2000-011RESOLUTION NO. 2000R-11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM VACATING A PORTION OF UNIMPROVED IMPERIAL HIGHWAY EXTENDING FROM VIA ESCOLA TO IMPERIAL HIGHWAY AS REALIGNED (Abandonment No. 98-12A ) WHEREAS, the City Council of the City of Anaheim did, by resolution duly adopted, declare its intention to vacate certain public streets, highways or public service easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and WHEREAS, notice of a public hearing to consider said vacation was posted and published in the manner prescribed by law; and WHEREAS, on the 25th day of January, 2000, a public hearing was held to allow interested persons to submit evidence concerning said proposed vacation. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation of the unimproved partion of Imperial Highway, particularly described as follows: See Exhibit A attached hereto, provided however, that this action shall serve only to terminate the rights of the public to use said street, highway or public service easement and shall not be construed to convey or relinquish any property interest of the City of Anaheim in and to said street, highway or public service easement. BE IT FURTHER RESOLVED that the vacation authorized by this resolution shall not be effective until a certified copy of this resolution is recorded in the Office of the Recorder of Orange County. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this resolution to be recorded in the Office of the Recorder of the County of Orange when the Director of Public Works has certified to the receipt, by the City, of a payment in the amount of $136,718.00 from Southridge Development. F THE CITY OF ANAHEIM Exhibit' A' Legal Description for Portion of Imperial Highway to be Abandoned That portion of the lands allocated to Paula Peralta de Dominguez, described in the Final Decree of Partition of the Rancho Santiago de Santa Ana, which was entered September 12, 1868 in Book "B", Page 410 of Judgments of the District Court of the 17th Judicial District in and for Los Angeles County, California, in the City of Anaheim, County of Orange, State of California, described as follows: Parcel t A strip of land, 106.00 feet wide, the Centerline of which is described as follows: Beginning at a point on the Centerline of Imperial Highway as said Centerline is described in an Easement deed to the City of Anaheim recorded March 6, 1995 as Document #95-0091497 Official Records of said County, said Centerline being a curve, concave northwesterly having a radius of 1200.00 feet, said point also being on the Northwesterly Boundary Line of Tract No. 10617 as shown on a map filed in Book 534 pages 14 through 17 of Miscellaneoas--Maps, records of said County.
