RESOLUTION NO. 64R- 549
A RESOLUTION OF THE CITY COUNCI~ OF THE
CITY OF ANAHEIM AUTHORIZING THE COMPROMISE
OF CERTAIN EMINENT DOMAIN LITIGATION.
~EREAS, heretofore, by its resolution duly adopted
and passed on the 21st day of April, 1964, the City of
Anaheim authorized and directed the initiation of condemnation
proceedings which resulted in the commencement of Orange County
Superior Court Case No. 123352, being entitled "City of Anaheim
vs. Clarice C. Keefe, et al.~'; and
~.~ER~tS, (subject to approval of the Probate Court
of Orange County) Defendant, Clarice C. Keefe, has offered to
deed a portion (owned by said Defendant) of the property sought
to be condemned by th~ City of Anaheim to the City for a total
consideration of $7,367.10; and
~,~EREAS, there is a current escrow for the purchase
of the adjacent property at the same rate per acre as the offer
of Defendant, and the City Council of the City of Anaheim finds
that the sum of $7,667.10 is a fair and reasonable amount to be
paid for 'the 0.3651 acres condemned.
N~, THEREFORE, BE IT P~SOLVED by the City Council
of the City of Anaheim that the Director of Finance be, and
he is hereby, authorized and directed to deliver to the City
Attorney's Office the sum of $7,667.10, payable to the First
National Bank of Orange County as Conservator of the Estate
of Clarice C. Keefe, Conservatee, to be delivered to said
First National Bank of Orange when the City Attorney holds a
Conservator's Deed in favor of the City of Anaheim, approved
by the Probate Court of Orange County, ~nveying Parcel 42
of said condemnation action.
THE FOREGOING RESOLUTION is approved and signed by
me this 28th day of July, 1964.
