A RESOLUTION OF THE CITY OF ANAHEIM, CALIFORNIA
RECITING THE FACT OF THE GENERAL MUNICIPAL
ELECTION HELD ON NOVEMBER 7, 2000, DECLARING THE
RESULT AND SUCH OTHER MATTERS AS PROVIDED BY
LAW.
WHEREAS:
a General Municipal Election was held and conducted in the City of
Anaheim on Tuesday, November 7, 2000, as required by the City Charter;
and
WHEREAS:
notice of the election was given in time, form and manner as provided by
law; that voting precincts were properly established; that election officers
were appointed and that in all respects the election was held and conducted
and the votes were cast, received and canvassed and the returns made and
declared in time, form and manner as required by the provisions of the
Elections Code of the State of California for the holding of elections in
charter cities; and
WHEREAS:
the Registrar of Voters of the County of Orange canvassed the returns of
the election and has certified the results to this City Council, the results are
received, attached and made a part hereof as "Exhibit A'.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1: That the whole number of votes cast in the precincts except absent voter
ballots and provisional ballots was 61,504.
That the whole number of absent voter ballots cast in the City was 18,256,
the whole number of provisional ballots was 0, making a total of 79,760
votes cast in the City.
SECTION 2: That the names of persons voted for at the election for Member of the City
Council are as follows:
Shirley McCracken
Tom Tait
Ron Chandler (Write in candidate)
Femando Gutierrz (Write in candidate)
SECTION 3.
The City Council does declare and determine that:
Shirley McCracken was elected as Member of the City Council of the City
of Anaheim for the full term of four years;
Tom Tait was elected as Member of the City Council of the City of
Anaheim for the full term of four years.
SECTION 4: That the Measure voted upon at the Election is as follows: (Measure I)
TECHNICAL AMENDMENTS. Shall specified sections of the
City Charter be amended to delete redundant and obsolete
language, to conform to provisions of state law, and to change all
gender references to include both the male and female genders?
YES NO
SECTION 5:
That as a result of the election, a majority of the voters voting on Measure
I did vote in favor of it and that the Measure was carried and shall be
forwarded to the Secretary of State for inclusion in the City of Anaheim
Charter.
That the Measure voted upon at the Election is as follows: (Measure J)
QUALIFICATIONS FOR ELECTIVE OFFICE. Shall Section
:501 of the City Charter be amended to prohibit city employees
from holding office as Mayor or City Council member?
YES NO
SECTION 6:
That as a result of the election, a majority of the voters voting on Measure
J did vote in favor of it and that the Measure was carried and shall be
forwarded to the Secretary of State for inclusion in the City of Anaheim
Charter.
That the Measure voted upon at the Election is as follows: (Measure K)
SPECIAL PROSECUTORS. Shall Section 703 of the City
Charter be amended to provide that all criminal prosecutions shall
be conducted by the City Attorney or other public agency and
prohibit the City Council from contracting with any person to act
as a special prosecutor in criminal cases?
YES NO
That as a result of the election, a majority of the voters voting on Measure
K did vote in favor of it and that the Measure was carded and shall be
forwarded to the Secretary of State for inclusion in the City of Anaheim
Charter.
SECTION 7: That the Measure voted upon at the Election is as follows: (Measure L)
CUT FUNDS AND EXPENDITURES. Shall Sections 705 and
706 of the City Charter be amended to require the City Treasurer
to have custody of all City funds and the Finance Director to have
control of all City expenditures, except where otherwise
authorized by resolution of the City Council, and to expressly
authorize the Finance Director to prepare or approve wire
transfers, electronic payments and facsimile signature checks for
City expenditures?
YES NO
That as a result of the election, a majority of the voters voting on Measure
L did vote in favor of it and that the Measure was carried and shall be
forwarded to the Secretary of State for inclusion in the City of Anaheim
Charter.
SECTION 8: That the Measure voted upon at the Election is as follows: (Measure M)
UTILITY RATES. Shall Section 1221 ofthe City Charter be
amended to permit the City Council to consider market prices and
other relevant marketplace factors when setting utility rates?
YES NO
That as a result of the election, a majority of the voters voting on Measure
M did vote against it and that the Measure was defeated.
SECTION 9:
That the number of votes given at each precinct and the number of votes
given in the City to each of the persons above named for the respective
offices for which the persons were candidates, and for and against the
measures, were as listed in Exhibit A attached.

The City Clerk shall enter on the records of the City Council of the City, a
statement of the result of the election, showing (1) the whole number of
ballots cast in the City; (2) the names of the persons voted for; (3) the
measures voted upon; (4) for what office each person was voted for; (5)
the number of votes given at each precinct to each person, and for and
against each measure; (6) the total number of votes given to each person,
and for and against each measure.
That the City Clerk shall immediately make and deliver to each of the
persons so elected a Certificate of Election signed by the City Clerk and
authenticated; that the City Clerk shall also administer to each person
elected the Oath of Office prescribed in the Constitution of the State of
California and shall have them subscribe to it and file it in the Office of
the City Clerk. Each and all of the persons so elected shall then be
inducted into the respective office to which they have been elected.
That the City Clerk shall certify to the passage of and adoption of this
resolution and enter it into the book of original resolutions.
