AHA-2020/04/21 ANAHEIM HOUSING AUTHORITY REGULAR MEETING OF APRIL 21, 2020 The Anaheim Housing Authority regular meeting was called to order at 6:18 P.M. telephonically, pursuant to Governor Newsom's Executive Order N-29-20 (superseding the Brown Act related provisions of Executive Order N-25-20) in response to COVID-19, for a joint public comment session with the Anaheim City Council. The meeting notice, agenda, and related materials were duly posted on April 16, 2020. PRESENT: Chairman Harry Sidhu and Authority Members Stephen Faessel, Denise Barnes, Jordan Brandman, Jose F. Moreno, Lucille Kring, and Trevor O'Neil (all via teleconference). ABSENT: Authority Member Denise Barnes STAFF PRESENT: City Manager Chris Zapata, City Attorney Robert Fabela, and Secretary Theresa Bass ADDITIONS/DELETIONS TO THE AGENDA: None PUBLIC COMMENTS: One electronically submitted public comment was received related to Housing Authority Agenda Item No. 1. — See Appendix. CONSENT CALENDAR: At 6:20 P.M., the consent calendar was considered, with Authority Member Moreno pulling Item No. 01 for separate discussion. MOTION: Authority Member Kring moved to approve the remainder of the consent calendar as presented, seconded by Authority Member Faessel. Approve minutes of the Housing Authority meetings of February 4, 2020, February 11, 2020, and March 24, 2020. END OF CONSENT CALENDAR 1. Approve an Exclusive Negotiation Agreement (ENA), in substantial form, with Greenlaw AGR- Development, LLC for a future development of approximately 7.3 acres at the southeast 12036 corner of Beach Boulevard and Lincoln Avenue for a term expiring on February 1, 2021 with an optional six-month extension; approve the Option Agreement and Escrow Instructions, in substantial form, in the acquisition amount of $4,750,000, for the purchase of an approximately 1.73 acre property located at 2952 and 2960 W. Lincoln Avenue should a definitive agreement not be reached during the term of the ENA; and authorize the Executive Director of the Housing Authority, or designee, to execute and administer the Agreements. Anaheim Housing Authority Minutes of April 21, 2020 Page 2 of 4 John Woodhead, Community & Economic Development Director, explained the Anaheim Housing Authority owns approximately 5 1/2 acres of land at the southeast corner of Beach Boulevard and Lincoln Avenue, comprised of five parcels housing the Americana Motel, former Americana car wash, Mobil gas station, and Old Mexico Restaurant which were acquired in December 2019, along with a vacant parcel north of the West Anaheim Youth Center acquired by the former Redevelopment Agency in 2001. He continued that Greenlaw Development, LLC in under contract to purchase approximately 1 3/4 acres at 2960 West Lincoln Avenue from the Stephen K. Doi Trust which is immediately east of the Authority property. Greenlaw and the Authority are proposing to combine properties for a larger, mixed-use, mixed-income development. Mr. Woodhead explained the combined site is strategically located and primed for development. The Beach Boulevard Specific Plan classifies the combined site in the "Mixed-Use High" development area which prescribes a quality mixed-use project with a collection of residential product types and commercial uses. In addition to contributing to the revitalized vision of the Specific Plan, the Authority acquired the Authority Property due to its location in a Transit Priority Area, as designated by the Southern California Association of Governments (SCAG). The half-mile area surrounding the intersection of Beach Boulevard and Lincoln Avenue is defined as a Transit Priority Area because it is the intersection of two or more major bus routes with a frequency of service interval of 15 minutes or less during the morning and afternoon peak commute periods. Mr. Woodhead continued that development of housing within Transit Priority Areas aligns with SCAG's Sustainable Communities Strategy and qualifies the combined site for State affordable housing and infrastructure grants. He noted staff is assessing two grants administered by the State's Department of Housing and Community Development (HCD) —Affordable Housing Sustainable Communities Grant and the Infill Infrastructure Grant. The grants can be dovetailed with one another to provide funds for both production of affordable housing and off-site improvements to benefit the broader community, including infrastructure upgrades, transportation improvements, and enhancement of open space. Anaheim has not been successful in prior funding rounds due to the location of Authority sites outside of Transit Priority Areas. The Authority is strategically assessing all its current and potential future sites for proximity to High Quality Transit Areas in order to leverage the broadest set of funding streams available and create a pipeline for subsequent funding allocation cycles of grants and tax credits. Mr. Woodhead explained the proposed ENA sets out to determine the scope of development (including the mix of for-rent and for-sale residential units, density of units per acre within maximum of what is allowed, affordability levels, off-site improvements, commercial square footage, and open space designs) and economic feasibility of developing the combined site with a quality mixed-use, mixed-income project. The proposed ENA provides a period of nine months to negotiate a definitive agreement for the combined site, including project scope, purchase or lease price to be paid for the Authority Property, project schedule, and terms of an Affordable Housing Agreement. The ENA allows for a six-month extension of the term. The definitive agreement will be presented to the Governing Board of the Housing Authority for consideration at a later date should a project move forward on the combined site. Mr. Woodhead clarified that should the Authority and Greenlaw not reach a definitive agreement during the ENA term, the Authority would exercise its option to acquire the Doi Property to maximize development options on the combined site. The proposed option agreement provides Anaheim Housing Authority Minutes of April 21, 2020 Page 3 of 4 that the Authority would acquire the Doi Property at Greenlaw's acquisition price of$4,750,000, which is in the range of fair market value established by the Housing Authority's MAI appraiser. Mr. Woodhead concluded that staff determined that the agreements do not constitute a project under the provisions of CEQA. DISCUSSION: Authority Member Faessel addressed delays with 39 Commons due to the current pandemic but that the developer plans to move forward as soon as possible. He believed having housing on both sides of Lincoln Avenue would add to the success of commercial businesses. He supported the ENA and questioned whether it would increase the possibility of a more robust affordable housing component. Mr. Woodhead responded that adding the Doi property to the Authority property substantially increased the acreage and viability of the site, allows an increase in density in accordance with the Specific Plan, and makes the provision of affordable housing greater, noting the grants being sought have a minimum requirement of 30 units per acres. DISCUSSION: Authority Member Moreno questioned how affordable housing could be assured, to which Mr. Woodhead explained the nature of the property being owned by the Housing Authority required an affordable housing component but the exact determination of the number of units and level of affordability had not yet been determined and would be part of the economic assessment of the land and the negotiation process. Regarding community amenities, Mr. Woodhead explained all affordable housing developments have onsite amenities which they make available to the greater community to the extent they are able and where feasible, further noting the possible grants look to enhance benefits such as transit, open space, and parks. In response to Authority Member Moreno's question regarding number of units, Mr. Woodhead explained the density would be between the minimum 30 units per acre requirement of the grants and the maximum 60 units per acre allowed under the General Plan. Mr. Woodhead further noted the project would look to have a mix of affordability between rental and for-sale units. Mr. Woodhead continued that the item under consideration was not to sell Authority property but to enter into an ENA with Greenlaw, with an option to purchase the Doi property if negotiations under the ENA were not successful. Authority Member Moreno encouraged staff to maximize affordability across all economic levels during the negotiations. Chairman Sidhu acknowledged this project as a continuation of the 39 Commons project to provide housing to support the new retail and commercial components in west Anaheim. Authority Member Kring believed this will be a wonderful project and offered her support. Authority Member Moreno expressed his gratitude to staff, prior Councils, and Authority Member Barnes for accelerating the projects in west Anaheim.
