WHEREAS, th~ City Planning Commission of the City of Anaheim did hold a p..~bli.c hearing in Reclassification Proceed- ings No. 63-64-100 t~o consider an amendment to Title 18 [~ ~'he A'r',an'e{t{~"-~{~{?-'{pal Code relating to zoning, and to consider a change in the boundaries cf the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; a~sd WHERE.%S, w£th:i~ a period of forty days following said hearing thereon the Planning Commission did duly adopt a reso- lution cont'aJning a rep,:.u;t of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendme'ct be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and %~{EREAS, ui~oa receipt of said resolution, summary of evidence, report: of f~ndi'ngs, and recommendation of the City Planning Commission [:he City Council did fix the 23rd day of june , 19~: ..... , as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forrh; and did g~ve notice thereof in the mm'met and foxpro as; provided in said Title 18 of the Anaheim FMnici. pal Cc, de; and WHER. F~kS, a~: t:he time ate place fixed for said public hearing the City CCp. n~cil did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said pu'bl~c hearing before the Planning Commission, its report of f~ndings, and recommendation; and WHEREAS, t~he City Council does find and determine that: the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the CJ. ty of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange~ State of (?alifornia, to wit: 63-64-100 The :/est !00.00 feet oi~ '~he east 424~00 feet of the north 288.0G feet o~? the northwest quarter of the northwest quainter of the northeast quarter of section 13, to~Tnship 4 south~ Range 1i '?Test, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in book 51 page 11 of Miscellaneous Maps, in the office of the county recorder of said count~~. EXCEPT the north 66.00 feet thereof, as granted to the State of Califor~ia for highway purposes, by deed re- corde~'J. July !!, 1959, in book 3969 page 167 of Official Recoris. '~e e>~c!uded from R-A~ RESIDENTIAL-AGRICULTUtLAL ZONE, and incor- · ?orated in C-l, NEIGHBORHOOD-CO~fl~ERCIAL ZONE, upon th.e following conditions: (a) That all engineeri~g requirements of the City of A~ai~.eim along Lincoln Avenue, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work sl-.all be complied with as required by the City Engineer an~~ in accordance with standard plans and specifications on file in ti~e Office of the City E~.gineer; and (b) that a bond in an amount and form satisfactory to ti~e City of Anaheim shall be posted with tb~e City to guarantee the installation of said engineering requirements. o That the owners of subject property shall pa~ to 'the Cz~ of Anaheim the sum of $2.00 per front foot, along Lincoln Avenue, for street lighting purposes. T~at trash storage areas shall be provided in accord- ance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, orior to final building inspection. That the owners of subject property shall pay to 'the City of Anaheim the sum of 15¢ per front foot along Lincoln Avenue, for tree planting purposes. T~at alterations to thc ~'=~' e~.~.onzng buildings for commer- cial use shall be subject to the issuance of building oermits and/or Building Department inspection· That all nev~ construction on subject property shall be subject to approval of the Development Review Board prior to the issuance of a building permit, to insure compatibilit~ with the abutting residential uses. That a 6-foot masonry wall shall be constructed along the south property line, prior to final building in- spection. (~) Ti~at a 6-foot masonry ~.~all shall be constructed along the west property line; and (b) that a bond in an amount and~ form satisfactory to the City of Anaheim shall be ~osted w~~ th the City to guarantee ti~e con- struction of said wall. -2- o That provision shall be made for an accessway 21 feet in width, with a 14-foot vertical clearance into the rear por'~_ion of subject property, when the rear property is developed to its highest and best use, if determined to be necessary by the Director of Public Works. 10. That Conditions Nos. l(b)~ 2, 4 and 8(b) above-men- tioned shell be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
