A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM APPROVING
MEMBERSHIP IN THE ORANGE COUNTY 800
MHz COUNTYWIDE COORDINATED
COMMUNICATIONS SYSTEM JOINT POWERS
AUTHORITY AND APPOINTING THE CITY'S
REPRESENTATIVES TO THAT AUTHORITY
WHEREAS, the County of Orange (County) in accordance with
certain agreements between the City of Anaheim and certain other
cities (Cities) and the County, currently operates a coordinated
law enforcement/public works/fire radio communications system
(Existing System); and
WHEREAS, Anaheim, the Cities and the County have determined
that current law enforcement/public works/fire communications
requirements require immediate replacement of the Existing System
with an 800 Megahertz (MHz) coordinated law enforcement/public
works/fire radio communications system (the 800 MHz System); and
WHEREAS, the Anaheim, the cities and the County have jointly
and severally determined that the most appropriate and
expeditious method to finance, purchase, administer, maintain and
operate the 800 MHz System is through creation of a Joint Powers
Authority; and
WHEREAS, Anaheim is a public agency as defined in Government
Code Section 6500 and, pursuant to the provisions of Government
Code Section 6502 is authorized and empowered to contract for the
joint exercise of powers common to Anaheim and other public
agencies; and
WHEREAS, Anaheim wishes to exercise Anaheim's powers
jointly with the Cities and the County to finance, purchase,
administer, maintain, and operate the 800 MHz System and provide
for services related and incidental thereto through the
establishment of a Joint Powers Authority to be known as the
Orange County 800 MHz CCCS).
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim as follows:
1. That the City's membership in the Orange County 800 MHz
CCCS is hereby authorized and approved.
2. That the Joint Powers Agreement (Agreement) for the
Orange County 800 MHz System is hereby approved.
3. That the City Manager is authorized and directed, on
behalf of the City, to execute the Agreement with any changes
which are in substantial conformance with the Agreement and which
are approved by the City Attorney and to execute any related
documents necessary for the implementation of the Orange County
800 MHz System.
4. That the City Manager is hereby appointed as Anaheim's
Director and the Deputy City Manager is hereby appointed as
Anaheim's Alternate Director to represent Anaheim on the Board of
Directors of the Orange County 800 MHz CCCS.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 6th day of June 1995.
