94-262 RESOLUTION NO. 94R- 262 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM RELEASING AND DISCHARGING LIEN ON REAL PROPERTY WHEREAS, the City of Anaheim entered into an agreement with Georgia L. Black, dated May 25, 1978, whereby funds granted to the City by the Orange County Manpower Commission pursuant to the Comprehensive Employment and Training Act of 1973 were used to perform repair and maintenance on certain real property owned by Georgia L. Black; and WHEREAS, the real property on which the repair and maintenance were performed is described as follows: Lot 21 in Block 8 of Tract No. 159, as shown on a Map recorded in Book 12, page 8 of Miscellaneous Maps, records of Orange County, California, also known as 723 N. Philadelphia Street in the City of Anaheim, California; and WHEREAS, the aforementioned agreement provided that Georgia L. Black would reimburse the City of Anaheim for the funds expended on the above-described real property pursuant to a schedule set forth in the agreement and granted the City a lien against that real property to secure payment of the amounts set forth; and WHEREAS, the aforementioned agreement further provided that in the event Georgia L~ Black would not sell, transfer, convey or alienate her interest in the above-described property or if said interest would not terminate, within five (5) years from the date of the agreement, then that agreement would terminate and be of no further force or effect; that any lien created by that agreement would be discharged; and that in such event the City would, upon request, execute and record a release and discharge of the lien created by the aforesaid agreement; and WHEREAS, the City has obtained from Old Republic Title Company, of Concord, California a photocopy of a grant deed dated March 21, 1985 and bearing a recordation stamp dated June 5, 1985, conveying the above-described property from Georgia Lynn Black, as grantor, to Brent P. Barrett and Sally S. Barrett, husband and wife, as to an undivided 1/2 interest, and James F. Turman and Betty S. Turman, husband and wife, as to an undivided 1/2 interest, all as tenants in common; and WHEREAS, said Old Republic Title Company has requested a release of the lien of the City of Anaheim against the above- described property; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the lien in favor of the City of Anaheim against the above-described real property located at 723 N. Philadelphia Street in the City of Anaheim be, and it is hereby, released and discharged. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to file this resolution for recordation in the office of the County Recorder of the County of Orange. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 15th day of November , 1994.
