AN ORDINANCE OF THE CITY OF ANAHEIM
AMENDING THE ZONING MAP REFERRED TO IN
TITLE 18 OF THE ANAHEIM MUNICIPAL CODE
RELATING TO ZONING (RECLASSIFICATION NO.
2008-00215).
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT:
WHEREAS, following a duly noticed public hearing held on October 27, 2008,
pursuant to the provisions of Chapter 18.60 of the Anaheim Municipal Code, the Anaheim
Planning Commission did adopt its Resolution No. PC2008-106 determining that a change or
changes in the zone or zones hereinafter mentioned and described should be made to reclassify
the subject property, as described below, into the RS -3 (SC) (Single -Family Residential — Scenic
Corridor Overlay) Zone; and
WHEREAS, within a period of forty (40) days following said hearing, the
Planning Commission did duly adopt a resolution containing a report of its findings, a summary
of the evidence presented at said hearing and granted the proposed amendment; and
WHEREAS, within the time prescribed by law, an interested party or parties did
appeal said Planning Commission decision to the Anaheim City Council, asking the City Council
to reconsider said reclassification requested by applicant; and
WHEREAS, thereafter, the City Council did set said application for such project
for a de novo hearing, which public hearing was duly noticed in the manner provided by law; and
WHEREAS, on January 13, 2009 the City Council held a duly noticed public
hearing and, as a result thereof, did adopt its Resolution No. 2009-012 declaring its intent that
changes in the zones hereinafter mentioned and described should be made to reclassify the
subject property, as described below, into the RS -3 (SC) (Single -Family Residential — Scenic
Corridor Overlay) Zone; and
WHEREAS, the owner of the subject property has requested that the City finalize
reclassification of the subject property from the T (SC) (Transition — Scenic Corridor Overlay)
Zone to the RS -3 (SC) (Single -Family Residential — Scenic Corridor Overlay) Zone; and
WHEREAS, certain terms and conditions were made as conditions precedent to
the making of a change or changes of said zone or zones, which conditions have now been met.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM
DOES ORDAIN AS FOLLOWS:
SECTION 1.
That the Zoning Map referred to in Title 18 of the Anaheim Municipal Code be,
and the same is hereby, amended by rezoning and reclassifying that certain real property situated
at 7260 Canyon Rim Road in the City of Anaheim, County of Orange, State of California, as
more particularly described in Exhibit "A" attached hereto and incorporated herein by this
reference, into the RS -3 (SC) (Single -Family Residential — Scenic Corridor Overlay) Zone.
SECTION 2.
The City Zoning Map shall be, and the same is hereby, amended and the above-
described property shall be excluded from the zone in which it is now situated and incorporated
in and made a part of the zone or zones as above set forth, and said City Zoning Map, as
amended, is hereby adopted and the Planning Department is hereby directed to prepare a
sectional zoning map to be added to the City Zoning Map showing the changes hereby approved
and adopted.
SECTION 3. CERTIFICATION
The City Clerk shall certify to the passage of this ordinance and shall cause the
same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a
newspaper of general circulation, published and circulated in said City, and thirty (30) days from
and after its final passage, it shall take effect and be in full force.
THE FOREGOING ORDINANCE was introduced at a regular meeting of the
City Council of the City of Anaheim held on the 136 day of January, 2009, and thereafter passed
and adopted at a regular meeting of said City Council held on the 27th day of January, 2009, by
the following roll call vote:
