4106ORDINANCE NO. 4106 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 78R-648 ' determining that a change or changes in the zone or zones ereinafter mentioned and described should he made as hereinafter set forth after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS# said Resolution did impose certain conditions and requirements precedent to the adoption of an ordinance chang- ing said zone or zones, which conditions and requirements have been satisfied. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: A portion of Lots 25 and 26 of Tract No. 117, Amended Map of Vista Del Rio Rancho recorded in Book 11, Page 15 of Miscellaneous Maps, records of Orange County, California and Lot "A" Tract No. 7732 recorded in Map Book 361, Pages 16 through 19, records of Orange County, California, described as follows: Beginning at the most westerly corner of Lot "A" per tract No. 7732 recorded in Map Book 361, pages 16 through 19, of said Orange County; thence North 600 38' 42" East 460.49 feet along the southeasterly line of the California State Highway Right -of -Way, described in Deed to the State of California recorded September 6, 1951, in Book 2227 Page 96 of Official Records; thence South A90 O1' 14" East, 22.55 feet; thence South 00" 48' 58" East 45.00 feet; thence North 890 Oil 14" West 60.00 feet; -1- ATTY-50 77-78-46 thence South 000 48' 58" East 121.00 feet; thence South 890 Ol' 14" East 60.00 feet. thence South 000 48' 58" East 107.54 feet to a point on the norther- ly line of the Santa Ana Valley Irrigation Company's Canal and the southerly line of Lot 26 as shown on said Tract No. 117; thence North 690 33' 02" East along said Santa Ana Valley Irrigation Company Canal 101.58 feet to a point in the southwesterly Right -of -Way line of Parcel 4 (Rel -821) of the Highway Right -of -Way relinquished to the County of Orange by Resolution by the California Highway Commission, a certified copy of said Resolution is recorded in Book 9989, Page 623 of said Official Records and as shown on Map recorded in Book B. Page 17 of State Highway Maps in said office; thence South 520 32' 30" East 19.71 feet; thence continuing along said Right -of -Way line the following courses,. South 370 27' 30" West 597.69 feet to the beginning of a curve concave southeasterly having a radius of 3050 -00 -feet; thence southwesterly along said curve through a central angle of 040 25' 46" an are distance of 235.79 feet; thence continuing along said said Right -of -Way North 620 11' 46" West 54.29 feet to a point on the northeasterly boundary of Tract No. 7733, recorded in Map Book 374, Pages 12- 15 of said Orange County; thence along said tract boundary through the following courses, North 100 13' 16" East 151.17 feet, North 000 57' 25" East 80.14 feet North 020 14' 38" West 64.20 feet, North 150 44t 26" West 92.49 feet to a point in the southeasterly boundary of Tract No. 7732 as recorded in a Map Book 361, Page 16-19 of said Orange County; thence along said tract boundary through the follow- ing courses, North 150 44' 26" West 61.74 feet, North 600 38' 00" East 95.96 feet, North 000 57' 25" East 74.14 feet to a point on the northwesterly Right -of - Way line of Camino Tampico as shown on said Tract No. 7732; thence along said Right -of -Way South 600 38' 00" West 1.26 feet, to the most Southerly corner of said Lot "A"; thence North 290 22' 00" West 119.58 feet along the southwesterly line of said Lot "A" to the point of beginning. now is "RS -A-43,000 (SC)" RESIDENTIAL/AGRICULTURAL, SCENIC CORRIDOR OVERLAY and COUNTY A-1 GENERAL AGRICULTURAL DISTRICT ZONES, and that it be changed to and incoroprated in "RS -7200 (SC)" RESIDENTIAL SINGLE-FAMILY, SCENIC CORRIDOR OVERLAY ZONE, subject to the followin conditions: 1. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. -2- 2. That subject property shall be served by underground utilities. 3. That the owner of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 4. That all structures constructed on subject property shall comply with the requirements of the City of Anaheim Fire Zone No. 4, as approved by the Fire Department. 5. That the developers of subject property shall provide an adequate. on-site vehicular turn -around area for lot Nos. -12 through 15, as approved by the City Traffic Engineer. 6. That the developers of subject property shall pay the traffic signal assessment fee (Council Policy No. 214) amounting to $36.00 per each new dwelling unit prior to the issuance of a building permit. 7. That Condition Nos. 1, 2, 32 49 5 and 6, above- mentioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby,. amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended,.is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the .same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it .shall take effect and be in full force.
