A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM CONCERNING
INTERVENTION IN LITIGATION
CHALLENGING MEASURE A
WHEREAS, Measure A was enacted by the voters of Orange
County on November 8, 1994 and amended the Orange County General
Plan to establish the E1 Toro Airport Planning Area and commence
a process to plan for reuse of E1 Toro Marine Corps Air Station
as a civilian airport facility following the closure of that
facility for military purposes; and
WHEREAS, conversion of the E1 Toro Marine Corps Air
Station Facility to civilian airport use would provide a
substantial economic benefit to all of Orange County in resolving
its current financial crisis; and
WHEREAS, certain Orange County cities have publicly
announced their intention to file suit to challenge the validity
of Measure A; and
WHEREAS, it is in the interests of this City and the
entire County that the will of the voters be sustained and that
planning for the conversion of E1 Toro Marine Corps Air Station
to civilian airport use proceed expeditiously; and
WHEREAS, in order to protect the interests of the City
and the County in this regard it may become necessary to
participate in defending Measure A in any litigation brought
challenging Measure A; and
WHEREAS, passage of this Resolution does not authorize
any expenditure of City public funds for the cost of litigation
regarding Measure A, and such authorization, if proposed, would
be the subject of a separate resolution.
NOW, THEREFORE, BE IT RESOLVED:
(1) The City will actively consider participation in
any litigation challenging Measure A. Such
participation may occur immediately upon the
instigation of any litigation or motion which
action has the effect of challenging Measure A.
(2) The City Attorney is directed to coordinate with
other cities and parties who intend to participate
in defending Measure A from any legal challenge.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 18th day of
April , 1995.
