6086ORDINANCE NO. 6086 AN ORDINANCE OF THE CITY OF ANAHEIM REPEALING EXISTING CHAPTER 16.08 AND ADDING NEW CHAPTER 16.08 OF THE ANAHEIM MUNICIPAL CODE ADOPTING BY REFERENCE WITH AMENDMENTS THE 2007 CALIFORNIA FIRE CODE, INCORPORATING BY REFERENCE THE 2006 EDITION OF THE INTERNATIONAL FIRE CODE, WITH CALIFORNIA AMENDMENTS, AS CODIFIED WITHIN PART 9, TITLE 24 OF THE CALIFORNIA CODE OF REGULATIONS THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS AS FOLLOWS: SECTION 1. That Chapter 16.08 of Title 16 of the Anaheim Municipal Code be, and the same is hereby, repealed. SECTION 2. That new Chapter 16.08 of Title 16 be, and the same is hereby, added to the Anaheim Municipal Code, to read as follows: "Chapter 16.08 CALIFORNIA FIRE CODE ADOPTED 16.08.010 APPROVAL The City Council does find and determine, as a result of study and investigation conducted by the City and its Fire Department, that the 2007 Edition of the California Fire Code, incorporating by reference the 2006 International Fire Code with California amendments, as codified in the Building Standards Code, Part 9, Title 24 of the California Code of Regulations, is an approved code for adoption by reference within the meaning of Section 50022.1 et seq of the Government Code of the State of California. 16.08.020 ADOPTION OF THE CALIFORNIA FIRE CODE, 2007 EDITION, WITH APPENDICES Pursuant to the provisions of Section 5022.1 to 50022.8, inclusive, of the Government Code of the State of California, the City Council of the City of Anaheim does hereby adopt, by reference, the 2007 Edition of the California Fire Code, incorporating by reference the 2006 International Fire Code with California Amendments, as codified within Part 9, Title 24 of the 1 California Code of Regulations, also known at the California Building Standards Code, as amended by this Chapter, including Appendix Chapter 1, Appendix Chapter 4, and Appendices B, E, F, G and H (hereinafter "2007 California Fire Code"), and directs that three (3) or more copies of the Code shall be filed in the office of the City Clerk and shall be kept there for public inspection while the Code is enforced, all of which copies shall be certified to the true copies by the City Clerk. The City Clerk shall, at all times, maintain a reasonable supply of copies of the Code available for purchase by the public at a moderate price not to exceed the actual cost thereof to the City of Anaheim. 16.08.030 HIGH-RISE BUILDING Section 202 of the 2007 California Fire Code, definition of high-rise building, is hereby amended to read as follows: `Section 202 Definitions. HIGH-RISE BUILDING. As used in this code: 1. "Existing high-rise structure" means a high-rise structure, the construction of which is commenced or completed prior to July 1, 1974. 2. "High-rise Structure" means every building of any type of construction or occupancy having floors used for human occupancy located more than 55 feet above the lowest floor level having building access (see California Building Code, Section 403.1.2), except buildings used as hospitals as defined in Health and Safety Code Section 1250. 3. "New high-rise structure means a high-rise structure, the construction of which is commenced on or after July 1, 1974.' 16.08.040 PERMITS REQUIRED Section 307.2 of the 2007 California Fire Code is hereby amended as follows: `Section 307.2 Permits Required. A permit shall be obtained from the fire code official in accordance with Appendix Chapter 1, Section 105.6 prior to kindling a fire for recognized silvicultural or range or wildlife management practices, prevention or control of disease or pests, or a bonfire. Application for such approval shall only be presented by and permits issued to the owner of the land upon which the fire is to be kindled. A permit shall be obtained from the fire code official to conduct open burning within the Special Protection Area of the City of Anaheim. A permit shall be obtained from the fire code official for any recreational fire located in the Very High Fire Hazard Zone within the City of Anaheim. Requirements for the recreational fire permit are as specified in the City of Anaheim Specification and Requirement titled Open Burning/Recreational Fire.' 16.08.050 HAZARDOUS FIRE AREAS Section 316 of the 2007 California Fire Code is hereby added to read as follows: `Section 316.1 Scope. The unrestricted use of grass-, brush-, or forest -covered land in hazardous fire areas is a potential menace to life and property from fire and resulting erosion. Safeguards to prevent the occurrence of fires and to provide adequate fire -protection facilities to control the spread of fire which might be caused by recreational, residential, commercial, industrial or other activities conduced in hazardous fire areas shall be in accordance with this section.' Section 316.2 Definitions. For the purpose of Section 316, certain terms are defined as follows: 1. Special Protection Area. All of the area within the City of Anaheim located east of the Costa Mesa Freeway (SR -55), and south of the Riverside Freeway (SR -91), is hereby designated a Special Protection Area and shall comply with the provisions of Section 316. 2. Tracer is any bullet or projectile incorporating a feature which marks or traces the flight of said bullet or projectile by flame, smoke or other means which results in fire or heat. 3. Tracer Charge is any bullet or projectile incorporating a feature designed to create a visible or audible effect by means which result in fire or heat and shall include any incendiary bullets and projectiles. 4. Very High Fire Hazard Severity Zone shall be as defined for Local Agency Very High Fire Hazard Severity Zone found in Section 4702.1. Section 316.3 Permits. The fire code official is authorized to stipulate conditions for permits. Permits shall not be issued when public safety would be at risk, as determined by the fire code official. Section 316.4 Smoking. Lighting, igniting or otherwise setting fire to or smoking tobacco, cigarettes, pipes or cigars in posted areas is prohibited. Section 316.5 Spark Arrestors. All chimneys used in conjunction with fireplaces, barbecues, incinerators or heating appliances in which solid, gas, or liquid fuel is used shall be provided with a spark arrestor constructed in accordance with Chapter 28 of the 2007 California Building Code. Section 316.6 Tracer Bullets, Tracer Charges, Rockets, and model Aircraft. 1. Tracer bullets and tracer charges shall not be possessed, fired or caused to be fired in the Special Protection Area. 2. Rockets, model planes, gliders and balloons powered with an engine, propellant or other feature liable to start or cause fire shall not be fired or projected in the Special Protection Area without a permit from the fire code official. Section 316.7 Apiaries. Lighted and smoldering material shall not be used in connection with smoking bees in or upon the Very High Fire Hazard Severity Zone except by permit from the fire code official. Section 316.8 Open Flame Devices. Welding torches, tar pots, decorative torches and other devices, machines or processes liable to start or cause fire shall not be operated or used in or upon the Very High Fire Hazard Severity Zone, except by permit from the fire code official. EXCEPTION: Use within habited premises or designated campsites which are a minimum of 30 feet from grass-, grain-, brush- or forest - covered areas. Flame -employing devices, such as lanterns or kerosene road flares, shall not be operated or used as a signal or marker in the Special Protection Area. EXCEPTION: The proper use of fusees at the scenes of emergencies or as required by standard railroad operating procedures. Section 316.9 Open Burning and Recreational Fires. A permit shall be obtained from the fire code official to conduct open burning within the Special Protection Area of the City of Anaheim. A permit shall be obtained from the fire code official for any recreational fire located in the Very High Fire Hazard Zone within the City of Anaheim. Permits shall incorporate such terms and conditions which will reasonably safeguard public safety and property. Outdoor fires shall not be built, ignited or maintained under the following conditions: 1. When high winds are blowing, 2. When a person age 17 or over is not present at all times to watch and tend such fire, or 3. When public announcement is made that