94-098 RESOLUTION NO. 94R- 9R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LE'I-I'ER OF UNDERSTANDING BETWEEN THE ANAHEIM MUNICIPAL EMPLOYEES ASSOCIATION, GENERAL UNIT AND THE CITY OF ANAHEIM. WHEREAS, the Human Resources Director met and conferred with officials and employee representatives of the Anaheim Municipal Employees Association, General Unit, on the effects of reasslgnlng the Streets Division work from the Maintenance Department to the Public Works Department; and WHEREAS, as a result thereof, a Letter of Understanding dated May 16, 1994 delineates an agreement reached on the effects of teassigning the Streets Division work from the Maintenance Department to the Public Works Department; and WHEREAS, the City Council of the City of Anaheim does find it in the best interest of the City of Anaheim to approve said Letter of Understanding. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. This resolution applies to employees in the job classifications currently assigned to the Streets Division of the Maintenance Department. These positions are as follows: Senior Lead Street Maintenance Worker Lead Street Maintenance Worker Street Maintenance Worker Sewer Machine Operator Heavy Equipment Operator/Streets Motor Sweeper Operator Laborer 2. The Letter of Understanding dated May 16, 1994 between the Anaheim Municipal Employees Association, General Unit and the City of Anaheim, a copy of which is attached hereto and incorporated by reference herein, is hereby approved. CITY CLERK OF THE CITY OF ANAHEIM LETTER OF UNDERSTANDING Between CITY OF ANAHEIM and the ANAHEIM MUNICIPAL EMPLOYEES ASSOCIATION GENERAL UNIT AFTER meeting and conferring on the effects of reasslgnlng the Streets Division work from the Maintenance Department to the Public Works Engineering Department on or about July 1, 1994 the parties have reached the following Agreement: This Agreement applies to employees In the following job classifications: Senior Lead Street Malnteance Worker Lead Street Maintenance Worker Street Maintenance Worker Sewer Machine Operator Heavy Equipment Operator/Streets Motor Sweeper Operator Laborer FOR a period of ten (10) years from July 1, 1994 to June 18, 2004, the employees in the above job classifications shall retain their Maintenance Department seniority date(s) for purposes of lay-off and reassignment. During the same ten year period employees in the above job classes shall be considered a department for purposes of applying the provisions of Article 29, reassignment, Layoff and Re-employment. THEREAFTER, the employees In the Job classifications listed above assigned from the Maintenance Department to the Public Works Engineering Department on July 1, 1994 shall retain their Maintenance Department seniority as their Public Works Engineering Department seniority date. The City of Anaheim and the Anaheim Municipal Employees Association, General Unit retain the right to discuss this issue in the future under the provisions of the Discussion Article of the Memorandum of Understanding between the parties.
