95-179 RESOLUTION NO. 95R-179 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING SPECIFIC PLAN NO. 88-1 AND THE ZONING AND DEVELOPMENT STANDARDS RELATING THERETO WHEREAS, the Anaheim City Council approved Specific Plan No. 88-1 (the Sycamore Canyon Specific Plan) on February 9, 1988, to provide for development of up to 1,119 residential units, 20 acres of commercial uses, and 133 acres of general open space on property located on the east and west sides of Canyon Vista Drive and the east and west sides of Serrano Avenue at Weir Canyon Road; and WHEREAS, the Sycamore Canyon Specific Plan was subsequently amended in May 1989 to provide for 61 additional residential units for a maximum total of 1,180 residential dwelling units. WHEREAS, Development Area 5 of the Sycamore Canyon Specific Plan consists of approximately 4.2 acres of property located at the northeast corner of Weir Canyon Road and Canyon Vista Drive; and that said property is currently designated for development as General Commercial on Exhibit 12 "Specific Plan", Exhibit 15 "Specific Plan Exhibit A" and Exhibit 23 "Product Types" of the Specific Plan document. WHEREAS, the petitioner proposes to redesignate Development Area 5 from General Commercial to Single Family Detached to allow development of up to twenty four (24) single- family detached dwelling units, thereby increasing the total number of permitted dwelling units in the Specific Plan from 1,180 to 1,204 units; and WHEREAS, the petitioner also proposes to amend Subsection .070 "Development Area 5" of Section 18.71.060 "Development Standards" of the Anaheim Municipal Code, to establish standards similar to those for neighboring Development Areas 4, 6 and 7 (which standards are based on the RS-5000[SC] "Residential, Single-Family - Scenic Corridor Overlay" Zone) with certain exceptions. All development standards of the "RS- 5000(SC)" Zone (Chapter 18.27) shall apply to Development Area 5 except as proposed below: DEVELOPMENT STANDARD PROPOSED DEVELOPMENT AREA 5 Minimum Building Site and 4,000 sq.ft. lot and 3,000 sq.ft. building pad Building pad Area Minimum Lot Width 45 feet Minimum Lot Width for 35 feet, measured at the Cul-de-sac and Knuckle required building setback line Lots Minimum Lot Frontage 20 feet on accessway or Width for Flag Lots easement providing access to the flag lot Maximum Lot Coverage and 40% lot coverage and Minimum Open Space per No additional open space Lot required for additional bedrooms Minimum Setback to 18-foot long driveway between "Front-on" Garages the property line and a garage with a roll-up garage door Minimum Parking Space 16 feet wide by 18 feet long Dimensions for required driveways, measured from the property line to a garage with a roll- up garage door Required Site Screening Decorative type wall permitted to preserve view opportunities where a minimum 6-foot grade separation exists between any arterial highway and a property line and a minimum 12-foot setback exists between the single-family development and the above-stated conditions; otherwise a 6- foot high block wall is required Minimum Lot Depth 70 feet, with the exception of adjacent to Arterial open spaces lots Highways Minimum Open Space Area 15-foot wide landscaped open adjacent to Arterial space area or easement Highways WHEREAS, the City Council did hold a public hearing upon said application on October 17, 1995, notice of which hearing was given in the manner required by law; and WHEREAS, the City Council, after due consideration of all evidence, testimony and reports offered at said public hearing does hereby find with respect to said proposed amendment that: 1. The property covered by the specific plan has unique site characteristics including topography, location and surroundings which will be enhanced by the special land use and developments standards of the specific plan; 2. The plan is consistent with the goals and policies of the General Plan and with the purposes, standards and land use guidelines therein; 3. The specific plan will result in development of a desirable character which will be compatible with existing and proposed development in the surrounding area; 4. The specific plan contributes to a balance of land users; and 5. The specific plan respects environmental and aesthetic resources consistent of economic realities. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby approve amendments to Specific Plan No. 88-1, consisting of revised Exhibit 12 "Specific Plan", Exhibit 15 "Specific Plan Exhibit A" and revised Exhibit 23 "Product Types" changing the land use designation for Development Area 5 from General Commercial to Single Family Detached and revising the Development Standards for Development Area 5, as set forth herein, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That completion of the proposed amendments to Specific Plan No. 88-1 is contingent upon approval and adoption of General Plan Amendment No. 338 by the Anaheim City Council. 2. That prior to approval of Final Tract Map No. 15223 (Development Area 5) or issuance of the first building permit for Tract Map No. 15223, whichever occurs first, the property owner/developer shall pay appropriate park and recreation in-lieu fees for the twenty-four (24) single- family detached residential units in said Development Area 5 to the City of Anaheim in an amount as established by City Council Resolution. 3. That prior to approval of Final Tract Map No. 15223 (Development Area 5) or issuance of the first building permit for Tract Map No. 15223, the property owner/developer shall pay Branch Library fees for the twenty-four (24) single-family detached residential units in said Development Area 5 to the City of Anaheim in an amount as established by City Council Resolution. 4. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. BE IT FURTHER RESOLVED that the Anaheim City Council does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. BE IT FURTHER RESOLVED that nothing contained herein shall constitute a determination by the City of Anaheim relating to any requested break in the median island on Weir Canyon Road to permit access to or from Development Area 5. Any such determination shall require separate action by the City. BE IT FURTHER RESOLVED that, except as expressly amended herein, Specific Plan No. 88-1, as heretofore adopted, shall remain in full force and effect.