open burning is prohibited. Permanent barbecues, portable barbecues, outdoor fireplaces or grills shall not be used for the disposal of rubbish, trash or combustible waste material. Section 316.10 Incinerators and Fireplaces. Incinerators, outdoor fireplaces, permanent barbecues and grills shall not be used in the very high fire severity zones without a permit from the fire code official. Incinerators, outdoor fireplaces, permanent barbecues and grills shall be maintained in good repair and in a safe condition at all times. Openings in such appliances shall be provided with an approved spark arrester, screen or door. EXCEPTION: When approved, unprotected openings in barbecues and grills necessary for proper functioning. Section 316.11 Clearance of Brush and Vegetative Growth from Electrical Transmission Lines. General. Clearance of brush and vegetative growth from electrical transmission and distribution lines shall be in accordance with Section 316.11. EXCEPTION: Section 316.11 does not authorize persons not having legal right of entry to enter on or damage the property of others without consent of the owner. Section 316.11.1 Support Clearance. Persons owning, controlling, operating or maintaining electrical transmission or distribution lines shall have an approved program in place that identifies poles or towers with equipment and hardware types that have a history of becoming an ignition source, and provides a combustible free space consisting of a clearing of not less than 10 feet in each direction from the outer circumference of such pole or tower during such periods of time as designated by the fire code official. EXCEPTION: Lines used exclusively as telephone, telegraph, messenger call, alarm transmission or other lines classed as communication circuits by a public utility. Section 316.11.2. Electrical Distribution and Transmission Line Clearances General. Clearances between vegetation and electrical lines shall be in accordance with Section 3.16.11.2. Section 316.11.2.1 Trimming Clearance. At the time of trimming, clearances not less than those established by Table 316.11.2 (1) should be provided. The radial clearances shown below are minimum clearances that should be established, at time of trimming, between the vegetation and the energized conductors and associated live parts. EXCEPTION: The fire code official is authorized to establish minimum clearances different than those specified in Table 316.11.2 (1) when evidence substantiating such other clearances is submitted to the fire code official and approved. Section 316.11.2.2 Minimum Clearance to be Maintained. Clearances not less than those established by Table 316.11.2 (2) shall be maintained during such periods of time as designated by the fire code official. The site specific clearance achieved, at time of pruning, shall vary based on species growth rates, the utility company specific trim cycle, the potential line sway due to wind, line sway due to electrical loading and ambient temperature, and the tree's location in proximity to the high voltage lines. EXCEPTION: The fire code official is authorized to establish minimum clearances different than those specified by TABLE 316.11.2 (2) when evidence substantiating such other clearances is submitted to the fire code official and approved. During emergencies, the utility company shall perform the required work to the extent necessary to clear the hazard. An emergency can include situations such as trees falling into power lines, or trees in violation of Table 316.11.2 (2). Section 316.11.4 Correction of Condition. The fire code official is authorized to give notice to the owner of the property on which conditions regulated by Section 3 16. 11 exist to correct such conditions. Section 316.12 Dumping. Garbage, cans, bottles, papers, ashes, refuse, trash, rubbish or combustible waste material shall not be placed, deposited or dumped in or upon hazardous fire areas or in, upon or along trails, roadways or highways in the Very High Fire Hazard Severity Zone. EXCEPTION: Approved public and private dumping areas. Section 316.13 Disposal of Ashes. Ashes and coals shall not be placed, deposited or dumped in or upon the Very High Fire Hazard Severity Zone. EXCEPTIONS: 1. In the hearth of an established fire pit, camp stove or fireplace. 2. In a noncombustible container with a tight -fitting lid, which is kept or maintained in a safe location not less than 10 feet from combustible vegetation or structures. 3. Where such ashes or coals are buried and covered with 1 foot of mineral earth not less than 25 feet from combustible vegetation or structures. Section 316.14 Use of Fire Roads and Firebreaks. Motorcycles, motor scooters and motor vehicles shall not be driven or parked upon, and trespassing is prohibited upon, fire roads or firebreaks beyond the point where travel is restricted by a cable, gate or sign, without the permission of the property owners. Vehicles shall not be parked in a manner which obstructs the entrance to a fire road or firebreak. EXCEPTION: Public officers acting within their scope of duty. Radio and television aerials, guy wires thereto, and other obstructions shall not be installed or maintained on fire roads or firebreaks unless located 16 feet or more above such fire road or firebreak. Section 316.15 Use of Motorcycles, Motor Scooters and Motor Vehicles. Motorcycles, motor scooters and motor vehicles shall not be operated within area closed per section 316.22, without a permit by the fire code official, except upon clearly established public or private roads. Permission from the property owner shall be presented when requesting a permit. Section 316.16 Tampering with Fire Department Locks, Barricades and Signs. Locks, barricades, seals, cables, signs and markers installed within the Special Protection Area, by or under the control of the fire code official, shall not be tampered with, mutilated, destroyed or removed. Gates, doors, barriers and locks installed by or under the control of the fire code official shall not be unlocked. Section 316.17 Liability for Damage. The expenses of fighting fires which result from a violation of Section 316 shall be a charge against the person whose violation of Section 316 caused the fire. Damages caused by such fires shall constitute a debt of such person and are collectable by the fire code official in the same manner as in the case of an obligation under a contract, expressed or implied. Section 316.18 Fuel Modification Requirements for New Construction: All new buildings constructed in the Special Protection Area shall comply with the following: 1. Fuel modification plans shall be submitted to and approved by the fire code official prior to the issuance of a grading permit. 2. The fuel modification plans shall meet the criteria set forth in the City of Anaheim Fuel Modification Plans and Maintenance Specifications and Requirements. 3. The fuel modification plan may be altered if conditions change. Any alterations to the fuel modification shall be approved by the fire code official. 4. All elements of the fuel modification plan shall be maintained in accordance with the approved plan and are subject to the enforcement process outlined in Section 109 of the 2007 California Fire Code. Section 316.19 Clearance of Brush or Vegetative Growth from Structures. Section 316.19.1 General. Persons owning, leasing, controlling, operating or maintaining buildings or structures in the Special Protection Area, and persons owning, leasing or controlling land adjacent to such buildings or structures, shall at all times: 1. Maintain an effective firebreak by removing and clearing away flammable vegetation and combustible growth from areas within 100 feet of such buildings or structures; EXCEPTIONS: (a) Single specimens of trees, ornamental shrubbery or similar plants used as ground covers, provided that they do not form a means of rapidly transmitting fire from the native growth to any structure. (b) Grass and other vegetation located more than 100 feet from buildings or structures and less than 18 inches in height above the ground need not be removed where necessary to stabilize the soil and prevent erosion. 2. Maintain additional fire protection or firebreak by removing brush, flammable vegetation and combustible growth beyond the 100 feet from such buildings or structures, when required by the fire code official due to extra hazardous conditions causing a firebreak of only 100 feet to be insufficient to provide reasonable fire safety. 