96-045 RESOLUTION NO. 96R-45 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN EXTENSION OF TIME FOR CONDITIONAL USE PERMIT NO. 3724. WHEREAS, the Planning Commission of the City of Anaheim heretofore adopted Resolution NO. PC94-151 on November 14, 1994, approving Conditional Use Permit No. 3724 subject to certain conditions of approval; and WHEREAS, the permittee has failed to comply with all of the conditions of approval of said Conditional Use Permit No. 3724 within one year following the approval thereof and, therefore, said Conditional Use Permit has been rendered null and void unless an extension of time is approved therefor pursuant to Section 18.03.090 of the Anaheim Municipal Code; and WHEREAS, the permittee has heretofore filed an application for extension of said time limitation to comply with the conditions of approval of Conditional Use Permit No. 3724 pursuant to the provisions of Section 18.03.090 of the Anaheim Municipal Code; and WHEREAS, the City Council held a duly noticed public hearing on said application on March 26, 1996, at which hearing the City Council did receive and consider evidence, both oral and documentary, relating thereto; and WHEREAS, the City Council hereby finds that good cause exists to grant an extension of time to comply with said conditions of approval. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that said application for extension of said time limitation be, and the same is hereby, approved and that said Conditional Use Permit No. 3724 is hereby extended for one additional year to expire on November 16, 1996 subject to the condition and stipulation by the permittee as follows: That the permittee recognizes that the subject property in which the church is located is an industrial zone and permittee agrees not to oppose, object to or otherwise contest any industrial uses heretofore or hereinafter established upon property in the vicinity of the subject church property as further set forth in that certain letter dated November 18, 1994 from the Diocese of Orange which letter is on file with the City Planning Department. BE IT FURTHER RESOLVED that the time within which a rehearing must be sought is governed by the provisions of Section 1.12.100 of the Anaheim Municipal Code (and the time within which judicial review of final decisions must be sought is governed by the provisions of Section 1094.6 of the Code of Civil Procedure*).
