A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM DENYING AN
AMENDMENT TO CERTAIN CONDITIONS OF
APPROVAL OF CONDITIONAL USE PERMIT
NO. 3554
WHEREAS, the Zoning Administrator of the City of
Anaheim approved Conditional Use Permit No. 3554 under Decision
No. ZA 92-51 on October 22, 1992, to permit on-premise sale and
consumption of alcoholic beverages in a restaurant, subject to
certain conditions of approval; and
WHEREAS, the permittee has now requested an amendment
to said conditions of approval; and
WHEREAS, upon referral from the Zoning Administrator
pursuant to Section 18.12.090 of the Anaheim Municipal Code, the
Planning Commission held a duly noticed public hearing upon said
request and, following the receipt of all evidence and testimony,
denied said amendment request; and
WHEREAS, the decision of the Planning Commission was
appealed to the City in the manner provided by law; and
WHEREAS, the city Council held a duly noticed public
hearing on August 23, 1994, at which hearing the city Council did
receive and consider evidence, both oral and documentary,
relating to said request; and
WHEREAS, the City Council hereby finds and determines
that the amendment of said conditions of approval is not
reasonably necessary to protect the public peace, health, safety
or general welfare, nor necessary to permit reasonable operation
under said Conditional Use Permit No. 3554.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the conditions of approval heretofore
imposed in Conditional Use Permit No. 3554 as approved by
Decision ZA 92-51 be, and the same are hereby, affirmed.
BE IT FURTHER RESOLVED that said petition to amend said
conditions of approval of Conditional Use Permit No.3554 be, and
the same is hereby, denied and that Conditional Use Permit No.
3554, by its terms and conditions, has expired.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 23rd day of August,
1994.