3. Remove portions of trees which extend within 10 feet of the outlet of a chimney. 4. Maintain trees adjacent to or overhanging a building free of deadwood. 5. Trees shall be trimmed to provide a minimum of 10 foot ground clearance. 6. Trees shall be cut/pruned at the angle of the slope in which they reside. 7. Irrigated surface fuels shall be maintained at a height not to exceed 18 inches. 8. Maintain the roof of a structure free of leaves, needles or other dead vegetative growth. 9. Debris and trimmings shall be removed from the site, or chipped and converted into mulch then evenly dispersed in the same area to a maximum depth of three (3) inches. 10. Deadwood and tree litter shall be regularly removed from trees. 11. Tree crowns extending to within 10 feet of any structure shall be pruned to maintain a 10 foot clear horizontal distance. Section 316.20 Clearance of Brush or Vegetation Growth from Roadways. The fire code official is authorized to cause areas within 10 feet on each side of portions of highways and private streets which are improved, designed or ordinarily used for vehicular traffic to be cleared of flammable vegetation and other combustible growth. The fire code official is authorized to enter upon private property to do so. EXCEPTION: Single specimens of trees, ornamental shrubbery or cultivated ground cover such as green grass, ivy, succulents or similar plants used as ground covers, provided that they do not form a means of readily transmitting fire. Section 316.21 Use of Equipment 1. Except as otherwise provided in this section, no person shall use, operate, or cause to be operated, in, upon or adjoining any Very High Fire Hazard Severity Zone any internal combustion engine which uses hydrocarbon fuels, unless the engine is equipped with a spark arrestor and maintained in effective working order, or the engine is constructed, equipped and maintained for the prevention of fire. 2. Spark arrestors affixed to the exhaust system of engines or vehicles subject to this section shall not be placed or mounted in such a manner as to allow flames or heat from the exhaust system to ignite any flammable material. 3. A spark arrestor is a device constructed of nonflammable material specifically for the purpose of removing and retaining carbon and other flammable particles over 0.0232 of an inch in size from the exhaust flow of an internal combustion engine that uses hydrocarbon fuels or which is qualified and rated by the United States Forest Service. 4. Engines used to provide motor power for trucks, truck tractors, buses, and passenger vehicles, except motorcycles, are not subject to this section if the exhaust system is equipped with a muffler as defined in the Vehicle Code of the State of California. 5. Turbocharged engines are not subject to this section if all exhausted gases pass through the rotating turbine wheel, there is no exhaust bypass to the atmosphere, and the turbocharger is in effective mechanical condition. Section 316.22 Restricted Entry. The fire code official shall determine and publicly announce when the Very High Fire Hazard Severity Zone shall be closed to entry and when such areas shall again be opened to entry. Entry on and occupation of hazardous fire areas, except public roadways, inhabited areas or established trails and camp sites which have not been closed during such time when the hazardous fire area is closed to entry, is prohibited. EXCEPTIONS: 1. Residents and owners of private property within hazardous fire areas and their invitees and guests going to or being upon their lands. 2. Entry, in the course of duty, by peace or police officers, and other duly authorized public officers, members of a fire department and members of the United States Forest Service. 3. A permit has been issued by the Anaheim Fire Department to enter a fire -closure area. Section 316.23 Trespassing on Posted Property. 1. General. When the fire code official determines that a specific area within the Special Protection Area presents an exceptional and continuing fire danger because of the density of natural growth, difficulty of terrain, proximity to structures or accessibility to the public, such areas shall be closed until changed conditions warrant termination of closure. Such areas shall be posted as hereinafter provided. 2. Signs. Approved signs prohibiting entry by unauthorized persons and referring to applicable fire code chapters shall be placed on every closed area. 3. Trespassing. Entering and remaining within areas closed and posted is prohibited. EXCEPTION: Owners and occupiers of private or public property within closed and posted areas, their guests or invitees, and local, state and federal public officers and their authorized agents acting in the course of duty. Section 316.24 Explosives and Blasting. Explosives shall not be possessed, kept, stored, sold, offered for sale, given away, used, discharged, transported or disposed of within the Very High Fire Hazard Severity Zone except by permit from the fire code official. Section 316.25 Unusual Circumstances. The fire code official may suspend enforcement and require reasonable alternative measures designed to advance the purposes of this section if he/she determines in any specific case that any of the following conditions exist: 1. Difficult terrain. 2. Danger of erosion. 3. Presence of plants included in any state and federal resources agencies, California Native Plant Society and county -approved list of wildlife, plants, rare, endangered and/or threatened species. 4. Stands or groves of trees or heritage trees. 5. Other unusual circumstances that make strict compliance with the clearance of vegetation provisions of Section 316 undesirable or impractical. Section 316.26 Storage of Firewood and Combustible Material. Firewood and combustible material shall not be stored in unenclosed spaces beneath buildings or structures, or on decks or under eaves, canopies or other projections or overhangs. When required by the fire code official, storage of firewood and combustible material stored in the defensible space shall be located a minimum of 20 feet from structures and separated from the crown of trees by a minimum horizontal distance of 15 feet. 16.08.060 HIGH-RISE BUILDINGS Section 408.12 of the 2007 California Fire Code is hereby added to read as follows: `Section 408.12 High -Rise Buildings. All high-rise buildings shall have at least one Automated External Defibrillator (AED) located on each occupied floor level.' Section 408.12.1 Type. All AEDs used in high-rise buildings must be of the type approved by the United States Food and Drug Administration (FDA).' Section 408.12.2 Accessibility. All AEDs shall be available for public use and shall be located in the elevator lobby unless otherwise approved by the fire code official. Standard industry accepted signs shall mark the location of each AED.' Section 408.12.3 Maintenance. All AEDs shall be maintained according to manufacturer recommendations. Maintenance records shall be kept for a period of one year.' 16.08.070 FIRE APPARTUS ACCESS ROADS Section 503.1 of the 2007 California Fire Code is hereby amended to read as follows: `Section 503.1 Where Required. Fire apparatus access roads shall be provided and maintained in accordance with Sections 503.1.1 through 503.1.3 and the City of Anaheim Fire Department Specification and Requirement for Access and Fire Hydrant Standards for Newly Constructed Residential, Commercial, and Industrial Developments.' 16.08.080 FIRE HYDRANT SYSTEMS Section 508.5 of the 2007 California Fire Code is hereby amended to read as follows: `Section 508.5 Fire Hydrant Systems. Fire hydrant systems shall comply with Sections 508.5.1 through 508.5.6 and the City of Anaheim Fire Department Specification and Requirement for Access and Fire Hydrant Standards fore Newly Constructed Residential, Commercial, and Industrial Developments.' 16.08.090 FIRE COMMAND CENTER Section 509.1 of the 2007 California Fire Code is hereby amended to read as follows: `Section 509.1 Features. Where required by other sections of this code and in all buildings classified as high-rise buildings by the California Building Code, a fire command center for fire department operations shall be provided. The fire command center shall be located adjacent to an approved fire access road and be accessible directly from the exterior. The location and accessibility of the fire command center shall be approved by the fire department. The fire command center shall be separated from the remainder of the building by not less than a 1- hour fire barrier constructed in accordance with Section 706 of the California Building Code or horizontal assembly constructed in accordance with Section 711 of the California Building Code, or both. The room shall be a minimum of 96 square feet (9 m2) with a minimum dimension of 8 feet (2438mm). A layout of the fire command center and all features required by this section to be contained therein shall be submitted for approval prior to installation. The fire command center shall comply with NFPA 72 and shall contain the following features: 1. The emergency voice/alarm communication system unit. 2. The fire department communications system. 3. Fire -detection and alarm system annunciates system. 4. Annunciator visually indicating the location of the elevators and whether they are operational. 5. Status indicators and controls for air -handling systems. 6. The fire-fighter's control panel required by Section 909.16 for smoke control systems installed in the building. 7. Controls for unlocking stairway doors simultaneously. 8. Sprinkler valve and water -flow detector display panels. 9. Emergency and standby power status indicators. 10. A telephone for fire department use with controlled access to the public telephone system. 11. Fire pump status indicators. 12. Schematic building plans indicating the typical floor plan and detailing the building core, means of egress, fire protection systems, fire -fighting equipment and fire department access. 13. Work table. 14. Generator supervision devices, manual start and load transfer capabilities and procedures. 15. Public address system, where specifically required by other sections of this code. 16. Fire command centers shall not be used for the housing of any boiler, heating unit, generator, combustible storage, or similar hazardous equipment or storage." 16.08.100 FIRE COMMAND CENTER IDENTIFICATION SIGN Section 509.2 is hereby added to the 2007 California Fire Code to read as follows: `Section 509.2 Identification. The fire command center shall be identified by a permanent easily identifiable sign noting "Fire Dept. Command Center" located on the door to the fire command center in accordance with Figure 509.2.' ALL SIGN IMAGING SHALL 5E IN COMPLIANCE WITH THE REFLECTIVE SHEETING MANUFACTURES MATCH COMPONENT SYSTEM. 16.08.110 KEY BOX Section 509.3 is hereby added to the 2007 California Fire Code to read as follows: "Section 509.3 Key Box. A key box shall be permanently installed near the door to the fire command center. The key box shall be located 5 '/2 feet to 6 feet above the floor level in a clearly visible location." 16.08.120 SOLAR SYSTEMS Section 605.11 is hereby added to the 2007 California Fire Code to read as follows: `Section 605.11 Solar Systems. Solar systems shall be installed and maintained in accordance with the California Electrical Code and the City of Anaheim Fire Department Specification and Requirement for Solar Systems.' 16.08.130 INSTALLATION AND MAINTENANCE WITHIN EXISTING GROUP R OCCUPANCIES Subsection 901.6.3 of the 2007 California Fire Code is hereby added to read as follows: `Section 901.6.3 Installation and Maintenance within Existing Group R Occupancies. (a) It shall be the responsibility of the property owner to supply and install all required detectors. The property owner shall be responsible for testing and maintaining detectors in common stairways and hallways. It shall be the responsibility of the tenant, whose tenancy will be longer than two weeks, to test and maintain detectors within dwelling units or rooming units and to notify the owner of authorized agent, in writing, of any deficiencies. The owner shall be responsible for providing each tenant with written information regarding detector testing and maintenance, or such information may be posted in common areas frequently visited by tenants such as the laundry room area. (b) The tenant shall be responsible for replacement of the battery except that such battery shall be in operating condition at the time that the tenant takes possession. The owner or authorized agent shall not be in violation of this act for a deficient smoke detector unless she or she has failed to correct the deficiency within a reasonable time after he or she has received written notice of the deficiency.' 16.08.140 AUTOMATIC SPRKINKLER SYSTEM Subsection 903.2 of the 2007 California Fire Code is hereby amended to read as follows: `Section 903.2 Where Required. When a sprinkler system is required in the locations described in the sections of 903.2, the entire new building or structure shall be provided with an approved automatic sprinkler system regardless of the presence of fire walls or fire barrier walls. The elimination of sprinkler protection in the following areas is subject to approval by the fire code official: 1. Spaces or areas in telecommunications buildings used exclusively for telecommunications equipment, associated electrical power distribution equipment, batteries and standby engines, provided those spaces or areas are equipped throughout with an automatic fire alarm system and are separated from the remainder of the building by fire barriers consisting of not less than 1 -hour fire -resistance -rated walls and 2 -hour fire -resistance -rated floor/ceiling assemblies. 2. Automatic fire sprinkler protection for fixed guideway transit systems shall be as per Section 903.2.17." 16.08.150 EXEMPT LOCATIONS Subsection 903.3.1.1.1 of the 2007 California Fire Code is hereby amended to read as follows: `Section 903.3.1.1.1 Exempt Locations. In other than Group I-2, I-2.1, or 1-3 occupancies, automatic sprinklers shall not be required in the following rooms or areas where such rooms or areas are protected with an approved automatic fire detection system in accordance with Section 907.2 that will respond to visible or invisible particles of combustion. Sprinklers shall not be omitted from any room merely because it is damp, of fire -resistance rated construction or contains electrical. 1. Any room where the application of water, or flame and water, constitutes a serious life or fire hazard. 2. Any room or space where sprinklers are considered undesirable because of the nature of the contents, when approved by the fire code official. 3. Generator and transformer rooms separated from the remainder of the building by walls and floor/ceiling or roof/ceiling assemblies have a fire -resistance rating of not less than 2 hours.' 16.08.160 STANDPIPE INSTALLATION STANDARD Section 905.2 of the 2007 California Fire Code is hereby amended to read as follows: `Section 905.2 Installation Standard. Standpipe systems shall be installed in accordance with this section and NFPA 14. Standpipe systems shall be designed to provide the required waterflow rate at a minimum residual pressure of 125 PSI at the hydraulically most remote outlet(s).' 16.08.170 AUTOMATIC FIRE DETECTION Subsection 907.2.12.1 of the 2007 California Fire Code is hereby amended to read as follows: `Section 907.2.12.1 Automatic Fire Detection. Smoke detectors shall be provided in accordance with this section. Smoke detectors shall be connected to an automatic fire alarm system. The activations of any detector required by this section shall operate the emergency voice/alarm communication system. Duct smoke detectors shall operate as specified in Section 907.12. Smoke detectors shall be located as follows: 1. In each mechanical equipment, electrical, transformer, telephone equipment of similar room which is not provided with sprinkler protection, elevator machine rooms, and in elevator lobbies. 2. In the main return air and exhaust air plenum of each air-conditioning system having a capacity greater than 2,000 cubic feet per minute. Such detectors shall be located in a serviceable area downstream of the last duct inlet. 3. At each connection to a vertical duct or riser serving two or more stories from a return air duct or plenum of an air-conditioning system. In Group R-1 and R-2 occupancies, a listed smoke detector is allowed to be used in each return -air riser carrying not more than 5,000 cubic feet per minute and serving not more than 10 air -inlet openings.' 