64-550iIESOLUTION NO. 64R- 550 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING AND DIRECTING THE ELOCUTION OF A QUITCLAIM DEED AS TO CERTAIN INTERESTS IN A WELL AND PUMPING PLANT AGREEMENT. WHEREAS, on or about the 31st day of October, 1960, William H. Montague and Frances Elizabeth Montague, husband and wife, entered, into a water agreement with John F. Kirsch and Mary R. Kirsch and others, under and by virtue of which certain rights were reserved to William H. Montague and Frances Elizabeth Montague; and WHEREAS, through eminent domain proceedings, the City of Anaheim did succeed to the interests of said Montagues in said agreement, and since that time has had no interest in said agreement in that water is being furnished to said prop- erty through the City of Anaheim water system; and WHE}~AS, it has been requested by John F. Kirsch and Mary R. Kirsch that the City of Anaheim quitclaim and relinquish its interest in said agreement, and the City having found that it has no interest therein, NOW, THEREFOP~, BE IT RESOLVED by the City Council of the City of Anaheim that the Mayor and the City Clerk be, and they are hereby authorized and directed to execute a quitclaim deed for and on behalf of the City of Anaheim, to the following described property for the sole purpose of relinquishing its right, if any, under said pumping plant agreement: The East half of the Northwest quarter of the Northwest quarter of Section 13, Township 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Anm, as shown on a map record- ed in book 51, page 10 of Miscellaneous Maps, records of Orange County, California. Exgepting therefrom the West 330 feet of the North 650 feet thereof. Also excepting therefrom the East 255 feet of the North 160 feet of the West 585 feet 'thereof. The purpose of this deed is to quitclaim all right, title and interest in and to said land by reason of that certain well and pumping plant agreement recorded October 26, 1940 in book 1066, page 379 of Official Records and amended by an Agreement recorded March 31, 1961 in book 5674, page 947 of Official Records together with all rights of way for pipelines contained in said agreement. -1- BE IT FURTHER RESOLVED that said quitclaim deed after execution be delivered to the office of the City Attorney for forwarding to said John F. Kirsch and Mary R.
