RES-2010-168 RESOLUTION NO. 2010- 168 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LETTER OF UNDERSTANDING BETWEEN THE ANAHEIM POLICE ASSOCIATION AND THE CITY OF ANAHEIM WHEREAS, the City of Anaheim and the Anaheim Police Association have met and conferred and reached an agreement concerning the health plan choices available to them for the calendar year 2011; and WHEREAS, the Anaheim Police Association is in agreement with the recommendation contained in said Letter of Understanding; and WHEREAS, as a result thereof, the Letter of Understanding dated September 23, 2010 between the parties has been prepared and signed; and WHEREAS, the City Council of the City of Anaheim does find that it is in the best interest of the City of Anaheim to approve said Letter of Understanding. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding dated September 23, 2010 between the Anaheim Police Association and the City of Anaheim, a copy of which is attached hereto and incorporated by reference herein, is hereby approved. TALLEY, CITY ATTORNEY BY: G "'" F: \OT4150CS.DOC LETTER of UNDERSTANDING between the ANAHEIM POLICE ASSOCIATION and the CITY of ANAHEIM The City of Anaheim (ANAHEIM) and the Anaheim Police Association (APA) agree that employees in classifications represented by the APA shall be offered the AETNA Value HMO plan as one of the health plan choices available to them for the 2011 plan year. The parties acknowledge that the AETNA Value HMO plan is not in full compliance with the schedule of benefits required by the current Memorandum of Understanding between the City and the APA. The Anaheim Police Association (APA) hereby notifies ANAHEIM of its interest in evaluating whether it is in the APA's interest to withdraw all of the active members of the bargaining unit from the City's health plans and thereafter provide health coverage to them through the vehicle of a Health & Welfare Trust to be established by APA and administered by a Board of Trustees to be selected by APA. The Board of Trustees will determine all issues concerning eligibility and benefits, including but not limited to medical, prescription drugs, dental, vision, as well as optional benefits, all as subject to decision of the Board in the exercise of its discretion. ANAHEIM acknowledges the interest of the APA in evaluating various options for providing health and welfare benefits to employees in classifications represented by the APA, and agrees to cooperate by providing employee census data and plan utilization information as requested by the APA or their agent. In the event the APA ultimately determines that it would be in their interest, the parties agree to meet and confer in good faith regarding the establishment of a Health & Welfare Trust with any changes to existing practices to be by mutual agreement of the parties.
