96-077 RESOLUTION NO. 96R- ?? A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LETTER OF UNDERSTANDING BETWEEN THE HOSPITAL AND SERVICE EMPLOYEE UNION, LOCAL 399 AND THE CITY OF ANAHEIM. WHEREAS, the Human Resources Director met and conferred with officials and employee representatives of the Hospital and Service Employee Union, Local 399, relating to the effects on the Union's membership of the proposed Stadium lease agreement between the City of Anaheim and Disney Baseball Enterprises, Inc.; and WHEREAS, the Union is in agreement with the recommendations contained in said Letter of Understanding; and WHEREAS, as a result thereof, the Letter of Understanding dated May 9, 1996, between the parties has been prepared and signed; and WHEREAS, the City Council of the City of Anaheim does find that it is in the best interest of the City of Anaheim to approve said Letter of Understanding. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding dated May 9, 1996 between the Hospital and Service Employee Union, Local 399 and the City of Anaheim, a copy of which is attached hereto and incorporated by reference herein, is hereby approved. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 21st day of May, 1996. SOHL, City Clerk of the City of Anaheim, do hereby certify that the foregoing is the original of Resolution No. 96R-77 was duly passed and adopted by the City Council of the City of Anaheim on May 21st, 1996. ~'~, CITY C'~L~RK OF TH~~~I~ OF ANAHEIM AGREEMENT BETWEEN the HOSPITAL and SERVICE EMPLOYEES' UNION, Local 399 and the CITY of ANAHEIM The City of Anaheim ("CITY") and the Hospital and Service Employees' Union, Local 399 ("UNION") have met and conferred regarding the effects on the UNION's membership of the proposed Stadium Lease Agreement between the CITY and Disney Baseball Enterprises, Inc. The parties agree to the following provisions to assist interested employees to apply for employment by Disney Baseball Enterprises or to request a transfer to the Anaheim Convention Center: 1. Any Stadium employee employed on May 10,1996 who is in a classification represented by the UNION may request to be considered for transfer to the Anaheim Convention Center in a like classification as vacancies occur. 2. CITY shall establish a pool of employees who notify CITY of their interest in being considered for transfer. Notification shall be on forms provided by CITY specifically for this purpose. 3. The pool will be established by June 1, 1996. No employee may be added to the pool after that date. 4. For the period June 1, 1996 through December 31, 1996, applicants for any vacancy in a classification represented by UNION at the Convention Center shall be drawn from the pool established under this Agreement. CITY shall not hire outside this pool unless all qualified pool applicants have previously been considered and rejected. 5. Employees who transfer to the Convention Center shall have their seniority calculated from the date of the transfer for the purpose of Article 13, Work Assignment. Employees shall retain their Stadium hire date for all other purposes. 6. Employees working in classifications listed in Appendix "A" at Anaheim Stadium only from March 29, 1996 to September 30, 1996 who are not offered employment by Disney Baseball Enterprises after completion of the standard employment application and being interviewed .er- have not been offered a transfer to the Anaheim Convention Center after indicating an interest in transfer and being interviewed by December 31, 1996 shall be eligible to be paid a one-time payment in the amount listed below during the pay period that includes December 31, 1996. 25 years or more $50 per full year of service 15 years to 24 years $40 per full year of service 10 years to 14 years $30 per full year of service 5 years to 9 years $20 per full year of service 1 - 4 years $50 lump sum payment per employee less than 1 year 0 The years of service shall be calculated using the September 30, 1996 date.
