RES-2010-140RESOLUTION NO. 2010-140 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE CHIEF OF POLICE OR HIS DESIGNEE TO SUBMIT A GRANT APPLICATION ON BEHALF OF THE CITY OF ANAHEIM TO THE CALIFORNIA EMERGENCY MANAGEMENT AGENCY, FOR THE 2010 URBAN AREAS SECURITY INITIATIVE (UASI) GRANT PROGRAM, AND IF AWARDED, AUTHORIZING THE ACCEPTANCE OF SUCH GRANT ON BEHALF OF THE CITY AND AMENDING THE BUDGET FOR FISCAL YEAR 2010 -11 ACCORDINGLY WHEREAS, the U.S. Department of Homeland Security (the "Grantor ") has heretofore invited public agencies, including the City of Anaheim, to submit applications to the Grantor for the 2010 Urban Areas Security Initiative (UASI) Grant Program (the "Grant "); and WHEREAS, the City of Anaheim desires to submit an application to Grantor for said Grant; and WHEREAS, the City of Anaheim is familiar with the terms, conditions and limitations of any such Grant; and WHEREAS, the City of Anaheim is willing and able to conform to each of the terms, conditions and limitations imposed upon any such Grant to the City; and WHEREAS, the City of Anaheim desires to accept any such Grant which may be awarded to the City; and WHEREAS, the City Council desires to amend the annual budget of the City to reflect and incorporate any Grant so awarded to the City, and to increase the annual appropriations and expenditures in the appropriate City program to reflect such award; and WHEREAS, the California Emergency Management Agency, which office administers the Grant on behalf of Grantor, has advised the Anaheim Police Department Emergency Management Director that prior to grant funding, the City Council must, by resolution, identify the projects scheduled to be funded with the Grant. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The Anaheim Chief of Police or his designee is hereby authorized to submit a grant application for and on behalf of the City of Anaheim to fund the projects listed in Exhibit A, here to and incorporate herein by reference, a public entity established under the laws of the State of California, and the Anaheim Police Department Homeland Security Director, or the Anaheim Chief of Police, or the Anaheim City Manager is authorized to execute any actions necessary for the purpose of obtaining federal financial assistance provided by the federal Department of Homeland Security (the "Grantor ") and subgranted through the State of California, including any extensions and amendments thereof. 2. The City Council of the City of Anaheim hereby agrees to, and by this resolution, does accept any such Grant so awarded to the City of Anaheim without further action of the City Council being required therefor. 3. The City of Anaheim hereby agrees to comply with each and all of the terms, conditions and limitations imposed by the Grantor upon said Grant, and the Anaheim Police Department Homeland Security Director, or the Anaheim Chief of Police, or the Anaheim City Manager is hereby authorized and directed to execute any agreements, assurances, or other documents as may be necessary in connection with the acceptance and implementation of said Grant as may be required by the Grantor, if such Grant is awarded to the City. 4. The annual budget of the City of Anaheim for fiscal year 2010 -11 is hereby amended by increasing the appropriations and authorized expenditures in Program No. 214 - 311 -1050 in such amount as is equal to the amount of Grant funds to be received by the City.
