2000-260RESOLUTION NO. 2000R-260 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM CONSENTING TO THE EXPENDITURE OF FUNDS BY THE ANAHEIM REDEVELOPMENT AGENCY IN CONNECTION WITH THE PROVISION OF PUBLIC IMPROVEMENTS BY THE CITY OF ANAHEIM AND MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH WHEREAS, the Anaheim Redevelopment Agency (the "Agency") is a public body, corporate and politic, formed by Resolution No. 6966 of the City of Anaheim (the "City") adopted by the City Council of the City on June 6, 1961, and exercising its powers pursuant to the California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.); and WHEREAS, on July 19, 1973, the City Council of the City adopted a redevelopment plan for the Redevelopment Project Alpha by Ordinance No. 3190, (which plan was subsequently amended on July 20, 1976 by Ordinance No. 3567, on November 30, 1976 by Ordinance No. 3631, on January 12, 1982 by Ordinance No. 4300, and on December 13, 1994 by Ordinance No. 5468); and WHEREAS, the Agency has been, and continues to be, engaged in activities necessary to carry out and implement the redevelopment plan (the "Redevelopment Plan") for Redevelopment Project Alpha (the "Redevelopment Project"); and WHEREAS, in order to carry out and implement the Redevelopment Plan, the Agency is undertaking certain activities necessary for redevelopment of the Redevelopment Project Area in accordance with provisions of the California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.); and WHEREAS, the City is prepared to award a bid for the construction and installation of public improvements related to the development of George Washington Park (the "Park Improvements"); and WHEREAS, the Agency is authorized, pursuant to Section 33445 of the Community Redevelopment Law, to pay for all or part of the land for and the cost of the installation of any public facility or improvement either within or without a particular project area with the consent of the City Council and upon a determination that (i) the facilities or improvements are of benefit to the Project Area or the immediate neighborhood in which the project is located, (ii) that no other reasonable means of financing such facilities and improvements are available to the community, and (iii) that the payment of funds for the costs of such facilities or improvements will assist in the alleviation of one or more blighting conditions inside the project area and is consistent with the implementation plan adopted pursuant to Section 33490 of the Community Redevelopment Law; and WHEREAS, the City and the Agency have similar public purposes for the construction of the Park Improvements; and WHEREAS, in furtherance of the public purposes of the Agency and the City, the Agency desires to fund a portion of the City's cost of constructing and installing the Park Improvements; and WHEREAS, the report prepared by Agency staffindicates that (i) the installation of the Park Improvements will be of benefit to the Project Area and the neighborhood surrounding George Washington Park, (ii) there exist no reasonable means available to the City to fund the entire cost of the Park Improvements, (iii) the installation of the Park Improvements is provided for in the Redevelopment Plan for the Project Area, and (iv) the installation of the Park Improvements will assist in the elimination of blighting conditions inside the Project Area, and is consistent with the Implementation Plan for the Redevelopment Project; and WHEREAS, the Agency and the City have duly considered all terms and conditions related to the construction and installation o£the Park Improvements and believe that the installation of the Park Improvements is in the best interests of the City of Anaheim and the health, safety, and welfare of its residents, and in accord with the public purposes and provisions of applicable state and local laws and requirements. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES HEREBY RESOLVE AS FOLLOWS: Section 1. (a) (b) (c) Findings. The City Council hereby finds and determines that: the construction and installation of the Park Improvements are of benefit to the Redevelopment Project Area and the neighborhood surrounding George Washington Park; there are no reasonable means of financing the Park Improvements available to the community other than to have the Agency assist in such financing; the Agency's provision of financial assistance for the construction and installation of the Park Improvements will assist in the elimination of blighting conditions in the Redevelopment Project Area and is consistent with the Implementation Plan for the Redevelopment Project. Section 2. Consent to the Provision of Financial Assistance. The City Council consents to the Agency's expenditure of up to Four Hundred Fifty Thousand Dollars ($450,000) with respect to the construction and installation of the Park Improvements. 2 THE FOREGOING RESOLUTION IS PASSED, APPROVED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM THIS 19 ( ch ) DAY OF December ., 2000.
