94-202 RESOLUTION NO. 94R - 202 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LETTER OF UNDERSTANDING BETWEEN THE ANAHEIM MUNICIPAL EMPLOYEES ASSOCIATION AND THE CITY OF ANAHEIM WHEREAS, representatives of the Human Resources Department met and conferred with officials of the Anaheim Municipal Employees Association regarding holiday overtime worked by police communications employees assigned to the Twelve Plan alternative work schedule; and WHEREAS, as a result thereof, a Letter of Understanding dated July 28, 1994 which provides that when a police conm~unications employee works a regularly assigned twelve hour shift on a holiday there shall be only eight hours paid at the overtime rate; and WHEREAS, the City Council of the City of Anahehn does find that it is in the best interests of the City of Anaheim to approve said Letter of Understanding; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding pertaining to holiday overtime worked by police communications employees assigned to the Twelve Plan alternative work schedule dated July 28, 1994, between the Anaheim Municipal Employees Association and the City of Anaheim, a copy of which is attached hereto and incorporated by reference herein, is approved. CITY CLERK OF THE CITY OF ANAHEIM LETTER OF UNDERSTANDING between the CITY OF ANAHEIM and the ANAHEIM MUNICIPAL EMPLOYEES ASSOCIATION CLERICAL UNIT HOLIDAY TIME WORKED POLICE COMMUNICATIONS TWELVE PLAN Article 34.5 and Article 34.6 of the cnrrent Memorandnm of Understanding (MOU) between the Anaheim Municipal Employees Association (AMEA), Clerical Unit, and the City of Anal~eim, address matters of holiday compensation, shift differential pay, and accrual of holiday time off for Police Department cmmnunications employees assigned to the work plan of twelve hour shifts. It is in the mutual h~terest of the parties to revise the language of Article 34.5 and Article 34.6 of the current MOU between AMEA, Clerical Unit, m~d Anaheim. After meeting and conferring over these matters, the parties have reached an nnderstanding to snbstitute the following provisions for the current MOU provisions of Article 34.5 and Article 34.6: Current MOU Article 34.5 An Employee Working in the Police Department classifications listed below shall receive an additional twelve (12) hours pay at his era-rent rate of compensation including shift differential if applicable, or shall accrue twelve (12) hours holiday time for each holiday listed in this Article, providing said employee works on the holiday of day observed in lieu of the holiday. Police Dispatcher I Police Dispatcher II Police Communications Supervisor Police Conununications Operat,~r AMEA LE'[-rgR OF UNDERSTANDING Page 2 Police Communications Holiday Time Worked Current MOU Article 34.6 Once each year an employee shall be compensated in cash by separate check at his era'rent rate of pay for any holiday time off accrued but not taken at the close of the bi weeldy pay period that includes November 16. MOU Article 34.5 When an employee working in the Police Department classifications listed in Article 34.53 is required to work on any of the above listed holidays or days observed in lieu of those holidays, the employee shall receive compensation in addition to eight (8) hours of regular holiday pay. 34.51 In the event the holiday falls on the employee's regularly scheduled twelve (12) hour day, the first four (4) hours worked shall be compensated at the employee's regular hourly rate of pay, including shift differential if applicable. All hours worked ha excess of four (4) hours shall be compensated at one and one-half (1.5) times the employee's regular rate of pay, including shift differential if applicable. 34.52 In the event a holiday falls on the employee's regularly scheduled eight (8) hour work day, all hours worked shall be compensated at one and one-half (1.5) times the employee's regular hourly rate of pay, including shift differential, if applicable. 34.53 These provisions apply to: Police Dispatcher I Police Dispatcher II Police Communications Supervisor Police Communications Operator AMEA LETI'tSP, OF UNDERSTANDING Page 3 Police Communications Holiday Time Worked 34.6 Employees working in the Police Department classifications listed in Article 34.53 may elect to accrue credit for overtime hours worked on a holiday in lieu of payment for those holiday work hours. Article 34.5 describes circumstance trader which an employee working on a holiday may be entitled to accrue credit for hours of holiday overtime at the rate of one and one-half (1.5) hour per hour worked. In such circumstances, the employee may elect to either be paid at the rate of one and one-half (1.5) hour for each overtime hour worked or accrue credit for holiday work time which is recorded at the rate of one and one-half (1.5) hour for each overtime hour worked. At the close of the pay period that includes November 16 each year an employee shall be compensated at his current regular hourly rate of pay for each hour of holiday time accrued.
