A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE DIRECTOR
OF PUBLIC WORKS TO APPLY FOR STIP FUNDING
AND EXECUTE A MASTER AGREEMENT FOR
STATE - FUNDED TRANSIT PROJECTS AND
ASSOCIATED PROGRAM SUPPLEMENTS ON
BEHALF OF THE CITY OF ANAHEIM, IF THE CITY
HAS THE OPPORTUNITY TO RECEIVE STATE
FUNDING IN THE FUTURE
WHEREAS, the City of Anaheim "City" may receive state funding from the
California Department of Transportation (Department) sometime in the future for transit
projects; and
WHEREAS, substantial revisions were made to the programming and funding
process for the transportation projects programmed in the State Transportation Improvement
Program, by Chapter 622 (SB 45) of the Statutes of 1997; and
WHEREAS, the statutes related to State - Funded Transit Projects require a local or
regional implementing agency to execute an agreement with the Department before it can be
reimbursed for project expenditures; and
WHEREAS, the Department utilizes Master Agreements for State - Funded Transit
Projects, along with associated Program Supplements, for the purpose of administering and
reimbursing state transit funds to local agencies; and
WHEREAS, because the City may have the opportunity in the future to receive
funding, the City wishes to delegate the authority to execute these agreements, program
supplements and any amendments thereto to the City's Director of Public Works.
NOW, THEREFORE, BE IT RESOLVED that, if the City has the opportunity in
the future to receive funding, the Director of Public Works for the City of Anaheim is hereby
authorized to execute Master Agreements, all Program Supplements for State - Funded Transit
Projects and any Amendments thereto with the California Department of Transportation so long
as all budgetary appropriations or other funding for such Projects have been approved and the
City Attorney's Office approves the form of the Master Agreements, Program Supplements and
any Amendments thereto.
NOW THEREFORE, BE IT FURTHER RESOLVED by the City Council of the
City of Anaheim that the City of Anaheim agrees to comply with all conditions and requirements
set forth in the Master Agreement for State - Funded Transit Projects and with all applicable
statutes, regulations and guidelines for all State - Funded transit projects that may be entered into
by the Director of Public Works.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 26th day of October , 2010, by the following roll call vote:
