97-205RESOLUTION NO. 97R-205 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 94R -240 (ANAHEIM RESORT NONCONFORMING SIGNAGE PROGRAM). WHEREAS, on September 20, 1994, the City Council adopted Resolution No. 94R -240 adopting the Anaheim Resort Nonconforming Signage Program; and WHEREAS, the Anaheim Resort Nonconforming Signage Program provides an incentive to encourage business, property and sign owners within the Anaheim Resort to bring their signage into conformance with the new standards identified in the Anaheim Resort Specific Plan, the Disneyland Resort Specific Plan, the Hotel Circle Specific Plan and the Anaheim Resort Identity Program; and WHEREAS, the Anaheim Resort Nonconforming Signage Program currently provides full -cost reimbursement for the removal of existing freestanding pole or monument signs, fabrication and installation of new Anaheim Resort monument signs and associated property repairs for properties adjacent to Harbor Boulevard between I -5 and Orangewood Avenue and Katella Avenue between Walnut Street and I -5, and up to $5,000 towards said costs for properties adjacent to the remaining streets in the Anaheim Resort; and WHEREAS, Planning Department staff recommends that the Anaheim Resort Nonconforming Signage program be amended to expand the area eligible for full cost reimbursement, as set forth in Attachment A to this Resolution, which is incorporated herein, and further amended to extend the program through December 31, 1998; and WHEREAS, the City Council reaffirms the recitals in Resolution No. 94R -240, and finds that the Anaheim Resort Nonconforming Signage Program provides a financial incentive to business, property and sign owners desiring to replace their legal nonconforming signage which has had a very positive effect on the area. NOW, THEREFORE, BE IT RESOLVED, based upon the foregoing, by the City Council of the City of Anaheim as follows: 1. That Resolution No. 94R -240 be, and the same is hereby amended to substitute Attachment A to this Resolution for Attachment A to Resolution No. 94R -240. 2. That Attachment B of Resolution No. 94R -240 be, and the same is hereby amended to revise Section Iv, paragraph Nos. A and C as follows: "A. Term of Program Participants may enter into Program Participation Agreements with the City of Anaheim until December 31, 1998. Installation and reimbursement may be completed following December 31, 1998, provided the Program Participation Agreement has been fully executed prior to that date." "C. Eligible Properties: 1. Central Core Properties: Properties adjacent to Harbor Boulevard and Katella Avenue. Harbor Boulevard between I -5 and Orangewood Avenue, and Katella Avenue between Walnut Street and the I -5, are the most visible streets in the Anaheim Resort for both vehicular and pedestrian traffic. The replacement of legal nonconforming freestanding pole and monument signage along these corridors with conforming signage will improve the aesthetics of the Anaheim Resort, make the signage more efficient and contribute towards the transformation of this area into a resort environment. Therefore, as funding permits, and as an incentive for Property, Business and Sign Owners to replace their nonconforming signage, the City will pay for the removal and replacement of legal nonconforming freestanding pole and monument signage with conforming signage and the repair of any damage, if any, caused to the real property as a result of the removal of the pole or monument sign. 2. Additional Properties: Properties within the Anaheim Resort adjacent to Ball Road- Harbor Boulevard north of the I -5 Freeway; Freedman Way; Clementine Street; Manchester Avenue between Harbor Boulevard and a point 550 feet east of Harbor Boulevard. Ox Road and, West Street, north of Ball Road. These properties are along streets which are, or are immediately adjacent to, primary accessways into or through the Anaheim Resort. The earlier replacement of legal nonconforming freestanding pole and monument signage along these streets with conforming signage will improve the aesthetics of the Anaheim Resort, make the signage more efficient and contribute towards the transformation of this area into a resort environment. Therefore, as funding permits on a first -come, first serve basis, and as an incentive for property, business and sign owners to replace their nonconforming signage, the City will reimburse the full cost of the removal of the existing sign, fabrication and installation of the new sign and associated repairs to the property. 3. Gateway Property Outside Anaheim Resort: 1201 W. Katella Avenue (Abby's Anaheimer Hotel). This property is located at the northwest corner of Katella Avenue and Walnut Street, immediately adjacent to the Anaheim Resort. It is also near the western gateway to the Anaheim Resort and is zoned CL (Commercial, Limited). The removal of the existing pole sign and replacement with an Anaheim Resort monument sign would enhance the aesthetics of this entry point. Therefore, as funding permits on a first -come, first -serve basis, the City will reimburse the full cost of the removal of the existing sign, fabrication and installation of the new Anaheim Resort monument sign and associated repairs to the property. 4. Other Properties in the Anaheim Resort For properties in the Anaheim Resort other than those identified in paragraphs 1 and 2 above, as funding permits on a first -come, first -serve basis, the City will provide a maximum of $5,000.00 for each lot or parcel to assist Property, Business and Sign Owners to replace legal nonconforming freestanding pole and monument signage with conforming signage." BE IT FURTHER RESOLVED that, except as expressly amended herein, Resolution No. 94R -240 shall remain in full force and effect. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 4th day of November, 1997.
