A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM AUTHORIZING THE
CITY MANAGER TO IMPLEMENT CERTAIN
INCREASES AND DECREASES IN THE
RATES CHARGED TO ANAHEIM CUSTOMERS
FOR SOLID WASTE COLLECTION AND
DISPOSAL
WHEREAS, the rates currently charged to Anaheim
customers for solid waste collection and disposal reflect the
fees charged by the County of Orange for use of the Orange County
Landfill facilities ("gate fees"); and
WHEREAS, it is anticipated that the County of Orange
will dramatically increase gate fees as a result of the County of
Orange bankruptcy filing; and
WHEREAS, it is necessary to pass on to Anaheim's
customers the anticipated increases in County of Orange gate fees
to prevent the rapid depletion of the City of Anaheim Sanitation
Fund ("Sanitation Fund"); and
WHEREAS, in order to prevent depletion of the
Sanitation Fund, it is necessary to act, immediately upon the
adoption of increases in gate fees, to incorporate such increases
in gate fees into the rates Anaheim charges its customers for
solid waste collection and disposal, without the delay occasioned
by bringing the matter before the City Council;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the City Manager is hereby authorized,
immediately upon the adoption of an increase or decrease in the
gate fees charged by the County of Orange, to adjust the rates
charged to Anaheim customers for solid waste collection and
disposal; such adjustment(s) shall be sufficient to offset the
increase or decrease in the gate fees and prevent any net loss to
the Sanitation Fund, and shall become effective immediately upon
approval by the City Manager.
BE IT FURTHER RESOLVED that the City Manager is
directed to report to the city Council any and all such
adjustments promptly after their implementation.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 4th day of
