RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
FINDING THAT THE ANAHEIM STADIUM PROJECT IS EXEMPT, BY
STATUTE, FROM THE REQUIREMENTS OF THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA)
WHEREAS, the City Council of the City of Anaheim adopted Ordinance No. 2934 on June
8, 1971, pursuant to Section 33201 of the Health and Safety Code, which created the Anaheim
Community Redevelopment Commission (the "Conunission") whose function, an~ong other things, is
to prepare a redevelopment plan (or recovery plan) for each proposed project area; and
WHEREAS, the Commission has prepared, pursuant to Health and Safety Code Section
34000 et seq., a Recovery Plan for the proposed Anaheim Stadium Project (the "Project"); and
WHEREAS, Section 21080(b) of the Public Resources Code and Section 15269 of the State
CEQA Guidelines describe emergency projects which are exempt, by statute, from the requirements of
CEQA; and
WHEREAS, the Recovery Plan for the Project provides for the following actions: repair,
restoration, and replacement of property and facilities damaged or destroyed as a result of a disaster in
a disaster stricken area in which a state of emergency has been proclaimed by the Governor;
emergency repairs to public services facilities necessary to maintain service; and specific actions
necessary to prevent or mitigate an emergency.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as
follows:
1. The City Council hereby finds that the Project is an emergency project as defined by
Section 15269 of the State CEQA Guidelines and is exempt, by statute, from the n:quirements of
CEQA.