16.80.180 EMERGENCY VOICE/ALARM COMMUNICATION SYSTEM Subsection 907.2.12.2 of the 2007 California Fire Code is hereby amended to read as follows: `Section 907.2.12.2 Emergency Voice/Alarm Communication System. The operation of any automatic fire detector, sprinkler water -flow device or manual fire alarm box shall automatically sound an alert tone followed by voice instructions giving approved information and directions for a general or staged evacuation on a minimum of the alarming floor, the floor above and the floor below. Duct smoke detectors shall operate as specified in Section 907.12. Speakers shall be provided throughout the building by paging zones. As a minimum, paging zones shall be provided as follows: 1. Elevator groups. 2. Exit stairways. 3. Each floor. 4. Areas of refuge as defined in Section 1002.1. 5. Dwellings Units in apartment houses. 6. Hotel guest rooms or suites. EXCEPTION: In Group I-1 and I-2 occupancies, the alarm shall sound in a constantly attended area and a general occupant notification shall be broadcast over the overhead page.' 16.08.190 DUCT SMOKE DETECTOR ACCESS follows: Section 907.12 of the 2007 California Fire Code is hereby amended to read as `Section 907.12 Access. Duct smoke detectors shall be connected to the building's fire alarm control unit when a fire alarm system is provided. Activation of a duct smoke detector shall initiate a visible and audible supervisory signal at a constantly attended location. Duct smoke detectors shall not be used as a substitute for required open area detection. EXCEPTION: In occupancies not required to be equipped with a fire alarm system, activation of a duct smoke detector shall activate a visible and an audible signal in an approved location. Smoke detector trouble conditions shall activate a visible or audible signal in an approved location and shall be identified as air duct detector trouble.' 16.08.200 SMOKE AND HEAT VENTS IN SPRINKLERED BUILDINGS Subsection 910.3.2.2 of the 2007 California Fire Code is hereby amended to read as follows: `Section 910.3.2.2 Sprinklered Buildings. Where installed in buildings equipped with an approved automatic sprinkler system, smoke and heat vents shall be designed to operate automatically by actuation of a heat - responsive device rated at least 100° F above the operating temperature of the sprinkler.' 16.08.210 RESIDENTIAL FUELING FACILITIES Subsection 2208.1.1 of the 2007 California Fire Code is hereby added to read as follows: `Section 2208.1.1 Residential Fueling Facilities. Residential fueling facilities shall be in accordance with the City of Anaheim Fire Department Specification and Requirement for CNG residential fueling.' 16.08.220 FIBERGLASS -REINFORCED PLASTIC PIPING Subsection 3403.6.9.1 of the 2007 California Fire Code is hereby amended to read as follows: `Section 3403.6.9.1 Fiberglass -Reinforced Plastic Piping. Fiberglass - reinforced plastic (FRP) shall be provided with flexible joints in accordance with subsection 3403.6.9.' 16.08.230 TANK LINING as follows: Subsection 3404.2.7.11 of the 2007 California Fire Code is hereby amended to read `Section 3404.2.7.11 Tank Lining. Tank lining is not allowed unless approved by the fire code official.' 16.08.240 UNDERGROUND TANKS as follows: Subsection 3404.2.11 of the 2007 California Fire Code is hereby amended to read `Section 3404.2.11 Underground Tanks. Underground storage of flammable and combustible liquids in tanks shall comply with the Anaheim Fire Department, Underground Storage Tank Installation Guidelines, Section 3404.2 and Sections 3404.2.11.1 through 3404.2.11.5.2.' 16.08.250 TEMPORARY OUT OF SERVICE Subsection 3404.2.13.1.1 of the 2007 California Fire Code is hereby amended to read as follows: `Section 3404.2.13.1.1 Temporary Out of Service. Underground tanks temporarily out of service shall be in accordance with the Anaheim Fire Department, Underground Storage Tank Temporary Closure Guidelines.' 16.08.260 OUT OF SERVICE FOR 90 DAYS Subsection 3404.2.13.1.2 of the 2007 California Fire Code is hereby amended to read as follows: `Section 3404.2.13.1.2 Out of Service for 90 Days. For the requirements see subsection 3404.2.13.1.1.' 16.08.270 TANKS ABANDONED IN PLACE Subsection 3404.2.13.1.4 of the 2007 California Fire Code is hereby amended to read as follows: `Section 3404.2.13.1.4 Tanks Abandoned in Place. Tanks abandoned in place shall be in accordance with the Anaheim Fire Department, Underground Storage Tank Abandonment -In -Place Guidelines.' 16.08.280 REMOVAL AND DISPOSAL OF TANKS follows: Subsection 3404.2.14 of the 2007 California Fire Code is hereby amended to read as `Section 3404.2.14 Removal and Disposal of Tanks. Removal and disposal of above -ground tanks shall comply with Sections 3404.2.14.1 and 3404.2.14.2. Removal of underground tanks shall be in accordance with the Anaheim Fire Department, Underground Storage Tank Removal Guidelines.' 16.08.290 CHAPTER 47 EFFECTIVE JANUARY 01, 2008 follows: Section 4701.3 of the 2007 California Fire Code is hereby added to read as `Section 4701.3 Effectiveness. This entire chapter is effective January 01, 2008, regardless of delayed implementation date adopted by the office of the California State Fire Marshal California or Building Standards Commission.' 16.08.300 DEFINITION OF WILDLAND-URBAN INTERFACE AREA Section 4702 of the 2007 California Fire Code is hereby amended to amend the definition of Wildland-Urban Interface Area to read as follows: `Section 4702 Wildland-Urban Interface Area. Is a geographical area identified by the state as a "Fire Hazard Severity Zone" in accordance with the public resources code Sections 4201 through 4204 and Government Code Sections 51175 through 51189, or other areas designated by the enforcing agency to be at a significant risk from wildfires including the Special Protection Area and the Very High Fire Hazard Severity Zone. See 86B for the applicable referenced Sections of the Government Code and the Public Resources Code.' 16.08.310 TITLE Subsection 101.1 of Appendix Chapter 1 of the 2007 California Fire Code is hereby amended to read as follows: `Section 101.1 Title. These regulations shall be known as the Fire Code of the City of Anaheim, hereinafter referred to as "this code"'. 16.08.320 CONFLICTING PROVISIONS Subsection 102.9 of Appendix Chapter 1 of the 2007 California Fire Code is hereby amended to read as follows: "Section 102.9 Conflicting Provisions. Where there is a conflict between a general requirement and a specific requirement, the fire code official shall decide which requirement meets the general intent of this code." 16.08.330 REVIEW OF BUILDING PERMITS Subsection 104.2.1 of Appendix Chapter 1 of the 2007 California Fire Code is hereby added to read as follows: `Section 104.2.1 Review of Building Permits. (a) No building permit shall be issued pursuant to section 15.05 et seq of the Anaheim Municipal Code for the construction, addition, alteration or repair of any building or structure which would result in noncompliance with the requirements of the fire code. The Fire Marshal and the Building Official shall establish administrative procedures designed to promote expeditious review of building permit applications. (b) The Fire Marshal and the Building Official may require such site plans, building plans, elevations, and other documentation from the applicant as may be necessary to determine such compliance and may impose such conditions on approval of an application as are necessary to assure such compliance. No building or structure subject to such review and approval shall be finally release for utility service or occupancy which is not in compliance with the building permit as approved or conditionally approved.' 16.08.340 PERMIT FEES Subsection 105.1.4 of Appendix Chapter 1 of the 2007 California Fire Code is hereby added to read as follows: `Section 105.1.4 Permit Fees. For each and every permit issued pursuant to this chapter, there shall be paid to the City of Anaheim Fire Department a permit fee in such amount as established by resolution of the City Council.' 16.08.350 REQUIRED OPERATIONAL PERMITS Section 105.6 of Appendix Chapter 1 of the 2007 California Fire Code is hereby amended to read as follows: `Section 105.6 Required Operational Permits. The fire code official is authorized to issue operational permits for the operations as set forth in Appendix Chapter 1, Sections 105.6.1 through 105.6.52.' 