RES-2010-141RESOLUTION NO. 2010 -141 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE DIRECTOR OF COMMUNITY SERVICES OR DESIGNEE TO SUBMIT A GRANT APPLICATION ON BEHALF OF THE CITY OF ANAHEIM TO THE STATE DEPARTMENT OF PARKS AND RECREATION, FOR THE NATURE EDUCATION FACILITY PROGRAM, AND IF AWARDED, AUTHORIZING THE ACCEPTANCE OF SUCH GRANT ON BEHALF OF THE CITY AND AMENDING THE BUDGET FOR FISCAL YEAR 2010 -11 ACCORDINGLY AND RESCINDING RESOLUTION NO. 2010-058 WHEREAS, the State Department of Parks and Recreation (the "Grantor ") has heretofore invited public agencies, including the City of Anaheim, to submit applications to the Grantor for the Nature Education Facilities Program (the "Grant "); and WHEREAS, the City Council adopted Resolution No. 2010 -058 authorizing the submittal of the Grant application to Grantor; and WHEREAS, the Department of Community Services submitted the Grant application to Grantor, however, Grantor has requested that additional language be added to the Resolution in order to complete the Grant application; and WHEREAS, the City desires to rescind Resolution No. 2010 -058 and re- submit the Grant application along with this revised Resolution; and WHEREAS, the City of Anaheim desires to submit an application to Grantor for said Grant for the Oak Canyon Environmental Learning Center Project; and WHEREAS, the City is familiar with the terms, conditions and limitations of any such Grant; and WHEREAS, the City is willing and able to confonn to each of the tenns, conditions and limitations imposed upon any such Grant to the City; and WHEREAS, the City desires to accept any such Grant which may be awarded to the City; and WHEREAS, the City Council desires to amend the annual budget of the City to reflect and incorporate any Grant so awarded to the City, and to increase the annual appropriations and expenditures in the appropriate City program to reflect such award. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The City of Anaheim shall submit an application for the Grant for the Oak Canyon Environmental Learning Center Project (the "Project ") by the Director of Community Services or designee on behalf of the City of Anaheim, a public entity established under the laws of the State of California, to the State Department of Parks and Recreation is hereby ratified and approved. 2. The City has or will have available, prior to commencement of any work on the Project, the sufficient funds to complete the Project should the Grant be awarded. 3. The City has or will have sufficient funds to operate and maintain the Project. 4. The City of Anaheim Director of Community Services, or designee, is hereby authorized to execute and take any actions necessary for the purpose of obtaining financial assistance provided by the Grantor, including any extensions and amendments thereof. 5. The City of Anaheim agrees to comply with all applicable federal, state and local laws, ordinances, rules, regulations and guidelines. 6. The City certifies that the Project is consistent with the applicable City planning document. 7. The City of Anaheim has reviewed, understands, and agrees to the General Provisions contained in the contract shown in the Grant Administration Guide and hereby agrees to comply with each and all of the terms, conditions and limitations imposed by the Grantor upon said Grant, and the City of Anaheim Director of Community Services, or designee, is hereby authorized and directed to execute any agreements, assurances, or other documents as may be necessary in connection with the acceptance and implementation of said Grant as may be required by the Grantor. 8. The annual budget of the City of Anaheim for fiscal year 2010 -11 is hereby amended by increasing the appropriations and authorized expenditures in such amount as is equal to the amount of Grant funds to be received by the City. BE IT FURTHER RESOLVED that Resolution No. 2010 -058 be, and the same is, hereby rescinded.
