64-496¢.ESOhUT J~ON NO. 64R-496 A RESOLUTION OF TI-tE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM b~JNICIPAL CODE REI.~.T1NG ~O ZOb~!N6 SHOULD BE AMENDED AND THA. T THE BOU~.~DARIES OF CERTAIN ZONES SHOIH~D BE CHANGED, WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 63-64-113 ~o consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned a~d described, and at said bearing did receive evidence and reports from persons interested therein and from its staff; and WHERL5. S, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a reso- lution containing a report of its findings, a summary of the evidence presented ar said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zo~,as be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of f~.ndings, and recommendation of the City Planning Commission the City Council did fix the 14th day of ~___- ~- , 19 64 , as the time and the City Council Chambers [n the City Hall of the City of Anaheim as the place for a publJc hearing upon said proposed amendment to Title 18 of the Anaheim blunicipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did g~.ve notice thereof in the maDner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, ar the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, aad di.d give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said publi{~ hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 63-64-113 Lot Mo. iG of Tract No. 2177 as shown on a map recor&ed in Book 59, Page 37 of Miscel- laneous Maps, Records of Orange County, California· be excluded from R-I, ONE-FAMILY RESIDENTIAL ZONE, and incor- porated in C-i, NEIGHBOiLHOOD-COM~2RCIAL ZONE, upon the following conditions: That the owner of subject property shall deed to the City of Anaheim a strip o> land 53 feet in width, from the center line of the street~ along Euclid Street, for street widening purposes. (a) That all engineering requirements of the City of .... ~-~nane~.m along Euclid Street, including prepara- tion of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading an~ paving, drainage facilities, or other appurtenant work shall be complied with as required b3' the City ~%ngineer and in accordance wit]~ standard plans and specifications on file in ti'~e Office of t~e City Engineer; and (b) that a bond in an amount and form satisfactory to the Cit)~ o;~ ~inaheim shall be posted with the City to guarantee the installation of said engineering requirements. That sidewalks and ~ ~ ,~rLvewa~,s shall be installed a~ong Sumac Lane, as requi~ed by the City ~ng~neer and in accordance with standard plans an,7 speci- fications on file in the Office of the City Engineer· That the o~vner of subject property shall pay to thc~ Cit~ of Anah¢:im the sum of $2.00 per front foot~ along Euclid Street and Sumac Lane, for street li,~ting purposes. o That trash storage areas shall be provided in ac- cordance with approved plans on file in the Office o~ the Director of Public Works and Superintendent of Streets. That the alterations for commercial use shall be subject to the approval of the Chief Building In- spector. o That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked '~Exhibits Nos. 1 and 2, Revision No. 1,~ except as amended herein. That the decorative brick fence, as indicated on E×hibits ]~os. 1 an~ 2, shall be constructed along the westerly and northerly property lines, including the corner radius, and along the northerly 26 feet of the easterly property line, except for a 7-foot wide pedestrian accessway along the Euclid Street frontage and a 20-foot wide vehicular access- way along the Sumac Lane frontage. -2- i0. BE IT FURTHER R~SOLVED that the City Attorney be, and he is ~'~ereb7 authorized and directed to prepare and submit no the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be ~ecessary and proper.
