95-064 RESOLUTION NO. 95R-64 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND DISTRIBUTION OF ELECTRICITY AS ADOPTED BY RESOLUTION NO. 71R-478 AND MOST RECENTLY AMENDED BY RESOLUTION NO. 93R-225 WHEREAS, the City of Anaheim maintains an electric generation and distribution system for the furnishing of electricity to residents and inhabitants of the City of Anaheim and has adopted Electric Rates, Rules and Regulations for the sale and distribution of electricity; and WHEREAS, a Notice of Hearing was published as follows: On March 27, 1995, notice of the public hearing on electric rates was published in the Orange County Register and proof thereof is on file with the Secretary of the Public Utilities Board. WHEREAS, the Public Utilities Board held a public hearing on April 6, 1995 and evidence was presented in connection with proposed revisions of Electric Rates, Rules and Regulations; and WHEREAS, the Public Utilities Board considered the proposal of the Public Utilities Department and has considered the evidence presented at the public hearing; and, WHEREAS, the Public Utilities Board has made the following findings with respect to the need for changes to the Electric Rates, Rules and Regulations: 1. Section 1221 of the City Charter provides that utility rates charged to a class of customers shall be uniform within the class and shall be based on cost of service revenue requirement for the class. 2. The proposed economic development rate will not require a rate subsidy from other classes of customers. 3. In determining rates, it is appropriate to give consideration to both cost of service and competitiveness with other utilities inside and outside California, including Southern California Edison, who have developed rates to retain and attract manufacturing operations. 4. It is appropriate to recognize that in order to maintain the economic health of Anaheim, creation and retention of good-paying manufacturing jobs and development of the Anaheim Canyon Industrial Area are imperative. 5. The Department and the City will benefit from attracting manufacturing customers who will provide incremental net revenues rather than not attracting these customers which could leave the Department with underutilized investments in generation, transmission, and distribution facilities and leave the City with fewer, good paying manufacturing jobs. 6. Manufacturing and industrial customers expected to expand or locate in the Anaheim Canyon Industrial Area are less likely to have seasonal variations in load requirements compared to retail and service establishments and are more likely to effectively use utility investment facilities, justifying a rate differential compared to the Large General Service class as a whole. 7. The Anaheim Canyon Industrial Area is one of Orange County's largest and most successful business centers. ~' It is one of the largest areas in Orange County with undeveloped land zoned for commercial and/or industrial use. Development of this area will create jobs, eliminate blight, and generate incremental revenues to the City's General Fund and to the Department. 8. The Northeast Area of Redevelopment Project Alpha is included in the Anaheim Canyon Industrial Area. This area has only thirteen years remaining as a redevelopment area; therefore, it is imperative that development occur in this area as expeditiously as possible within that time frame. Therefore, providing greater discounts than are proposed Citywide is reasonable and appropriate. 9. On the basis of the preceding findings, the proposed Schedule ED is reasonable and appropriate. 10. It is appropriate for the Utilities Department to recover from its customers the capital costs to relocate street lights installed within Underground Conversion Districts as well as to recover the cost of energy used by these lights. Therefore, it is appropriate to create a street and highway lighting schedule to serve street lighting in the Underground Conversion Districts. 11. On the basis of the preceding finding, the proposed changes to schedule LS-1 are reasonable and appropriate. WHEREAS, the Public Utilities Board considered the requirement of the California Environmental Quality Act (CEQA) and made the following findings: 1. The establishment of these rates as set forth above will ensure adequate revenues necessary to meet power supply costs, operation and maintenance expenses, capital expenditures, debt service requirements, reserve amounts, intracity transfers, and other necessary operating and maintenance expenses. 2. The matters covered above come within Section 21080(b) (8) of the Public Resources Code of the State of California. Section 21080 (b) (8) states that CEQA does not apply to the establishment, modification, structuring, restructuring, or approval of rates, tolls, fares, or other charges which the public agency finds are for the purpose of meeting operating expenses, materials, meeting financial reserves, obtaining funds for capital projects necessary to maintain service within existing service areas, or obtaining funds necessary to maintain those intracity transfers as are authorized by city charter. Thus, the establishment of these rates is exempt from CEQA. WHEREAS, based on the findings hereinabove made, the Public Utilities Board of the City of Anaheim recommended to the City Council that the Council adopt the findings of the Public Utilities Board with respect to the matters contained herein and adopt the electric rates as presented; and WHEREAS, based on findings made by the Public Utilities Board of the City of Anaheim recommended to the City Council that the Council, by Motion, certify that the adoption of the electric rates is statutorily exempt, under the California Environmental Quality Act, Public Resources Code, Section 21080(b) (8), in accordance with Title 14 of the California Administrative Code Section 15273(a). WHEREAS, the City Council has considered the evidence and concurs with the findings of the Public Utilities Board as set forth hereinabove. NOW, THEREFORE BE IT RESOLVED that: 1. The findings of the Public Utilities Board as set forth herein are hereby adopted by the City Council of the City of Anaheim. 2. The changes and additions to the Electric Rates, Rules and Regulations as shown in Attachment A are hereby adopted by the City Council of the city of Anaheim and will become effective May 15, 1995. 3. The Public Utilities General Manager is hereby authorized and directed to prepare, promulgate, publish, and implement changes to the Electric Rates, Rules and Regulations as set forth herein. Where the cuctomor requests the installation of other than the standard equipment and such requested equipment is acceptable to the City, the city will install the requested equipment provided the customer agrees to advance the estimated difference in cost installed between such equipment and standard equipment. Advances made for this purpose will not be refunded. Facilities installed in connection with such agreements become and remain the sole property of the City. A. Hours of Service: Approximately 4140 hours per year. B. Power Cost Adjustment: The rates above are subject to adjustment as provided for in Schedule PCA. The applicable power cost adjustment billing factor set forth therein will be applied to 20 kwh per month per 1000 lumens for incandescent Imaps, to 8 kwh per month per 1000 lumens for mercury vapor lamps and to 5 kwh per month per 1000 lumens for high pressure sodium vapor lamps. For customers locating in the Anaheim Canyon Industrial Area, as defined by the North East Area Sper-Jfic P~an, and signing development agreements with the Community Development Deparm~ent, the discount percentages specified above will be doubled. /f, during the Term of Agreement, any governmental agency, authority, court or private entity takes an action which materially impacts the City's ability to recover its cost under Schedule GS-2, less the appropriate Efficiency Range Discount, the City may renegofiate with the customer the rate for electric service set forth in this schedule. D. For existing customers adding 200 kW or more in new load, the discount applies only to the new load, which must be served under a separate service or, at the Department's option, submetered. The customer shall supply, at no expense to the Depar~nent, any metering equipment necessary as well as a location suitable to the Depar~nent for meters and associated equipment used for billing.