16.08.360 FIRE HYDRANTS AND VALVES Subsection 105.6.15 of Appendix Chapter 1 of the 2007 California Fire Code is hereby amended by deleting the following from the list of required operational permits: `Section 105.6.15 Fire Hydrants and Valves.' 16.08.370 CHRISTMAS TREE LOT Subsection 105.6.48 of Appendix Chapter 1 of the 2007 California Fire Code is hereby added to read as follows: `Section 105.6.48 Christmas Tree Lot. To operate a Christmas Tree Lot in the City of Anaheim.' 16.08.380 PUMPKIN PATCH LOT Subsection 105.6.49 of Appendix Chapter 1 of the 2007 California Fire Code is hereby added to read as follows: `Section 105.6.49 Pumpkin Patch Lot. To operate a Pumpkin Patch Lot in the City of Anaheim.' 16.08.390 RECREATIONAL FIRE Subsection 105.6.50 of Appendix Chapter 1 of the 2007 California Fire Code is hereby added to read as follows: `Section 105.6.50 Recreational Fire. To conduct a recreational fire in the Very High Fire Hazard Severity Zone, see section 307.4.2 and 316.9.' 16.08.400 ACTIVITES OR USE IN CONJUNCTION WITH AN EXHIBITION OR TRADE SHOW Subsection 105.6.51 of Appendix Chapter 1 of the 2007 California Fire Code is hereby added to read as follows: `Section 105.6.51 Activities or Use in Conjunction with an Exhibition or Trade Show. The following requires a permit when used or placed in an exhibition or trade show: 1. Flammable or Combustible Aerosols 2. Flammable or Combustible Liquids 3. Open Flames 4. Propane 5. Two Story Structures 6. Hazardous Materials.' 16.08.410 SPECIAL OPERATIONAL PERMITS Subsection 105.6.52 of Appendix Chapter 1 of the 2007 California Fire Code is hereby added to read as follows: `Section 105.6.52 Special Operational Permits. A permit issued by the Anaheim Fire Department for conditions, events, or activities associated with places of assembly to insure compliance with Chapter 10 of this code. Such conditions, events, or activities include, but are limited to haunted houses or fairs.' 16.08.420 REQUIRED CONSTRUCTION PERMITS Section 105.7 of Appendix Chapter 1 of the 2007 California Fire Code is hereby amended to read as follows: `Section 105.7 Required Construction Permits. The fire code official is authorized to issue construction permits for the work as set forth in Appendix Chapter 1, Sections 105.7.1 through 105.7.14.' 16.08.430 ABOVEGROUND TANKS Subsection 105.7.14 of Appendix Chapter 1 of the 2007 California Fire Code is hereby added to read as follows: `Section 105.7.14 Aboveground Tanks. A construction permit is required for the installation of or a modification to an aboveground storage tank containing a flammable or combustible liquid or a hazardous material.' 16.08.440 OCCUPANT COUNT Subsection 107.7 of Appendix Chapter 1 of the 2007 California Fire Code is hereby added to read as follows: `Section 107.7 Occupant Count. The manager/owner of places of assembly classified as a Group A -occupancy, and for dance halls, shall have an effective system to maintain a count of the number of occupants present in order to keep the number of occupants at or below the posted occupant load. If at any time the fire code official determines that an accurate count of occupants is not being maintained, the occupancy shall be cleared until an accurate count can be made.' 16.08.450 BOARD OF APPEALS ESTABLISHED Section 108 of Appendix Chapter 1 of the 2007 California Fire Code is hereby amended to read as follows: `Section 108 Board of Appeals Established. In order to determine the suitability of alternate materials and type of construction, and to provide for reasonable interpretation of the provisions of this Code and relief by way of appeal from the granting or denial of any permit, there shall be, and hereby is, created a Board of Appeals consisting of the Planning Commission of the City of Anaheim who shall grant such relief or make such interpretation or explanation as may be necessary and proper pursuant to the provisions of this Code. Said members shall hold their respective membership on said Board of Appeals by reason of, and concurrently with their respective terms of service as Planning Commissioners and shall cease to be such members upon their ceasing to be commissioners. Whenever any reference to Board of Appeals shall appear in this Code, it shall mean the Planning Commission of the City of Anaheim. Whenever the fire code official shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the California Fire Code do not apply or that the true intent and meaning of the California Fire Code has been misconstrued or wrongly interpreted, the applicant may appeal from a decision of the fire code official to the Board of Appeals within ten (10) days from the date of the decision being appealed. A decision shall be considered as having been appealed within the aforesaid ten (10) days if a written Notice of Appeal is filed with the City Clerk of the City of Anaheim within said ten (10) day period. Such Notice of Appeal shall: 1. Specify the substance and particulars of the decision being appealed; 2. Show the date of the decision; 3. Be signed by the appellant or his/her duly authorized agent; and 4. Indicate the mailing address of the appellant. Whenever a Notice of Appeal is filed with the City Clerk, the City Clerk shall set the matter for hearing at the earliest reasonable time and shall notify the fire code official and the appellant of the place, date, and time, the Board of Appeals shall hear and consider the appeal. The City Clerk shall give notice of the hearing to the fire code official and to the appellant at least three (3) days prior to the time set for the hearing. Notice shall be given to the appellant by mailing said notice to the address shown on the Notice of Appeal. All decisions of the Board of Appeals shall be final.' 16.08.460 VIOLATION PENALTIES Section 109.3 of Appendix Chapter 1 of the 2007 California Fire Code is hereby amended to read as follows: `Violation Penalties. Except where another penalty is provided pursuant to state law, any person who shall violate any of the provisions of this chapter or shall fail to comply therewith, or who shall violate or fail to comply with any order made hereunder, or who shall build in violation of any detailed statement or specifications or plans submitted and approved thereunder, shall severally for each and every such violation or noncompliance, respectively, be guilty of a misdemeanor, punishable by a fine of not more than One Thousand Dollars or by imprisonment for not more than six months or by both such fine and imprisonment. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each day that the prohibited conditions are maintained shall constitute a separate offense. The application of the above penalty shall not be held to prevent the enforced removal of the prohibited conditions.' 16.08.470 ONE -AND TWO-FAMILY DWELLING Section B 105.1 of Appendix Chapter B of the 2007 California Fire Code is hereby amended to read as follows: `Section B105.1 One- and Two -Family Dwelling. The minimum fire -flow requirements for one- and two-family dwellings having a fire -flow calculation area which does not exceed 3,600 square feet shall be 1,500 gallons per minute. Fire flow and flow duration for dwellings having a fire -flow calculation area in excess of 3,600 square feet shall not be less than that specified in Table B105.1. EXCEPTION: A reduction in required fire flow of 50 percent as approved is allowed when the building is provided with an approved automatic sprinkler system.' 16.08.480 BUIILDINGS OTHER THAN ONE -AND TWO-FAMILY DWELLINGS Section B 105.2 of Appendix Chapter B of the 2007 California Fire Code is hereby amended to read as follows: `Section B 105.2 Buildings Other than One- and Two- Family Dwellings. A reduction in fire -flow of up to 50 percent, as approved by the fire code official, is allowed when the building is provided with an approved automatic sprinkler system installed in accordance with Section 903.3.1.1 or 903.3.1.2. The resulting fire -flow shall not be less than 1,500 gallons per minute for the prescribed duration as specified in Table B 105.1.' SECTION 3. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 4. