64-700~SOLUTION NO. 64R-700 A tlESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A SEALED PROPOSAL AND AWARDING A CONrfP, ACT TO THE LOWEST RESPONSIBLE BIDDER FOR THE FURNISHING OF DETAILED PLANS, DRAWINGS, CALCULATIONS AND SPECIFICATIONS AND ALL PLANT, LABOR, SERVICES, P~ATERIALS AND mQUIPMENT AND ALL UTILITIES AND TRANSPORTATION, INCLUDING POWER, FUEL AND WATER, AND PERFORMING ALL WORK NECESSARY FOR TH~ FURNISHING, ERECTION AND COMPLETION OF THE FOLLOWING PUBLIC IMPROVE- I~iNT: A PREFABRICATED STEEL BUILDING IN THE CITY PARKWAY b'i~INTENANCE YARD AT 1426 EAST VERMONT AVENUE, iN T~ CITY OF ANAHEIM, JOB NO. 899. ~i~HEt~AS~ the City Council of the City of Anaheim did cause to ~be published in a newspaper of general circulation, printed, published and circulated in the City of Anaheim, to wit: The Anaheim Bulletin, on the 10th and 17th days of September~ 1964, a notice inviting sealed proposals for furnish- ing the following: Detailed plans, drawings, calculations and specifications in accordance with and conforming in general to prelimin- ary plans and specifications prepared by the Public Works Department of the City of Anaheim and on file in the Office of the City Engineer for the erection of a pre- fabricated steel building with reinforced concrete foundation and floor; and all plant, labor, services, materials and equipment, and all utilities and trans- portation, including power, fuel and water, and perform- ing all work necessary to furnish, erect and complete, in a good and workmanlike manner, in strict accordance with the detailed plans and specifications to be sub- mitted by the biddez~ and conforming in general to preliminary plans and specifications on file in the Office of the City Engineer~ a prefabricated steel building with ~_~einforced concrete foundation and floor in the City Parkway Maintenance Yard at 1426 East Vermont Avenue, in the City of Anaheim, Job No. 899. The cost of preparing the detailed design, drawings, plans, specifications and calculations shall be included in the lump sum bid. AND ~iTi~I~AS, said notice inviting sealed proposals for said public improvement did provide that sealed proposals would be received by the City of Anaheim at the Office of the City Clerk of the City of Anaheim up to the hour of 2:00 o'clock P.M. on the 24th day of September, 1964, for the furnishing of detailed plans, drawings, calculations and speci- fications in accordance with and conforming in general to pre- liminary plans and specifications prepared by the Department of Public Works and on file in the Office of the City Engineer; and all plant ~ labor ~ services ~ materials, and equipment ~ -1- all utilities and transportation, including power, fuel and water, and performing all work necessary to furnish, erect and complete in a good and workmanlike manner, the public improvement hereinabove more particularly mentioned and described, and which notice did state and declare that pursuant to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim had ascertained the prevailing rate of wages in the locality in which this type of labor is to be performed for each craft or type of workman or mechanic needed to execute the contract, and which wage scale is on file in the Offices of the City Clerk and City Engineer. WHEREAS, the City Clerk of the City of Anaheim did receive the following sealed proposals prior to 2:00 o'clock P.M. on the 24th day of September, 1964, in response to the notice aforesaid inviting sealed proposals, to wit: TOTAL PRICE DUDLEY STEEL CORPORATION $12,341.00 ROBERT E. GEE 12,929.00 PENTA CONSTRUCTION SYSTEM, INC. 13,646.00 G. W. ANDERSEN CONSTRUCTION CO. ALL STATES STEEL BUILDINGS INC. 14,985.00 17,750.00 AND WHEREAS, the City Engineer did thereupon examine and tabulate said sealed proposals and did report to the City Council the result of his examination and tabulation; and WHEREAS, the City Council finds that the sealed proposal submitted by DUDLEY STEEL CORPORATION, 14001 South Garfield Boulevard, Paramount, California, is the lowest responsible proposal submitted for the furnishing of detailed plans and specifications and all plant,labor, services, materials and equipment, all utilities and transportation, in- cluding power~ fuel and water and performing all work necessary to furnish, erect and complete in a good and workmanlike manner, the public improvement hereinabove