95-007 RESOLUTION NO. 95R - 7
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM CONSENTING TO THE ASSIGNMENT OF A
FRANCHISE FOR OIL PIPELINES (SABA PETROLEUM)
WHEREAS, the City of Anaheim did, by Ordinance No.
2854, grant a franchise (hereinafter the Franchise) to Texaco,
Inc. for the purpose of installing and maintaining certain pipe-
lines for the transportation of oil, gas and other liquids in the
public streets of Anaheim; and
WHEREAS, Texaco, Inc., did install certain pipelines in
the public streets of Anaheim for the purpose of transportation
of oil, gas and other liquids pursuant to said Franchise; and
WHEREAS, said Franchise was granted in 1970 for a
period of forty years; and
WHEREAS, Texaco, Inc. has sold its oil production
facilities, including the pipelines in the streets of the City of
Anaheim to Saba Petroleum, Inc.; and
WHEREAS, Texaco, Inc. and Saba Petroleum has requested
the city of Anaheim to consent to the assignment of the F3~anchise
from Texaco, Inc. to Saba Petroleum, Inc.; and
WHEREAS, Section 1403 of the Charter of the city of
Anaheim permits the transfer or assignment of a franchise with
the written consent of the City Council upon the transferee's
agreement to be bound by each and all of the terms of the grant
and the provisions of the Charter of the City of Anaheim
pertaining to franchises.
NOW, THEREFORE, BE IT RESOLVED THAT the City Council
does hereby consent to the assignment of the Franchise from
Texaco, Inc. to Saba Petroleum, Inc. provided that Saba
Petroleum, Inc. shall, within thirty (30) days of the date of
this Resolution file with the City Clerk a written agreement to
be bound by each and all of the terms of the Franchise and the
provisions of the Charter of the City of Anaheim pertaining to
franchises.