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 5. PENALTY It shall be unlawful for any person, firm or corporation to violate any provision or to fail to comply with any of the requirements of this ordinance. Any person, firm or corporation violating any provision of this ordinance or failing to comply with any of its requirements shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding One Thousand Dollars ($1,000.00) or by imprisonment not exceeding six (6) months, or by both such fine and imprisonment. Each such person, firm or corporation shall be deemed guilty of a separate offense for each day during any portion of which any violation of any of the provisions of this ordinance is committed, continued or permitted by such person, firm or corporation, and shall be punishable therefor as provided for in this ordinance. SECTION 6. EFFECTIVE DATE This Ordinance shall become effective thirty (30) days from and after the date of its adoption by the City Council. Publication of this Ordinance shall be effected in accordance with the requirements of the Anaheim City Charter. The unrestricted use of grass-, brush-, or forest -covered land in hazardous fire areas is a potential menace to fife and property from fire and resulting erosion. Safeguards to prevent the occurrence of fires and to provide adequate fire -protection facilities to control it which might be caused by recreational, residential, commercial, industrial or other activities conduced in hazardous fire areas shall be in accordance with this section. Section 316.2 Definitions. For the purpose of Section 316, certain terms are defined as follows: 1. Spacial Protection Area. All of the area within the City of Anaheim located east of the Costa Mesa Freeway (SR -55), and south of the Riverside Freeway (SR -91), is hereby designated a Special Protection Area and shall comply with the provisions of Section 316. 2. Tracer ie any bullet or prgjectile incorrpporating a feature which marks or traces the flight ol said bullet or projectile by flame, smoke or other means which results in fire or heat. 3. Tracer Charge is any bullet or projectile incorporating a feature designed to create a visible or audible eftact by means which result in fire or heat and shall include any incendiary bullets and projectiles. 4. Very Higgh Fee Hazard Severity Zone shall be as defined for Local Agency Ve/� Hgh Fire Hazard Severity Zone found in Section 4702.1. Section 3i6.3 Permits. The fire code official is authorized to stipulate conditrone #or pennds. Peimiteshall not be issued when public safety would beat risk, as determined by the fire code official. Section 316.4 Smoking. Lighting, igniting or otherwise setting fire to or smoking tobacco, cigarettes, pipes or c�gare in posted areas is rohibited. Section 316.5 Spark Arrestors. i chimneys used in Conjunction with fireplaces, barbecues, incinerators or heating appliances in which solid, gas, or liquid fuel is used shell be provided with a spark arrestor constructed in accordance with Chapter 28 of the 2007 California Building Code. Section 316.6 Tracer Bullets, Tracer Charges, Rockets, and model Aircraft • 1, Tracer bullets and tracer charges shall not be possessed, fired or caused to be fired in the Special Protection Area. 2. Rockets, model planes, gliders end balloons poweredwith an engine, propellant or other feature liable to start or cause fire shall not be fired or Projected in the Special Protection Area without a permit from the fire code official.. Section 318 7 APieriea. Lighted and smoldering material shall not be used in connection with smoking bees in or upon the Very High Fire Hazard Severity Zone except by permit from the fire code official. Section 316.8 Open Flame Devices. Welding torches, tar pots, decorative torches and other devices, machines or processes liable to start or cause fire shall not be operated or used In or upon the Very High Fire Hazard Severity Zone, except by permit from the fire code official. EXCEPTION: Use within habited premises or designated campsites which fire a minimum of 30 feet from grass-, grain-, brush- or forest -covered areas. RFlame�mpptoying devices, such as lanterns or kerosene road flares, shall not be operated gr used as a signal or marker in the Special Protection Area. A permit shall be obtained from the fire code official to conduct open burning within the Special Protection Areaof the City of Anaheim. Permits shall incorporate such terms and conditions which will reasonably safeguard public safety and property. Outdoor fires shall not be built, ignited or maintained under the following conditions: 1. When high winds are blowing, 2. When a person age 17 or over is not present at all times to watch and tend such fire, or 3. When Public announcement is made that open burning is prohibited. Perrnenent barbecues, portable barbecues, outdoor fireplaces or grills shell not be used for the disposal of rubbish, trash ar oombuatible wsate material. Section 316.10 Incineretore and Flreplaces. Incinerators, outdoor fireplaces, permanent barbecues end grills shalt not be used in the very high fire s�verrty zones without a permit from the fire code official. Incinerators, outdoor fireplaces, perfianent barbecues:entl grille shall be maintained in good repair and in a safe condition at,atl times. Openings in such applianoee shah be provided with an approved spark arrester, screen or door. EXCEPTION: When approved, unprotected openings in barbecues and grills necessary or proper -functioning. , Section 316.11 Gearance ol Brush and Vegetative Growth from Electrical Transmission Lines. General. Clearance of brush and vegetative growth from eloetricei transmission and dieMbution lines shall be in accordance with Section 316.11. EI(CEPTION: Section 318.11 does not authorize persons not having legal right of entry to enter on or damage the property of othere without consent of the owner. Section 316.11.1 Support Clearance. Section 316.11.2. Electrical Diatributxm and rensmiearon Line Clearances General. Clearances between vegetation and electrical lines shall be in accordance with Sectiop 3.16.11.2. Section 316.11.2.1 Trimming Clearance. At the limp of trimming, clearances not less then those established by Table 316.11.2 (1) should be provided. The radial clearance8 a below are minimum clearances that should be established, at time of trimming, between the vegetation and the on tors and associated live parts. EXCEPTION: The fire code official is authorized to establish minimum clearances different than arose specified in Table 316.11.2 (1) when evidence substantiating such other clearances is submitted to the fire code official and approved. Section 316.11.2.2 Minimum Clearance to be Maintained. Clearances not less than those established by Table 316.11.2 (2) shall be maintained during such periods of time as designated by the fire code official. The site specific clearance achieved, at time of pruning, shall vary based on sped the utility company specfic trim cls, the potential line sway due to�wind, line sway due to electrical loading and ambient temperature, and the tree s location in proximity to the high voltage lines. During emergencies, the utility company shall perform the required work tt the extent necessary to clear the hazard. An emergency can include situations such as trees falling Into power lines, or trees in violation of Table 316.11.2-(2). Section 316.11.4 Correction of Condition. The fire code official is authorized to give notice to the owner of the property on which conditions regulated by Section 316.11 exist to correct such conditions. Section 316.12 Dumping. Garbage, cans, bottles, papers, ashes, refuse, trash, rubbish or combustible waste matena shall not be placed, deposited or dumped in or upon hazardous fire areas or in, upon or along trails, roadways or highways into Very High Fire Hazard Severity Zone. EXCEPTION: Approved public and private dumping areas. Section 316.13 Disposal of Ashes. Ashes and coals shall not be placed, deposited or dumped in or upon the Very High Fire Hazard Severity Zone. EXCEPTIONS: • 1. In the hearth of an established fire pit, camp stove or fireplace. 2. In a noncombustible container with a tightfitting lid, which is kept or maintained in a safe location not less than 10 feet from combustible vegetation or structures. 