mentioned and described, together with the appurtenances thereto, as specified in the no~tice inviting sealed proposals, and that said proposal of said above-named bidder should be accepted and a contract awarded to said bidder in accordance therewith; and W,~EP~AS, the City Council finds that the above- mentioned sealed proposal is the lowest responsible proposal received and that the person, firm or corporation submitting said proposal is a responsible person, firm or corporation and that the proposal submitted is the best suited and fitted for the public improvement to be constructed. NOW, THEREFORE, BE IT P~SOLVED by the City Council of the City of Anaheim, that the sealed proposal submitted by DUDLEY STEEL CORPORATION for the furnishing of all plant, labor, services, materials and equipment~ all utilities and transpor- tation, including powers fuel and water~ and performing all -2- work necessary to furnish, erect and complete in a good and workmanlike manner, in strict accordance with the specifica- tions, plans and drawings therefor submitted to the City and approved by the Department of Public Works, and the notice inviting sealed proposals, the public works and improvement hereinabove more particularly mentioned and described, together with the appurtenances thereto, be, and the same is hereby, accepted, and that a contract for the furnishing, erection and completion of said public improvement be, and the same is hereby~ awarded to the said above-named bidder. JuND BE IT FURTHER RESOLVED that the successful bidder be, and it is hereby required to execute a contract in the required form with. the City of Anaheim upon the terms and conditions specified in the notice inviting sealed pro- posals and the proposal submitted by said successful bidder and in accordance with the plans and specifications for said public improvement hereinabove described, and in accordance with the terms, conditions and provisions of this resolution, and that said successful bidder shall be required to furnish a surety bond in an amount equal to one hundred per cent (100%) of the contract price for all labor, materials and equipment to be furnished and performed, as set forth in the sealed proposal submitted by said bidder for the construction of said public improvement, together with the appurtenances thereto, as security for the faithful performance of said contract and a separate surety bond in an amount eq~ual to one hundred per cent (100%) of the construction cost os said public improvement covered by said contract, as security for the pay- ment of all persons performing labor and furnishing material for said project. AND BE IT FURTHER RESOLVED that said successful bidder be, and it is hereby required to furnish to the City of Anaheim in companies satisfactory to the City of Anaheim, public liability, property damage, compensation, and other insurance in the amounts and for the purposes as set forth and specified in the notice inviting sealed proposals, and subject to the approval of the City Attorney as to form and sufficiency. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk of the City of Anaheim be, and they are hereby, authorized and directed to make, execute and enter into, for and on behalf of the City of Anaheim, a written contract with said successful bidder for the furnishing of all plant, labor, materials, and equipment and performing all work, as herein- above more particularly described, for the furnishing, erection and completion of said public improvement hereinabove described upon the terms and conditions as specified in the notice in- viting sealed proposals and in accordance with the detailed plans and specifications submitted by the bidder and conforming in general to the preliminary plans and specifications prepared by the Department of Public Works, and all addenda · thereto, and all modifications incorporated therein prior to the date of the opening of bids, on file in the Office of the City Clerk of The City of Anaheim and in strict accordance with the terms, conditions, and provisions of this resolution, and in accordance with all of the contract documents herein specified. -3- ATTEST THE FOREGOING RESOLUTION is approved and signed by me this _~_igi% day of September ~ 19. 6. 4 . o OR ~ ,ITY CLERK OF THE C]~TY OF ANAHEIM STATE OF CALIFORNIA } COUNTY OF ORANGE ,} S So CITY OF ANAHEIM ) i~ DENE M.
