94-214 RESOLUTION NO. 94R- 214 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LETFER OF UNDERSTANDING BETWEEN THE ANAHEIM MUNICIPAL EMPLOYEES ASSOCIATION, C! ]~RICAL UNIT AND THE CITY OF ANAHEIM. WHEREAS, the Human Resources Director met and conferred with officials and employee representatives of the Anaheim Municipal Employees Association, Clerical Unit, on the wages, hours, terms and conditions of employment for employees assigned by management to work at the Fire Communications Center; and WHEREAS, as a result of the meetings, a Letter of Understanding dated August 12, 1994 delineates an agreement reached concerning the following: 1. The provisions of Article 14.5 compensation shall not apply to employees employed during the first pay period of July 1, 1994 through July 15, 1994; and 2. That effective July 1, 1994 through May 4, 1995, the basic compensation plan for all officers and employees of the City of Anaheim who are now employed or will in the future be employed in the classifications listed below shall be allocated to the following salary schedule in the Salary Schedule Master: Salary Step Salary Classification Schedule Range Relationship Fire Dispatcher II UFS 1825 R~E Benchmark Fire Dispatcher I 1643 R-E .900 x Fire Dispatcher II Fire Comm. That effective May 5, 1995 through October 3, 1996, the basic compensation plan for all officers and employees of the City of Anaheim who are now employed or will in the future be employed in the classifications listed below shall be allocated to the following salary schedule in the Salary Schedule Master: Salary Step Salary Classification Schedule Range Relationship Fire Dispatcher II UFS 1898 R-E Benchmark Fire Dispatcher I 1708 R-E .900 x Fire Dispatcher II Fire Comm. That job classes of Fire Dispatcher I, Fire Dispatcher II and Fire Commuhications Shift Supervisor shall have a probation period of twenty-six (26) complete bi-weekly pay periods; and 5. That employees in the Fire Communications Center shall retain their City of Orange Fire Department seniority date for a period of ten (10) years from July 1, 1994 to June 18, 2004 for purposes of Reassignment, Layoff and Re-employment; and DH1005BR.SR 6. That the job classes of Fire Dispatcher I, Fire Dispatcher II and Fire Shift Supervisor shall receive emergency medical dispatcher certification pay of $.29 per hour; and 7. That employees may be assigned to a Fire Communications alternate work schedule in order to reduce trips to and from work; and WHEREAS, all remaining terms and conditions of employment shall be in accordance with the provisions of the Memorandum of Understanding between the Anaheim Municipal Employees Association, Clerical Employees and the City of Anaheim; and NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding dated August 12, 1994, between the City of Anaheim and the Anaheim Municipal Employees Association Clerical Unit, as set forth in the document attached hereto and incorporated by reference herein, be and the same is hereby, approved and that the effective date of such Letter of Understanding shall be July 1, 1994. BE IT FURTHER RESOLVED that Resolution No. 94Ro149 and Resolution No. 94R-45 are hereby repealed effective July 1, 1994. CITY CLERK OF THE CITY OF ANAHEIM LETrER OF UNDERSTANDING BETWEEN ~I'I-tE ANAItEIM MUNICIPAL EMPLOYEES ASSOCIATION CLERICAL UNIT AND THE CITY OF ANAHEIM The Anaheim Municipal Employees AssocSation (AMEA), Clerical Unit, and the City of Anaheim, after meeting and conferring, have reached an understanding on the wages, hours, and other terms and conditions of employment for employees assigned by management to work at the Fire Communications Center, as follows: 1. EFFECTIVE DAlE ANAHEIM and AMEA agree that this understanding is effective July 1, 1994 and replaces the previous Letter of Understanding (Resolution No. 94R-149 and Resolution No. 94R-45) and supersedes all previous written and oral understandings including but not limited to offers of employment, and formal or informal practices as asserted by either party. 2. COMPENSATION The provisions of Article 14.5 Compensation shall not apply to employees employed during the first pay period in July 1994 (July 1, 1994 through July 15, 1994). 3. SALARY RELATIONSHIPS Fire Dispatcher ~. Fke Conununications Shift Supervisor 1.150 x Fire Dispatcher Fire Dispatcher I .900 x Fire Dispatcher II The wages in "Appendix A" reflect an agreed upon phased implementation plan to these salary relationships. 