2000-137RESOLUTION NO. 2000R-137 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM VACATING CERTAIN PUBLIC STREETS AND ALLEYS IN THE VICINITY OF JEFFREY DRIVE AND LYNN AVENUE (Abandonment No. 00-5A) WHEREAS, the City Council of the City of Anaheim did, by resolution duly adopted, declare its intention to vacate certain public streets, highways or public service easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and WHEREAS, notice of a public hearing to consider said vacation was posted and published in the manner prescribed by law; and WHEREAS, on the llth day of July, 2000, a public hearing was held to allow interested persons to submit evidence concerning said proposed vacation. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation of portions of Michelle Drive, Audre Drive, Jeffrey Drive and certain unnamed public alleys, more particularly described as follows: See Exhibit A attached hereto and incorporated by this reference herein and subject to the reservations therein contained; provided, however, that this action shall serve only to terminate the rights of the public to use said street, highway, or public service easement and shall not be construed to convey or relinquish any property interest of the City of Anaheim in and to said street, highway or public service easement. BE IT FURTHER RESOLVED that the Mayor be, and he is hereby, authorized and directed to execute a quitclaim deed to convey the interest of the City of Anaheim in and to the streets and alleys being abandoned by this resolution to the Anaheim Housing Authority. BE IT FURTHER RESOLVED that the vacation authorized by this resolution shall not be effective until a certified copy of this resolution is recorded in the Office of the Recorder of Orange County. II II BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this resolution to be recorded in the Office of the Recorder of the County of Orange. ATTEST: C~TY CLER~ OF 'THE CIT~ OF ANAHEIM MAYbR~HEIM ABANDONMENT 00-SA EXHIBIT "A" Those portions of Tract No. 3278, in the City of Anaheim, County of Orange, State of Caiifomia, shown on map filed in Book 104, Pages 8, 9, and 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Portion of Michelle Drive That portion of Michelle Drive bounded on the North by a line being parallel with and 32.00 feet, southerly measured at right angles, from the centerline of Lynne Avenue and bounded on the South by the easterly prolongation of the southerly line of Lot 45 of said Tract all as shown on said Map. Portion of Audre Drive That portion of Auclre Drive bounded on the West by the southerly prolongation of the westerly line of Lot 45 and bounded on the East by a line being parallel with and 57.00 feet, westerly, measured at fight angles, from the centertine of Walnut Avenue of said Tract ail as shown on said Map. Jeffery Drive That portion of Jeffrey Drive bounded on the North by the easterly prolongation of the northerly line of Lot 33 of said Tract and bounded on the South by the easterly prolongation of the southerly line of Lot 23 of said Tract all as shown on said Map. Alley That certain alley lying between Wainut Avenue and Jeffrey Drive bounded on the North by the easterly prolongation of the northerly line of Lot 12 of said Tract and bounded on the South by the easterly prolongation of the southerly line of Lot 22 of said Tract all as shown on said Map. Alley That certain ailey lying between Jeffrey Drive and Michelle Drive bounded on the North by the easterly prolongation of the northerly line of Lot 34 of said Tract and bounded on the South by the easterly prolongation of the southerly line of Lot 44 of said Tract all as shown on said Map. EXCEPTING AND RESERVING therefrom unto the City of Anaheim an easement for public utility purposes including, but not limited to, the installation and maintenance of water and electrical facilities over, under, along, and across the streets and alleys described above, together with reasonable rights of ingress and egress. Also reserving therefrom unto Pacific Bell, a public utility easement to construct, place, operate, inspect, maintain, repair, replace, and remove such arterial and underground telephone and telegraph communication structures and facilities as the company may from time to time require, including poles, anchors, wires, cables, conduits, manholes, markers, and necessary fixtures and appurtenances within the streets and alleys described above, together with reasonable of ingress and egress. Said reservation to Pacific Bell is subject to the prior rights of the City of Anaheim, as described in the reservation unto said City in paragraph seven above. Page 2 ABANDONMENT 00-5A Also reserving therefrom unto the Southern California Gas Company, an easement for public utility purposes for the installation and maintenance of gas line facilities over, under, along, and across the streets and alleys described above, together with reasonable rights of ingress and egress. Said reservation to Southern California Gas Company is subject to the prior rights of the City of Anaheim, as described in the reservation unto said City in paragraph seven above. Also reserving therefrom umo Adelphia Communications, an easement for public utility purposes for the installation and maintenance of cable communications facilities over, under, along, and across the streets and alleys described above, together with reasonable rights of ingress and egress. Said reservation to Adelphia Communications is subject to the prior rights of the City of Anaheim, as described in the reservation unto said City in paragraph seven above.