3. Where such ashes or coals are buried and covered with 1 foot of mineral earth not less than 25 feet from combustible vegetation or structures. Section 316.14 Use of Fire Roads end Firebreaks. Motorcycles, motor scooters and motor vehicles shall not be driven or parked upon, and trespassing is prohibited upon, fire roads. or firebreaks beyond the point where travel is restricted by a cable, gate or sign, without the permission of Vehicles shall not be parked in a manner which obstructs the entrance to a fire, road or firebreak. EXCEPTION: Public officers acting within their scope of duty. Radio and television aerials, guy wires thereto, and other obstructions shall not be installed or maintained on fire roads or firebreaks unless located 16 feet or more above such fire road or firebreak. Section 316.15 Use of Motorcycles, Motor Scooters and Motor Vehicles. Motorcycles, motor scooters and motor vehicles shall not be operated within area closed per section 316.22, without a permit by the fire code official, except upon clearly established public or private roads. Permis ty owner shall be presented when requesting a permit. Section 316.16 Tampering with Fire Department Locks, Barricades and Signs. Locks, barricades, seals, cables, signs and markers installed withirtthe Special Protection Area, by or under the control of the fire code official, shall not be tampered with, mutilated, destroyed or removed. and locks installed by or under the control of the fire code official shall not be unlocked. Section 316.17 Liability for Damage. The sxenses of fighting fires which result from a violation of Section 316 shall be a charge against the person whose violation of Section 316 caused the fire. Damages caused by such fires shall Constitute a debt of such person and are collectable b, in the same manner as in the case of an ob igation under a contract, expressed or implied. Section 316.18 Fuel Modification Requirements for New Construction: All new buildings constructed in the Special Protection Area shall, comply with the following: 1. Fuel modification plans shall be submitted to and approved by the fire code official prior to the issuance of a grading permit. 2. The fuel modification plans shall meet the criteria set forth in the City of Anaheim Fuel Modification Plans and Maintenance Specifications and Requirements. 3. The fuel modification, plan may be altered if conditions change. Any alterations to the fuel modification shall be approved by the fire code official 4.A11 elements of the fuel modification plan shall be maintained in accordance with the approved plan and are subject to the enforcement process outlined in Section 109 of the 2007 California Fire Code. Section 316.19 Clearance of Brush or Vegetative Growth from Structures. Section 316.19.1 General. Persons owning, leasing, controlling, operating or maintaining buildings or stroctures in the Special Protection Area, and persona owning, leasing or controlling land adjacent to such buildings or structures, shall at all "a:1. Maintain an effective firebreak by removing and clearing away flammable vegetation and combustible growth from areas within 100 feet of such buildings or structures; EXCEPTIONS: N (a) Single specimens of trees, ornamental shrubbery or similar plants used as ground covers, provided that they do not form a means of rapidly transmitting fire from the native growth to any structure. (b) Grass and other vegetation located more than 100 feet from buildings or structures and less than 18 inches in height above the ground need not be removed where necessary to stabilize the soil and prevent erosion. 2 Maintain additional fire protection or firebreak by removing brush, flammable vegetation and combustible growth beyond the 100 feet from such buildings or structures, when required by the fire code official due to extra hazardous conditions causing a rrlrebreak of only 100 feet to be i reasonable fire safety. 3. Remove portions of trees which extend within 10 feet of the outlet of a chimney. 4. Maintain trees adjacent to or overhanging a building free of deadwood. ` 5. Trees shall be trimmed to provide a minimum of 10 foot ground clearance. 6. Trees shall be cut/pruned at the angle -of the slope in which they reside. 7. Irrigated surface fuels shell be maintained at a height not to exceed 18 inches. 8. Maintain the roof of a structure free of leaves, needles or other dead vegetativerowth. 9. Debris and trimmings shall be removed from the she, or chipped and converted -into mulch then evenly dispersed in the same area to a maximum depth of three (3) inches. 10. Deadwood and tree litter shall be regularly removed from trees. 11. Tree crowns extending to within 10 feet of any structure shall be pruned to maintain a 10 foot clear horizontal distance. Section 316.20 Clearance of Brush or Vegetation Growth from Roadways. The fire code official is authorized to_cause areas within 10 feet on each side of portions of highways and private streets which are improved, designed or ordinarily used for vehicular traffic to be cleared of flamr other combustible growth. The fire code official is authorized to enter upon private property to do so. EXCEPTION: Single specimen's of trees, ornamental shrubbery or cultivated ground cover such as green grass, ivy, succulents or similar plants used as ground covers, provided that they do not form a means of readily transmitting fire. Section 316.21 Use of Equipment 1. Except as otherwise provided in this section, no person shall use, operate, or cause to be operated, in, upon or adjoining any Very High Fire Hazard Severity Zone any internal combustion engine which uses hydrocarbon fuels, unless the engine Is equipped with a spark arrestor and rr working order, or the engine is constructed, equipped and maintained for the prevention of fire. 2. Spark arrestors affixed to the exhaust system of engines or vehicles subject to this section shall not be placed or mounted in such a manner as to allow flames or heat from the exhaust system to ignite any flammable material. 3.A spark arrestor is a device constructed of nonflammable material specifically for the purpose of removing and retaining carbon and other flammable particles over 0.0232 of an Inch in size from the exhaust flow of an internal combustion engine that uses hydrocarbon fuels or which is c the United States Forest Service. 4' Engines used to provide motor power for trucks, truck tractors, buses, and passenger vehicles, except motorcycles, are not subject to this section lithe exhaust system is equipped with a muffler as defined in the Vehicle Code of the State of Califomia. 5. Turbocharged engines ere not subject to this section f all exhausted gases pass through the rotating turbine wheel, there is no exhaust bypass to the atmosphere, and the turbocharger is in effective mechanical condition. Section 318.22 Restricted Entry. The fire code official shall determine and publicly announce when the Very high Fire Hazard Severity Zone shall be closed to entry and when such areas shall again be opened to entry. Entry on and occupation of hazardous fire areas, except public areas or established trails and camp store which have not been closed during such time when the hazardous fire area is closed to entry, is prohibited. EXCEPTIONS: 1. Residents and owners of private property within hazardous fire areas and their invitees and guests going to or being upon their lands. 2. Entry, in the course of duty, by peace or police officers, and other duly authorized public officers, members of a fire department and members of the United States Forest Service. 3. All high-rise buildings shall have at least one Automated External Defibrillator (AED) located on each occupied floor level.' Section 408.12;1 Type. The property owner shall be responsible for testing and maintaining detectors in common stairways and hallways. it shall be the responsibility of the tenant, whose tenancy will be longer the and maintain detectors within dwelling units or rooming unite and to notify the owner of authorized agent, in writing, of any deficiencies. The owner shall be responsible for providing each tenant with written information regarding detector testing and maintenance, or such information mai mon areas frequently visited by tenants such as the laundry room area. lie The tenant shall be responsible for replacement of the battery except that such battery shall be in operating condition at the time that the tenant takes possession.
