall hold a public hearing thereon; and WHEREAS, prior to such public hearing the legislative body is required to give notice of the hearing and to make available for public inspection a summary report which estimates the amount of taxes proposed to be used to pay for such public facilities, which sets forth the facts supporting the determinations required to be made pursuant to Section 33445, and which sets forth the redevelopment purpose for which such taxes are being used; and WHEREAS, the Anaheim Redevelopment Agency (the "Agency") has previously entered into an Agreement by and between the Anaheim City School District (the "District") and the Anaheim Redevelopment Agency concerning the Plaza Redevelopment Project and proposes to enter into an Implementation Agreement (the "Agreement") in which the Agency commits to fund the cost of land for and installation and construction of certain public improvements located within the City to be owned and operated by the District; and WHEREAS, the Agency and the City Council of the City of Anaheim (the "City Council") have duly published notice of a public hearing and have provided for public inspection the summary report as required pursuant to Section 33679; and WHEREAS, the City Council has reviewed the Agreement and the summary report, conducted the public hearing on the proposed public improvements, and has heard and considered the public testimony thereon; and WHEREAS, the City Council has determined that the funding of the public improvements set forth in the Agreement and the summary report will improve the educationalfacilities located within the City and the educational programs of the City and is in the best interests of the residents of the City. NOW, THEREFORE, the City Council of the City of Anaheim does resolve as follows: 1. The City Council hereby finds and declares that on the basis of the public testimony at the public hearing and the information set forth in the summary report, each of the public improvement projects located within the City of Anaheim as set forth in the Agreement and the summary report is of benefit to the Redevelopment Project Alpha (the "Project") or the immediate neighborhood in which the Project is located. 2. The City Council hereby finds and declares that on the basis of the public testimony at the public hearing and the information set forth in the summary report, there is no other reasonable means of financing the public improvement projects located within the City as set forth in the Agreement and the summary report. 3. The Agency is hereby authorized to provide funding for the public improvement projects as set forth in the Agreement. PASSED, APPROVED AND ADOPTED THIS 27th day of Apr±l , 1993.
