64-414RESOLUTION NO. 64R-4i4 A ?~SOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 562. WHEREAS, the City Planning Conm~ission of the City of Anaheim did receive an application from JAMES SPAPRIES, 146 Anned Drive, Placentia, California, for a Conditional Use Permit to establish a 'trailer sales on Parcel "A" of the real property hereinafter described and a mobile home park on Parcel "B" of the real property hereinafter described. Said real property is situated in the City of Anaheim, County of Orange, State of California, and is more particularly described as follows, to wit: PARCEL "A'~: The most Southerly 200.00 feet of that portion of the Southwest quarter of the Southwest quarter of Section 12, Township 4 South, Range 11 West, described as follows: Beginning at a point in the South line of said Section 12 said point being located 648.71 feet North 89© 41' 10~' East from the Southwest corner of said Section 12, said point being on the West line of the East 15.00 feet of the East half of the West half of the Southwest quarter of the Southwest quarter of Section 12; thence North 0° 10' 49" West 815.00 feet along the said West line of the East 15.00 feet to a point in a line parallel with and 815.00 feet Northerly from the South line of said Section 12~ thence South 89© 41' 10" West 316.93 feet along said parallel line to a point in the West line of the East half of the West half of the Southwest quarter of the Southwest quarter of said Section 12; thence North 0© 11' 10'~ West 513.23 feet along the West line of the said East half of the West half to a point in the North line of the said Southwest quarter of the Southwest quarter of Section 12; thence North 89° 41' 20" East 661.98 feet along said North line to a point in the East line of the West 330.00 feet of the East half of the Southwest quarter of the Southwest quarter of said Section 12; thence South 0© 10' 49" East 1328.23 feet along the East line of the said West 330.00 feet to a point in the South line of said Section 12; thence South 89© 41' 10" West 345.00 feet along said South line to the point of beginning. EXCEPT the most Southerly 200.00 feet 'therefrom. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim Upon said appli- cation on April 27, 1964, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 1147 Series 1963-64, grant- ing Conditional Use Permit No. 562, subject to certain condi- tions set forth in said resolution; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said Conditional Use Permit and ~id thereupon fix the 3rd day of June, 1964, as the time and the Council Chamber in the City Hall of the C._~y of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by Law an~ the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hear- ing, the City Council did duly hold and conduct such hearing and did give all persons interested, therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, 'the City Council finds, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. Be The size and shape of the site proposed for the use is adequate to allow the full development of -2- the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEi~FORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting said Conditional Use Pe~it be, and the same is hereby sustained, and that Conditional Use Permit No. 562 be, and the same is hereby, granted permitting the establishment of a trail- er sales on Parcel '~A': hereinbefore described, and the estab- lishment of a mobile home park on Parcel "B'~ hereinbefore de- scribed, subject to the following conditions: That trash storage areas shall be provided in accordance ~ith approved plans on file in the Office of the Director of Public Works, prior to final building inspection. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, prior to final building inspection. That the o~er of subject property shall pay to the City of Anaheim the sum of $25.00 per trailer soace, to be used. for park and recreation purposes, said amount to be paid. at the time the building permit is issued· That soil tests, sufficient and adequate for a determination of the requirements for site construc- tion and installation of sewer and water facilities, shall be submitted to the Building Department prior to the issuance of a building permit. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked "Exhibits Nos. 1 and That landscaping shall be installed as indicated on Exhibit No. 1; provided, however, that one tree shall be planted for every trailer space, and that a 20-foot landscaped front yard setback shall be maintained. That plans for said. landscaping shall be submitted to and approved by the Superintendent of Pari~way Maintenance, and that said landscaping shall be installed prior to final building inspection. That a 6-foot masonry wall shall be constructed as indicated on Exhibit No. 1, prior to final building inspection. -3- That a 6-foot solid fence shall be constructed on the east property line, prior to final building inspection. That this Conditional Use Permit is granted subject to the completion of Reclassification Proceedings No. 63-64-110 now pending. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
