95-089 RESOLUTION NO. 95R-89
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING A LETTER OF UNDERSTANDING
BETVVEEN THE ANAHEIM FIREFIGHTERS ASSOCIATION
AND THE CITY OF ANAHEIM.
WHEREAS, the Human Resources Director met and conferred with officials and
employee representatives of the Anaheim Firefighters Association, amending Article 53 -'
Grievance Procedure of the current Memorandum of Understanding; and
WHEREAS, the Association is in agreement with the recommendation contained in said
Letter of Understanding; and
WHEREAS, as a result thereof, the Letter of Understanding dated May 22, 1995
between the parties has been prepared and signed; and
WHEREAS, the City Council of the City of Anaheim does find that it is in the best
interest of the City of Anaheim to approve said Letter of Understanding.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that
the Letter of Understanding dated May 22, 1995 between the Anaheim Firefighters Association
and the City of Anaheim, a copy of which is attached hereto and incorporated by reference
herein, is hereby approved.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the
City of Anaheim this 1 ~th day of June, 1995.

LE'I-FER Of UNDERSTANDING
between the
ANAHEIM FIREFIGHTERS ASSOCIATION, Local No. 2899
and the
CITY OF ANAHEIM
The Anaheim Firefighters Association (AFA) and the City of Anaheim, having met and
conferred, agree to revise Article 53.53 (Grievance Procedure - Third Step) of the
Memorandum of Understanding between the AFA and the City of Anaheim, to read as follows:
53.53 Third Step. If the grievance is not satisfactorily adjusted in the Second Step, it shall be
submitted to an impartial arbitrator for a final and binding decision, or if the Anaheim
City Manager and the employee and/or his designated representative agree, it shall be
submitted to the Anaheim City Manager for final and binding decision. Such
submission must occur within thirty (30) calendar days after the Fire Chief's answer is
received.
53.531 The parties (ANAHEIM and AFA) may mutually agree to submit a grievance to
non-binding mediation, prior to submission to arbitration. This language is not
intended to impede or delay the arbitration process.
53.532 If submitted to the Anaheim City Manager, the Anaheim City Manager or his
assistant shall meet with the employee and/or his designated representative
within ten (10) working days after submission of the grievance to him. The
Anaheim City Manager or his assistant may affirm, reverse, or modify as he
deems appropriate the disposition made at the Second Step.
53.533 The Anaheim City Manager or his assistant shall deliver his decision to the
employee and/or his representative within five (5) working days after said
meeting, and such decision shall be final and binding on both parties.
