94-172 RESOLUTION NO. 94R-172 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM REQUESTING THE ORANGE COUNTY TRANSPORTATION AUTHORITY TO ALLOCATE COMBINED TRANSPORTATION PROGRAM FUNDS FOR LINCOLN AVENUE BETWEEN MAGNOLIA AVENUE AND BEACH BOULEVARD WHEREAS, the Orange County Transportation Authority approved a Combined Transportation Funding Program (CTFP) for fiscal year 1993-94; and WHEREAS, the program includes $319,000.00 in fiscal year 1993-94 for a street improvement project on Lincoln Avenue between Magnolia Avenue and Beach Boulevard; and WNEREAS, the City of Anaheim has adopted a General Plan Circulation Element which does not preclude implementation of the MPAH within its jurisdiction; and NOW, THEREFORE, BE IT RESOLVED that the City of Anaheim, hereby requests the Orange County Transportation Authority allocate $166,976.10 of CTFP funds from the Arterial Highway Financing Program for construction of said project to the City. This request is in conformance with the CTFP allocation process and does not exceed ninety (90) percent of the programmed amount or ninety (90) percent of the construction contract. BE IT FURTHER RE. OLVED, that the City of Anaheim, agrees to £'und its share of the improvement costs of the above indicated fiscal year and any additional costs over the identified programmed amount. BE IT FURTHER RESOLVED, that the City of Anaheim, has awarded the contract for the project on June 28, 1994 for $298,794.88. BE IT FURTHER RESOLVED, that the City of Anaheim has: (1) designed the project improvements, and (2) completed required preparatory work [n accordance with the standards required by the City and other affected jurisdictions involved with said project. BE IT FURTHER RESOLVED, that the remaining ~en (10) percent in CTFP funds will be transferred to the City of Anaheim when constructiou is completed and a Final Report on the project is accepted by the Orange County Transportation Authouity. The City of Anaheim agrees to submit the final report to the Orange County Transportatio~ Authority within one hundred twenty (120) days after the City's acceptance o[ the improvements.
