AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING ORDINANCE NO. 5639 TO EXTEND THE
TERM OF THE FRANCHISE GRANTED TO MOBIL OIL
CORPORATION FOR THE RIGHT TO MAINTAIN AND OPERATE A
SYSTEM OF PIPELINES FOR THE TRANSPORTATION OF OIL,
GAS, AND OTHER SUBSTANCES IN AND ACROSS A PORTION OF
JEFFERSON STREET BETWEEN ATWOOD CHANNEL AND
ORANGETHORPE AVENUE IN THE CITY OF ANAHEIM
WHEREAS, on August 11, 1998, the City Council of the City of Anaheim (the
"City") did enact Ordinance No. 5639, which ordinance did award a franchise to Mobil
Oil Corporation, now doing business as ExxonMobil Oil Corporation (the "Grantee"),
Inc; and
WHEREAS, the general terms and condition of the franchise are for a term of ten
(10) years to construct, maintain, operate, repair, renew and remove a single pipeline, not
to exceed six inches in diameter for the transportation of oil, gas, water, waste water, mud
and other substances in Jefferson Street from the Atwood Channel to Orangethorpe
Avenue within the City (the "Franchise Agreement"); and
WHEREAS, the City wishes to amend and extend the Franchise Agreement
between the City and Grantee for another ten (10) years;
WHEREAS, Section 1401 of the Charter of the City of Anaheim requires that the
City Council pass a resolution declaring its intention to change the terms and conditions
upon which a franchise was granted and affixing a place, date and hour when and where
any person interested therein may object to the amending of the franchise.
NOW THEREFORE, the City Council of the City of Anaheim does ordain as
follows:
1. Section 1 of Ordinance 5639, is amended to change Grantee's name from
Mobil Oil Corporation to ExxonMobil Oil Corporation and extend the term thereof for
ten (10) years, which term shall become effective on the thirtieth (3W") day after the
passage of this ordinance.
2. Section 9 of Ordinance 5639, is amended to increase the amount of the
franchise fee to be paid to Five Hundred Fifty Dollars ($550.00).
THE FOREGOING ORDINANCE was introduced at a regular meeting of the
City Council of the City of Anaheim held on the lgtjjlay of Mtnber , 2008, and
thereafter passed and adopted at a regular meeting of said City Council held on the 28th
