FOLLOWS: <br />ORDINANCE NO. 5106 <br />AN ORDINANCE OF THE CITY COUNCIL <br />OF THE CITY OF ANAHEIM AMENDING <br />SECTION 17.06.030 OF CHAPTER 17.06 <br />OF TITLE 17 OF THE ANAHEIM MUNICIPAL <br />CODE RELATING TO GRADING <br />THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS <br />SECTION 1. <br />That Section 17.06.030 of Chapter 17.06 of Title 17 of <br />the Anaheim Municipal Code be, and the same is hereby, amended to <br />read as follows: <br />"17.06.030 PURPOSE OF CHAPTER <br />.010 Unregulated Excavation. The <br />unregulated excavation and filling of property, in the <br />course of the physical development of the City, could <br />cause extensive damage to public and private property and <br />result in numerous hazardous conditions. The purpose of <br />this chapter is to require that excavations and fills be <br />performed in accordance with good engineering practice, <br />thereby reducing to a minimum the present and future <br />hazards and damage to public and private property from <br />such work, and to allow for proper maintenance of such <br />slopes. <br />.020 Transitional Areas. Transitional <br />areas may be required between existing developed areas <br />and areas that require grading. The scope and extent of <br />the transitional area required will be determined by <br />individual review by the City Engineer as prescribed <br />under council policy of the City of Anaheim. <br />.030 Contour grading shall be encouraged; <br />the extent and amount of such grading shall be determined <br />by individual review by the City Engineer as prescribed <br />under council policy of the City of Anaheim." <br />SECTION 2. SEVERABILITY <br />The City Council of the City of Anaheim hereby declares <br />that should any section, paragraph, sentence or word of this <br />ordinance of the Code, hereby adopted, be declared for any reason <br />to be invalid, it is the intent of the Council that it would have <br />passed all other portions of this ordinance independent of the <br />elimination herefrom of any such portion as may be declared <br />invalid. <br />
