A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM VACATING THAT CERTAIN EASEMENT FOR
HIKING AND EQUESTRIAN PURPOSES LOCATED AT
PROPERTY AT 357 RAMSGATE DRIVE (99-18A)
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate
certain public streets, highways or public service easements
pursuant to the Public Streets, Highways and Service Easements
Vacation Law; and
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by
law; and
WHEREAS, on the 7th day of March, 2000, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation of that
easement for hiking and equestrian purposes, particularly
described as follows:
That certain easement for hiking and
equestrian purposes lying adjacent and
parallel to the southerly line of Lot 8
of Tract No. 9524 and extending westerly
from Ramsgate Drive (formerly Sunset
Ranch Road) to a point 10.00 feet east
of the west line of said Lot 8 as shown
on Tract No. 9524, as recorded in Book
412, Pages 40 through 43 of
Miscellaneous Maps records in the office
of the Orange County Recorder.
provided, however, that this action shall serve only to terminate
the rights of the public to use said street, highway, or public
service easement and shall not be construed to convey or
relinquish any property interest of the City of Anaheim in and to
said street, highway or public service easement.
BE IT FURTHER RESOLVED that the vacation authorized by
this resolution shall not be effective until a certified copy of
this resolution is recorded in the Office of the Recorder of
Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be recorded in the Office of the Recorder of
the County of Orange upon the certification of the Director of
the Community Development Department that each of the following
conditions or events has been completed or occurred:
1. Receipt of payment of Three Thousand Five
Hundred Eighty Dollars ($3580.00)
BE IT FURTHER RESOLVED that the Mayor be, and he is
hereby, authorized and directed to execute a quitclaim deed to
the easement vacated hereby upon the receipt of the payment set
forth above.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 7th day_of March,