4. FIRE COMMUNICATIONS ALTERNATE WORK SCItEDULE ANAHEIM and AMEA agree that employees may be assigned to a Fire Communications alternate work schedule in order to reduce trips to and from work. Such an alternate work schedule shall not reduce set Ace to the public. DH9475BR.OT Fire Communications Work Schedule Page 2. ANAHEIM and the Anaheim Municipal Employees Association agree that the regular work schedule for employees assigned to the Fire Communications schedule by management shall be five (5) twelve (12) hour work days and two (2) ten hour work days in each bi-weekly pay period. The schedule shall be designed and implemented by management. A work period of seven consecutive calendar days shall be assigned to each employee assigned to the Fire Communications Twelve Plan. Each employee will be scheduled by management to work a regular work schedule of forty hours in each work period. Employees may submit a request to trade shifts within their seven consecutive calendar day work period. All shift trades shall be scheduled and taken in accordance with the best interests of ANAHEIM and shall not result in any overtime or Fair Labor Standards Act premium payment to either employee. Employees may be assigned to or from the Fire Corranunications Twelve Plan work schedule or from one work schedule to another only effective at the beginning of a bi-weekly pay period. Employees who perform authorized work in excess of the regular work day or work week as defined in the Letter of Understanding and who are otherwise eligible for overtime pay shall be compensated for such work at the rate of one and one-half (1-1/2) times their regular hourly rate of pay. The Fire Communications Twelve plan work schedule may be revoked at any time by either party upon written notice to the other party. Return to a work schedule of ten (10) eight (8) hour shifts each bi-weekly pay period will occur at the beginning of the first pay period after the notice of revocation has been received. 5. APPOINTMENTS The provisions of Article 22 Appointments and Promotions are waived for appointments made on July 1, 1994. 6. PROBATION The job classes of Fire Dispatcher I, Fire Dispatcher II and Fire Communications Shift Supervisor shall be added to the list of job classes in Article 24 Probation that have a regular period of probation which begins on the date of appointment and ends twenty-six (26) complete bi-weekly pay periods after the date of appointment. REASSIGNMENT SENIORITY For a period of ten (10) years from July 1, 1994 to June 18, 2004, the employees in the Fire Communications Center shall retain their City of Orange Fire Department seniority date or their City of Anaheim seniority date whichever is earlier for purposes of layoff and reassignment. During the same ten year period employees in the Fire Comnmnications Center shall be considered a department for purposes of applying the provisions of Article 29, Reassignment, Layoff and Re-employment. Thereafter, the employees in the Fire Communications Center shall retain the City of Anaheim Fire Department seniority as their seniority date. 8. BEREAVEMENT LEAVE Employees eligible for "i~nmediate fa~mily" bereavement leave in accordance with article 33.1 shall be granted bereavement leave with pay for up to maximum of thirty-six (36) working hours. Employees eligible for "other family members" bereavement leave in accordance with Article 33.11 shall be granted bereavement leave with pay for up to a maximum of twelve (12) working hours. 9. HOLIDAY PAY An employee assigned to the Fire communications Work Schedule shall receive an additional twelve (12) hours pay at his regular rate of pay or shall accrue twelve (12) hours holiday time for each holiday listed in Article 34.1. 10. VACATION ACCRUAL AND USE Employees employed on July I, 1994 shall accrue vacation in accordance with their City of Orange Fire Department seniorit,/date. Employees employed on July 1, 1994 shall be eligible to take any accrued vacation immediately. An employee employed after July 1, 1.094 shall be eligible to take any accrued vacation upon completion of thirteen (13) complete bi-weekly pay periods of service. CERTIFICATION PAY Employees in the following job classes shall receive emergency medical dispatcher certification pay upon certification as an Emergency Medical Dispatcher by the County of Orange Emergency Medical Services/State of California: Fire Communications Shift Supervisor Fire Dispatcher I Fire Dispatcher H The effective date of emergency medical dispatcher certification pay shall be the first day of the pay period following verification of eligibility. Upon an employee's initial certification, the employee will be eligible for emergency medical dispatcher certification pay until his/her certification expires. Eligibility for certification pay will continue only ff the employee is periodically recertified as provided by the County of Orange Emergency Medical Services/State of California. Emergency medical dispatcher certification pay shall be $.29 per hour. Employees employed on July 1, 1994 shall be eligible to receive emergency medical dispatcher pay immediately upon verification of eleigiblity. 12.
