96-002 RESOLUTION NO. 96R-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A CERTAIN DEED CONVEYING TO THE ANAHEIM REDEVELOPMENT AGENCY CERTAIN REAL PROPERTY OR INTERESTS THEREIN. WHEREAS, in order to carry out and implement the Redevelopment Plan for Redevelopment Project Alpha, the Anaheim Redevelopment Agency (the "Agency") and Blaine and Dee Ann Jacklin (the "Developer") have entered into the First Amendment to Disposition and Development Agreement dated November 14, 1995 (the "DDA"), which DDA requires that the Agency convey clear title to Parcel 1 of Parcel Map 94-183 to the Developer for restoration of a historic single family house known as the "Grimshaw Cottage," and the Developer will acquire and renovate the Grimshaw Cottage; and WHEREAS, the Agency is required pursuant to the DDA to prepare a parcel map to create a legal parcel for the Grimshaw Cottage; WHEREAS, the City owns fee title to a portion of Parcel 1 of Parcel Map No. 94-183 totaling approximately 600 square feet; and WHEREAS, pursuant to Council Policy No. 216 it is ordinarily the policy of the City to obtain fair market value for the release or conveyance of real property held by the City; and WHEREAS, it is necessary for the City to quitclaim all interest in Parcel 1 of Parcel Map No. 94-183 in order for the Agency to convey clear title to the Developer (the "Quitclaim"); and WHEREAS, the fair market value of the City's interest in Parcel I of Parcel Map No. 94- 183 is approximately Seven Thousand Three Hundred Ninety-Two Dollars; and WHEREAS, the Agency will expend approximately Thirty Thousand Dollars in public improvements to the alley and Rose Street adjacent to the Grimshaw Cottage property, consisting of lighr'mg, landscaping, street and utility improvements; and WHEREAS, the City is authorized pursuant to Health and Safety Code Section 33220 to convey any of its property to the Agency, upon the terms and with or without consideration as it determines, for the purpose of aiding and cooperating in the planning, undertaking, construction or operation of redevelopment projects located within the City; and WHEREAS, the City Council has dully considered all terms and conditions of the proposed Quitclaim and believes that the Quitclaim is in the best interests of the City and the health, safety, and welfare of its residents, and in accord with the public purposes and provisions of applicable State and local law requirements; and WHEREAS, the City Council finds that the Quitclaim of the City's interests in Parcel 1 of Parcel Map No. 94-183 will result in the installation of public improvements of greater value to the City than the value of the City's interest in the real property to be quitclaimed; and WHEREAS, the Agency lint the city have previously approved a Negative Declaration pursuant to the Californ~ Environmental Quality Act ("CEQA") with respect to the rehabilitation of the Grhmh~w Cottage pursuant to the t~ms of the DDA, and the Quitclaim would carry out the project previously approved lad would not result in any further environmental impacts beyond the environmental impacts of the project which was previously approved. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES RESOLVE AS FOLLOWS: Section 1. The City Council hereby finds and determines that the project approved by this resolution is exempt form CEQA pursuant to Section 15061(b)(3), in that the project has no potential for causing a significant effect on the environment beyond the project which was previously approved by the City Council and the Agency. The City Clerk is authorized and directed to file a Notice of Exemption pursuant to the provisions of CEQA. Section 2. The City Council hereby waives the provision of Council Policy No. 216 with respect to the Quitclaim of the City's interest in Parcel 1 of Parcel Map No. 94-183 to the Agency. Section 3. The Quitclaim is hereby approved. The Mayor and City Clerk are hereby authorized, on behalf of the City, to sign the Quitclaim and any other documents necessary and appropriate to carry out and implement the Quitclaim. S¢~tign 4.
