64-387RESOLUTION NO. 64R-387. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 63-64-102 to consider an amendment to Title 18 of the Anaheim Municipal Code relating tO zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; amd WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 19th day of May , 196~ ., as the time and the City Council Chambers i~ the City Hall of the City of Anaheim as the Place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said.prop- erty~ hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 63-64-102 The North 320.00 feet of the South 832.00 feet of the Northeast quarter of the southeast quarter of section 13, Township 4 South, Range 11 West~ in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in 'book 51 page 11 of Miscellaneous Maps, in the office of the county recorder of said county. EXCEPT that portion thereof included within Tract No. 2874, as shown on a map recorded in book 81 pages 38 to 42 inclusive of said Miscellaneous Maps. ALSO EXCEPT that portion thereof lying westerly of the easterly line of Tract No. 4750, as per map recorded in book 171 pages 30 and 31 of said Miscellaneous Maps. ~LSO EXCEPT that portion thereof described as follows: Beginning at an angle point on the boundary of Tract No. 2874, per map thereof recorded in book 87 pages 38 to 42, inclusive, of said Miscellaneous Maps, easterly 50.00 feet from the southeast corner of lot 63 of said Tract, said angle point being on the East line of said southeast ~uarter; thence South 0° 09' 35" West 82.00 feet along said East line to the true point of beginning; thence South 0° 09' 35'~ West 160.15 feet along said East line; thence South 89° 58' 50" West 262.23 feet to the easterly line of Tract No. 4750, per map thereof recorded in book 171 pa~es 30 and 31 of said Miscellaneous Maps; thence North 3v 48' 25" East 160.51 feet along said east- erly line to a line bearing South 89° 58' 50" West from the true point of beginning; thence North 89° 58' 50" East 252.02 feet to the true point of beginning. Said land is included within the area shown on a map filed in book 27 page 24 of Record of Surveys, in the office of the county recorder of said county. be excluded from R-A, RESIDENTIAL-AGRICULTURAL ZONE, and incor- porated in R-l, ONE-FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street~ along Magnolia Avenue, for street widening purposes. 2. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Magnolia Avenue, for street lighting purposes. 3. That the owner of subject property shall pay to the City of Anaheim the sum of 15¢ per front foot along Magnolia Avenue, for tree planting purposes. 4. That a Record of Survey to record the approved division of subject property shall be recorded in the Office of the Orange County Recorder. 5. That the building line set-back for dwellings shall be that of the minimum set-back of existing homes in the area. -2- 6. That Conditions Nos. 1, 2, 3 and 4 above-mentioned shall be complied with within a period Of 180 days from date hareof~ or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
