64-597 ?~ESOLUTION NO. 64R-597 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1648. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from LYLE B. MITCHELL~ JAMES A. GOSLINE and LOLA MARIE GOSLINE, owners of certain real property situated in the City of Anaheim, County of Orange~ State of California, described as follows: PORTION "A'~: The easterly 360.00 feet, measured at right angles, of the following described property. A portion of the south half of the northeast quarter of the southwest quarter of Section 27~ Township 4 South, Range 10 West, S.B.B. & M., in the Ranchos Las Bolsas, as shown on a map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the southeast corner of Tract No. 2224 as shown on a map recorded in Book 90, Page 16 of Miscel- laneous Maps, records of Orange County, said corner also being the southwest corner of Tract No. 3267 as shown on a map recorded in Book 102, page 42 of Miscellaneous Maps, records of Orange County; thence southerly along the prolongation of the easterly line of said Tract No. 2224, South 1© 56' 00'~ East 660.13 feet to a point in the south line of the southeast quarter of the northeast quarter of the southwest quarter of said Section 27; thence along said southerly line North 89© 43' 45" East 673.11 feet to a point in the easterly line of the southeast quarter of the northeast quarter of the southwest quarter of said Section 27, said easterly line also being the center line of Harbor Boulevard; thence along said center line of Harbor Boulevard North 1© 20' 30'* West 659.97 feet to a point on the northerly line of the southeast quarter of the northeast quarter of the southwest quarter of said Section 27; thence along the said northerly line, South 89© 43' 45'~ West 679.92 feet to the point of beginning. EXCEPTING THEREFROM the southerly 189.80 feet measured at right angles. EXCEPTING THEREFROM the easterly 360.00 feet measured at right angles. (The above property designated as Portions "A" and "C" to correspond to plans and specifications and Reclassification 63-64-103.) AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on July 8, 1964, notice of which said public hear- ing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 1253, Series 1964-65, recommending that Variance No. 1648 be denied; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in denying said variance and did set a public hearing thereon to be held on the llth day of August, 1964, at 7:00 o'clock P.M. in the City Hall in the City of Anaheim and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: -2- There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. That such a variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. That the granting of ~uch variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW~ THEREFORE~ BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting a waiver of the Anaheim Municipal Code minimum parking area requirement on Portion "A" hereinbefore described, and a waiver of the Anaheim Municipal Code minimum parking space, minimum floor area per dwelling unit and minimum lot area per dwelling unit requirements on Portion "C" hereinbefore described, subject to the following conditions: That this variance is granted subject to the completion of Reclassification Proceedings No. 63-64-103 now pending, and to the recorda- tion in the Office of the Orange County Recorder of the final map of Tract No. 5688. go That subject property shall be developed sub- stantially in accordance with plans and specifi- cations on file with the City of Anaheim, marked Exhibits Nos. 1 through 9, dated August 11, 1964 and signed by Mayor Chandler. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. That the above-mentioned conditions shall be complied with within a period of one year from date hereof, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein.
