A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM EXEMPTING
VARIOUS PROPERTY ACQUISITIONS AND
DISPOSITIONS FROM CONFORMITY
FINDINGS UNDER GOVERNMENT CODE
SECTION 65402.
WHEREAS, California Government Code Section 65402
specifies that for jurisdictions which have adopted a General
Plan, various acquisitions of real property, dedications, or
vacations must be submitted to the planning agency for review and
reporting as to conformity with the General Plan; and
WHEREAS, City of Anaheim has adopted a General
Plan, which among other things, calls for various roadway
improvements; and
WHEREAS, California Government Code Section 65402
permits the City by resolution to provide that the planning
agency reference and reporting procedure shall not apply to any
of the following:
(1) disposition of the remainder of a larger
parcel which was acquired and used in part for street
purposes;
(2) acquisitions, dispositions, or abandonments
for street widening; or
(3) alignment project, provided that such are
"minor"; and
WHEREAS, the City Council now wishes to exempt its
street widening and beautification projects from the procedural
requirements of making reference to a planning agency for a
finding of conformity with the General Plan.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The planning agency reference and conformance
reporting procedure of Government Code Section 65402
shall not be required for any property acquisitions
made in connection with the Anaheim Resort Area
Improvement Projects and the Katella Smart Street
Project currently being undertaken by the City
including the following streets and portions thereof:
A. Harbor Boulevard from Orangewood Ave. to
approximately 200 feet south of Katella Ave.
B. Katella Avenue from the Santa Ana Freeway (I-5)
to Ninth Street including the following inter-
sections:
1. Anaheim Boulevard from Katella Ave.
to approximately 400 feet northerly
of Katella Ave.
2. Haster Street from Katella Ave. to
approximately 600 feet souther-
ly of Katella Ave.
3. Clementine Street - from Katella Ave.
to approximately 200 feet northerly
of Katella Ave.
4. Harbor Boulevard - from 200 feet
south of Katella Ave. to 700 feet
north of Katella Ave.
5. West Street - from 400 feet north of
Katella Ave. to 600 feet south of
Katella Ave.
C. Ball Road from the Santa Ana Freeway to West
Street.
D. Harbor Boulevard from Ball Road to Vermont Ave.
E. Harbor Boulevard from the Santa Ana Freeway to
900 feet south of Manchester Ave. including
that portion of Manchester Ave. extending
300 feet easterly of Harbor Boulevard.
F. Clementine Street / Manchester Ave. from Alro
Way to 200 feet south of Freedman Way including
200 feet of Freedman Way west of Clementine
St./ Manchester Ave.
(All of the foregoing streets are referred to
throughout this resolution as the Anaheim Area
Resort Improvement Projects and the Katella Smart
Street Project.)
2. The City Council hereby finds that the
Anaheim Area Resort Improvement Projects and the
Katella Smart Street Project are "minor" for the
purposes of this reference procedure, in that few of
the parcels to be acquired for the project constitute
full takes, but rather merely additional right of way
for street widening purposes, and few are expected to
completely displace any residence or business.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 16th day of April, 1996.
