96-081 RESOLUTION NO. 96R- 81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LETTER OF UNDERSTANDING BETWEEN THE GENERAL TRUCK DRIVERS UNION, LOCAL 952 AND THE CITY OF ANAHEIM. WHEREAS, the Human Resources Director met and conferred with officials and employee representatives of the General Truck Drivers Union, Local 952, relating to the effects/impacts of the lease agreement between the City of Anaheim and Disney Baseball Enterprises, Inc.; and WHEREAS, the Union is in agreement with the recommendations contained in said Letter of Understanding; and WHEREAS, as a result thereof, the Letter of Understanding dated May 1, 1996, between the parties has been prepared and signed; and WHEREAS, the City Council of the City of Anaheim does find that it is in the best interest of the City of Anaheim to approve said Letter of Understanding. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding dated May 1, 1996 between the General Truck Drivers Union, Local 952 and the City of Anaheim, a copy of which is attached hereto and incorporated by reference herein, is hereby approved. SOHL, City Clerk of the City of Anaheim, do hereby certify that the foregoing is the original of Resolution No. 96R-81 was duly passed and adopted by the City Council of the City of Anaheim on May 21st, 1996. ~,ClTY CLERK OF ' -IEIM LETTER OF UNDERSTANDING Between the GENERAL TRUCK DRIVERS UNION, LOCAL 952 and the CITY OF ANAHEIM The PARTIES, having met and conferred in good faith regarding the effects/impacts of the lease agreement between the City of Anaheim and Disney Baseball Enterprises, Inc., have agreed to the following to mitigate the effects of that agreement: 1. In the event that Disney Baseball Enterprises, Inc., selects the option of managing and operating the Stadium Parking Area beginning October 1, 1996, then all existing employees of the City of Anaheim currently engaged in the Baseball Stadium operations who indicate by a standard employment application an interest in being employed by Disney Baseball Enterprises, Inc., in comparable positions, will be interviewed by Disney Baseball Enterprises, Inc. Disney Baseball Enterprises, Inc., will consider in good faith, at its sole discretion, the employment of such persons, subject to wages, benefits and other employee programs and practices of Disney Baseball Enterprises, Inc. 2. In the event that the City of Anaheim is not selected for the parking concession with Disney Baseball Enterprises, Inc., the City shall give the UNION notice of such determination within five (5) working days and will meet and confer with the General Truck Drivers Union, Local 952, concerning the impacts/effects of such determination. 3. Employees working in classifications listed in Appendix "A" of the Memorandum of Understanding between the General Truck Drivers Union, Local 952, and the City of Anaheim, Anaheim Stadium only, from March 29, 1996 to September 30, 1996, who are still employed by the City of Anaheim during the pay period that includes September 30, 1996, shall be eligible to be paid a one-time payment of $75.00 in addition to their regular pay.
