94-005 RESOLUTION NO. 94R-5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE CITY MANAGER TO ENTER INTO CERTAIN AGREEMENTS FOR AND ON BEHALF OF THE CITY FOR REMEDIAL MEASURES RELATING TO THE NORTHRIDGE EARTHQUAKE OCCURRING ON JANUARY 17, 1994. WHEREAS, Section 518 of the Charter of the City of Anaheim provides that, by ordinance or resolution, the City Council may authorize the City Manager to bind the City, with or without a written contract, for the acquisition of equipment, materials, supplies, labor, services or other items included within the budget approved by the City Council, and may impose a monetary limit upon such authority; and WHEREAS, on January 17, 1994, an earthquake occurred in Southern California, measuring 6.6 in magnitude and having an epicenter in or near Northridge, California, which earthquake caused damage to public facilities in the City of Anaheim, including damage to Anaheim Stadium; and WHEREAS, pursuant to said Charter Section 518, the city Council desires to grant authority to the City Manager to enter into agreements relating to the inspection and/or repair of public facilities owned by the City of Anaheim or the Anaheim Public Improvement Corporation which facilities were, or may have been, damaged as a result of said earthquake. NOW, THEREFORE, BE IT RESOLVED by the city Council of the City of Anaheim that it does hereby authorize the city Manager to bind the City for the acquisition of equipment, materials, supplies, labor, services or other items relating to the inspection and/or repair of public facilities owned by the city of Anaheim or the Anaheim Public Improvement Corporation which facilities where, or may have been, damaged as a result of the January 17, 1994, Northridge Earthquake. BE IT FURTHER RESOLVED that the City funds necessary to satisfy the City's obligations under said agreements are contained in city fund number 570 (a Stadium fund) and said funds are hereby budgeted for such purposes. BE IT FURTHER RESOLVED that the authority contained in this Resolution shall be in addition to the authority heretofore set forth in Resolution 91R-119, which Resolution shall remain in full force and effect. BE IT FURTHER RESOLVED that the authority granted herein shall not apply to public works agreements entered into pursuant to City of Anaheim Charter Section 1211.
