RESOLUTION NO. 64R- 668 A tiESOLUTION OF TH~ CITY COUNCIL OF THE CITY OF ANAHEIM DECLAkING ITS INTENTION TO VACATE AND ABANDON PORTIONS OF AN ALLEY AND EASEMENT FOR ALLEY PURPOSES UPON, OVER, ACROSS AND ALONG THt~ HEREINAFTER DESCRIBED REAL PROPERTY; RESERVING A PUBLIC UTILITY OVERHANG EASEMENT FOR ELECTRIC POWER LINES, CROSS-AR~, ELECTRICAL AND TELEPHONE FACILITIES OVER, ALONG, ACROSS AND THROUGH A PORTION OF SAID PROPERTY; FIXING A TIME AND PLACE FOR A HEARING THEREON; DIRECTING THE POSTING OF NOTICES THEREOF AND THE PUBLICATION OF THIS I(ESOLUTION. WHEREAS, a request has been made for the abandonment of those certain portions of an alley and easement for alley pur- poses upon, over, across and along the property hereinafter described; and WHEREAS, the City Council of the City of Anaheim does elect to proceed under the provisions of the Street Vacation Act of 1941, to abandon or vacate said portions of an alley and easement for alley purposes; and WHEREAS, the City Council does declare that it intends to reserve a public utility overhang easement for electric power lines, cross-arms, electrical and telephone facilities over, along, across and through the easterly 10.00 feet of Parcel No. 1 hereinafter described, the westerly line of said 10-foot reser- vation bein parallel with and 10 feet westerly (as measured at right angles) from the east line of said Parcel No. 1. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it does hereby declare that it intends to vacate, abandon and close to public use those certain por- tions of an alley and easement for alley purposes upon, over, across and along the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Those portions of that certain alley lying within Tract No. 1565, as shown on a Map recorded in Book 49, pages 19 through 24, of Miscellaneous Maps, records of Orange County, California, located in the City of Anaheim, County of Orange, State of California, and more particularly described as follows: Parcel No. 1: Commencing at the most Northwesterly corner of Lot 120 of Tract No. 1565, as shown on a Map re- corded in Book 49, pages 19 through 24, inclusive, of Miscellaneous Maps, records of Orange County, California; thence South 89° 49' 05" East along the Northerly line of said Lot 120, a distance of -1- 90.00 feet to the true point of beginning of the parcel of land hereinafter described; thence South 89° 49' 05" East 10.00 feet; thence North 45° 10' 55~' East 14.14 feet; thence South 14° 01' 23" East 40.75 feet; thence North 72° 13' 54" West 31.47 feet; thence North 0° 10' 55" East 20.00 feet to the true point of beginning. Parcel No. 2: Commencing at the Northwesterly corner of Lot 102 of the above mentioned Tract No. 1565; thence South 0° 10' 55" West along the West line of said Lot 102, a distance of 54.16 feet to the true point of beginning of the parcel of land herein- after described; thence South 44° 49' 05" East a distance of 14.14 feet; thence South 89° 49' 05" East a distance of 10.00 feet; thence South 0° 10' 55" West 21.92 feet; thence South 74© 31' 15" West 11.15 feet; thence North 14° 55' 41" West 35.53 feet to the true point of beginning. and that it does elect to proceed under the provisions of the Street Vacation Act of 1941; and BE IT FURTHER RESOLVED that the City Council does here- by further declare that it intends to reserve a public utility overhang easement for electric power lines, cross-arms, elec- trical and telephone facilities over, along, across and through the easterly 10.00 feet of Parcel No. 1 above described, the westerly line of said 10-foot reservation being parallel with and 10.00 feet westerly (as measured at right angles) from the east line of said Parcel No. 1; and BE IT FURTHER RESOLVED that reference is hereby made to a map on file in the Office of the City Clerk for further particulars as to the proposed vacation, abandonment and closing to public use of said portions of alley and easement for alley purposes, and said reservation of said public utility easement; and BE IT FURTHER RESOLVED that a time and place for hear- ing all persons interested in or objecting to the proposed vacation and abandonment shall be fixed not less than fifteen (15) days from the date of the passage of this resolution. That the 6th day of October , 1964, at 1:30 o'clock P.M. in the Counc~Chamber in the City--Hall in the City of Anaheim is hereby fixed as the time and place for a public hearing on the matter of such vacation, abandonment and closing to public use of said portions of alley and easement for alley purposes, for all persons interested in or objecting to such proposed vacation, abandonment and closing to public use to appear and show cause, if any they have, why such portions of alley and easement and the use thereof for the purposes hereinabove mentioned should not be vacated, abandoned and closed to public use; and -2- BE IT FURTHER RESOLVED that notices of such proposed vacation and abandonment of said portions of alley and easement and the use thereof for the purposes herein mentioned shall be posted conspicuously along the lines of said portions of alley and easement at least ten (10) days before the date set for said hearing. Such notices shall be posted not more than 300 feet apart, and at least three (3) such notices shall be posted along the line of each portion of said alley and easement proposed to be vacated and abandoned. Such notices shall state the passage of this Resolution of Intention and the time and place of the hearing upon the matter of such vacation and abandonment of said portions of alley and easement; and BE IT FURTHER RESOLVED that proof of publication of any notice required by this resolution shall be made by affidavit as provided in the Code of Civil Procedure, and proof of posting of any such notice shall be made by affidavit of the person posting the notice, setting forth the facts regarding such posting; and BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage of this resolution and shall cause the same to be published in the manner prescribed by law, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City of Anaheim. this ATTEST: THE FOREGOING I~SOLUTION is approved and signed by me lSth day of September, 1964.
