95-176 RESOLUTION NO. 95R-176 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ESTABLISHING FINDINGS SUPPORTING THE EXCLUSION OF CERTAIN AREAS FROM THE VERY HIGH FIRE HAZARD SEVERITY ZONE DESIGNATION RECOMMENDED BY THE STATE DIRECTOR OF FORESTRY WHEREAS, the State Legislature has added Chapter 6.8 (commencing with Government Code Section 51175) to Part I of Division I of Title 5 of the Government Code (hereinafter the "Bates Bill") providing for designation of areas in the state as Very High Fire Hazard Severity Zones and identifying measures to retard the rate of spread and reduce the potential intensity of uncontrolled fires; and WHEREAS, the California Director of Forestry and Fire Protection (hereinafter "California Director") has recommended certain areas within the City of Anaheim be classified as Very High Fire Hazard Severity Zones; and WHEREAS, the California Director recommended that all of the area east of the Costa Mesa Freeway (SR-55) and south of the Riverside Freeway (SR-91) be included within the Very High Fire Hazard Severity Zone; and WHEREAS, the Bates Bill provides for a local agency, at its discretion, to exclude areas from the Very High Fire Hazard Severity Zone following a finding supported by substantial evidence in the record that the requirements of Government Code Section 51182 are not necessary for effective fire protection within the area; and WHEREAS, the City Council has determined to include only those areas recommended by the California Director identified in Ordinance No. aS~3 within the Very High Fire Hazard Severity Zone and to exclude all remaining areas of the City of Anaheim east of the Costa Mesa Freeway (SR-55) and south of the Riverside Freeway (SR-91). NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that inclusion of certain areas recommended by the California Director within the Very High Fire Hazard Severity Zone is not necessary for effective protection within those areas for the following reasons: 1. The City Council, concurrently with the introduction of Ordinance No. 5523 establishing the Very High Fire Hazard Severity Zones in only a segment of the area recommended by the California Director, has adopted Ordinances: (a) Amending Appendix II-A of the Uniform Fire Code, 1991 Amendment requiring all areas of the city of Anaheim located east of the Costa Mesa Freeway (SR-55) and south of the Riverside Freeway (SR-91) (hereinafter "Special Protection Area") to comply with all of the provisions of Appendix II-A of the Uniform Fire Code, 1991 Edition. Appendix II-A will provide fire-protection measures to the Special Protection Area to control the spread of fire which might be caused by recreational, residential, commercial, industrial or other activities conducted in hazardous fire areas equal to the brush and vegetative clearance requirements of the Bates Bill. (b) Amending Sections 3201 and 3203 of the Uniform Building Code, 1991 Edition to require Class A roof coverings for all new construction or re-roofing of any existing building when Fifty Percent (50%) or more of the total roof area is re-roofed within any one-year period in the Special Protection Area. This Ordinance also requires non-combustible insulation in the installation of skylights, penthouses, solar-energy collectors, and light-transmitting plastics when installed with a Class A roof anywhere within the City of Anaheim. Adoption of this Ordinance provides the City of Anaheim additional fire-protection measures to structures within the wildland/urban intermix area of the City equal to those measures specified in the Bates Bill and other legislative requirements imposed upon areas within the Very High Fire Hazard Severity Zone.
