RESOLUTION NO. 64R-656
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE EXE-
CUTION OF A CONTRACT WITH SOUTHERN CALIFORNIA
EDISON COMPANY FOR REDUCTION IN ELECTRIC RATES
AND FOR SETTLEMENT OF CLAIMS.
WHEREAS, the City of Anaheim and Southern California
Edison Company entered into a contract for electric service,
dated July 23, 1963, for a period of 10 years under Rate
Schedule No. R-2; and
I.~EREAS, said Edison Company has filed said contract
for electric service with the Federal Power Commission and the
same has been accepted for filing and became effective pursuant
to the Rules and Regulations of said Commission on June 11,
1964, and is designated as Rate Schedule FPC No. 15; and
WHEREAS, the Federal Power Commission, in accepting
said rates for filing, did not designate the rate schedule as
either an initial rate or a change in rates because of ques-
tions associated with possible claims by the City either as to
the lawfullness of said rate schedule under the Federal Power
Act or as to any asserted obligation of Southern California
Edison Company to have filed rate schedules with said Commis-
sion theretofore; and
I~EREAS, said Edison Company made effective on July 1,
1964, certain reductions in retail rates totaling approximately
$6.9 million in which the City did not participate, and there
is a difference of opinion between said Edison Company and the
City as to whether any further reduction in resale rates is
warranted at this time; and
WHEREAS, it is the policy of said Edison Company to
give the City full and impartial consideration in connection
with any rate reductions warranted by reductions in income
taxes or any other major cost factor, and the Edison Company
does not consider the existence of a long-term contract with
the City as a valid reason for denying it the benefits of
reductions in rates which are otherwise justified; and
WHEREAS, it is in the best interest of the City to
execute a contract for reduction in electric rates and for
settlement of claims with Southern California Edison Company.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the Mayor and City Clerk be, and
they are hereby authorized and directed to execute a contract
for reduction in electric rates and for settlement of claims
with Southern California Edison Company.
BE IT FURTHER RESOLVED that the form of contract
submitted to the City Attorney's Office by Southern California
Edison Company in its letter dated August 27, 1964, entitled
"Contract for Reduction in Electric Rates and for Settlement
of Claims," be, and the same is hereby approved as to form.

THE FOREGOING RESOLUTION is approved and signed by
